HomeMy WebLinkAbout990235.tiff RESOLUTION RE: APPROVE MEMORANDUM OF UNDERSTANDING AND AUTHORIZE CHAIR TO SIGN WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with a Memorandum of Understanding among the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, Rocky Mountain National Park, and Larimer County, Colorado, with terms and conditions being as stated in said memorandum of understanding, and WHEREAS, after review, the Board deems it advisable to approve said memorandum of understanding, a copy of which is attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Memorandum of Understanding among the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, Rocky Mountain National Park, and Larimer County, Colorado, be, and hereby is, approved. BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to sign said memorandum of understanding. The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 8th day of February, A.D., 1999. Kirkmeyer P -Tem Deputy Clerk to th r a � '�iV°\\ Georg er ROV AS O FORM: J. eile my ney Glenn VaaS 990235 BC0024 MOU-1520-9-9001 MEMORANDUM OF UNDERSTANDING between ROCKY MOUNTAIN NATIONAL PARK, LARIMER COUNTY, COLORADO, and WELD COUNTY, COLORADO Whereas, the Cache la Poudre River Corridor Act (The Act), Public Law 104-323, was enacted by the Congress in October 1996, with its mission to be carried out by a citizen commission (The Commission), and Whereas, the mandate of The Act, under the direction of The Commission, is to develop an interpretive plan for this river corridor, and Whereas, technical problems with the language of The Act have delayed the appointment of The Commission, and Whereas, Rocky Mountain National Park, Larimer County, and Weld County, Colorado, wish to expedite the will of Congress and of local communities in implementing the mission of the Poudre Corridor Act, Now, therefore, Rocky Mountain National Park, Larimer County, and Weld County desire, as an interim measure to forward the purposes of the Poudre Corridor Act, to enter into an exchange of information in accordance with the following stipulations: STIPULATIONS This exchange of information will be to develop a foundation upon which The Commission, once appointed, will be able to proceed more expeditiously with accomplishing the provisions of The Act. Larimer County agrees to serve as a conduit to other interested parties in the Poudre Corridor, in both the provision of information and involvement in this exchange. Exchange of information may include, but is not limited to: GIS mapping data, identification of interpretive sites, present public corridor facilities and management, and present corridor planning Discussions will be to insure the successful implementation of The Act, and will aid,but in no way usurp the primacy of, The Commission in achieving this goal. Larimer County, Weld County, and Rocky Mountain National Park agree to meet periodically to discuss issues associated with implementation of The Act. The counties will assume responsibility for inviting whomever they consider appropriate to participate in these meetings. 990235 Rocky Mountain National Park agrees to proceed with the recruiting and hiring of two employees to work on preliminary tasks associated with implementation of The Act; work priorities will be determined by Larimer and Weld Counties. This Memorandum of Understanding will terminate upon appointment of The Commission; from that time onward The Commission will guide all work related to the Cache la Poudre River Corridor Rocky Mountain National Park, Larimer County, and Weld County strongly support the Cache la Poudre River Corridor, and the many good efforts and entities involved in the realization of this goal. Civil Rights During the performance of this agreement, the participants agree to abide by the terms of the USDI-Civil Rights Assurance Certification, non-discrimination and will not discriminate against any person because of race, color, religion, sex or national origin. The participants will take affirmative action to ensure that applicants are employed without regard to their race, color, religion, sex, or national origin. Officials Not to Benefit No member or delegate to Congress shall be admitted to any share or part of this agreement, or to any benefit that may arise therefrom, but this provision shall not be construed to extend to this agreement if made with a corporation for its general benefit. Public Information Release Larimer and Weld Counties must obtain prior approval from Rocky Mountain National Park for any public information releases which refer to the Department of the Interior, any bureau, park unit, or employee (by name or title), or this agreement. The specific text, layout, photographs, etc., of the proposed release must be submitted with the request for approval.
