Hall, Chair Commissioner Barbara J. Kirkmeyer, Pro-Tem - EXCUSED Commissioner George E. Baxter Commissioner M. J. Geile Commissioner Glenn Vaad Also present: Acting Clerk to the Board, Esther Gesick Assistant County Attorney, Lee Morrison Planning Department representative, Julie Chester Health Department representative, Sheble McConnellogue Public Works representative, Don Carroll The following business was transacted: I hereby certify that pursuant to a notice dated June 16, 1999, and duly published June 19, 1999, in the Fort Lupton Press, a public hearing was conducted to consider the request of Jerry and Jeannie Bess for a Fishery in the A (Agricultural) Zone District. Lee Morrison, Assistant County Attorney, made this a matter of record. Julie Chester, Department of Planning Services, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. Ms. Chester stated eight referral agencies responded favorably to the proposal with conditions, and added the proposal complies with the Weld County Zoning Ordinance, Comprehensive Plan and Agricultural Zone District. She stated Planning Services staff determined that fish farming is a commercial use which is directly related to agriculture; however, it does not fit the definition of livestock as defined by the Zoning Ordinance, thus requiring a Special Review Permit. Ms. Chester gave a brief description of the location of the site and surrounding uses and stated the applicants have already met Conditions of Approval#2.A through #2.H; therefore, she requested they be deleted. In response to Commissioner Geile, Ms. Chester stated the parcel is 80 acres in size; however, the fish ponds will cover seven to ten acres. In response to Chair Hall,Jerry and Jeannie Bess, applicants, stated they have reviewed and agree with the Conditions of Approval and Development Standards. In response to Commissioner Geile, Ms. McConnellogue explained Condition #2.H was originally required due to the type of process used to remove the sludge; however, the applicants have decided not to use chemical treatments which eliminate the sludge. (Switched to Tape #99-23.) Responding to Commissioner Vaad, Shannon Keeton, Keeton Industries, Inc., stated his company manufactures the sludge reducer, and explained there will be five irrigation wells on the southwest quarter of the property which supply water to the fish ponds. He stated the water then flows into a collection pond and can be pumped underground to be used for irrigation. Pt, /-11-- //7L 991138 cc. Commissioner Baxter moved to approve the request of Jerry and Jeannie Bess for a Site Specific Development Plan and Special Review Permit#1228 for a Fishery, based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record, and deletion Conditions of Approval #2.A through #2.H with the remaining Conditions renumbered. The motion was seconded by Commissioner Geile, and it carried unanimously. This Certification was approved on the 7th day of July, 1999.
