HomeMy WebLinkAbout951329.tiffHEARING CERTIFICATION DOCKET NO. 95-40 RE: SITE SPECIFIC DEVELOPMENT PLAN AND AMENDED SPECIAL REVIEW PERMIT #881 FOR AN EXISTING RECREATIONAL FACILITY TO HOLD COMPETITIVE EVENTS IN THE A (AGRICULTURAL) ZONE DISTRICT - LAKEVIEW VILLAGE, INC., C/O DORIS PAVLICK A public hearing was conducted on June 21, 1995, at 10:00 a.m., with the following present: Commissioner Dale K. Hall, Chairman Commissioner Barbara J. Kirkmeyer, Pro-Tem Commissioner George E. Baxter Commissioner Constance L. Harbert Commissioner W. H. Webster Also present: Acting Clerk to the Board, Shelly Miller Assistant County Attorney, Lee Morrison Planning Department representative, Todd Hodges The following business was transacted: I hereby certify that pursuant to a notice dated May 24, 1995, and duly published June 8, 1995, in the Windsor Beacon, a public hearing was conducted to consider the request of Lakeview Village, Inc., c/o Doris Pavlick, for a Site Specific Development Plan and Amended Special Review Permit for an existing recreational facility to hold competitive events in the A (Agricultural) Zone District. Lee Morrison, Assistant County Attorney, made this a matter of record. Todd Hodges, Planning Department representative, presented a brief summary of the proposal and stated the Development Standards and Conditions of Approval meet the concerns of the surrounding property owners and referral agencies. He then entered the favorable recommendation of the Planning Commission into the record as written. Responding to questions from the Board, Mr. Hodges stated no violations are on record for this site and the applicant will be bound by the same Conditions of Approval and Development Standards as are attached to the existing Permit. Doris Pavlick, owner and representative for the applicant, stated the site has been used for recreation since 1989, and they are now requesting competitive events be allowed in the summer. Responding to questions from the Board, Ms. Pavlick stated trees are not required and the noise level is maintained. She said the trees originally planted died, but more trees are growing now, noting trees cannot be planted on the dam side. Ms. Pavlick stated the neighbor closest to the site has never had any problems. She noted the club is private to members, who are owners, and is not open to the public. She stated there are approximately ten owners, with twelve being the maximum number allowed. Ms. Pavlick stated the competitive events will allow public who are members of the Water Ski Association on site and club members' boats will be used. She stated trailers owned by members are stored on site from November through April. Ms. Pavlick confirmed the toilets are vaulted and on site now. Howard Wargo, surrounding property owner, voiced concerns and submitted a letter, Exhibit B for the record, with other surrounding property owners' signatures objecting to the proposal. He confirmed musk and Canada thistle, noxious weeds, are growing on site. Let the record reflect a recess was taken at this time. Upon reconvening, Ms. Pavlick stated the lakes are not sewer water and are tested by the Health Department under contract; therefore, the water is not unsafe and meets requirements. Reference was made to Development Standard #4 of the original Permit requiring monthly monitoring of the water quality. Ms. Pavlick reiterated landscape on the dam is not required; however, it has been reseeded twice, mowed, and sprayed. Responding to further questions from the Board, Ms. Pavlick stated the weeds were sprayed last fall and will be sprayed again. She confirmed Gerrity Oil and Gas Corporation will fence the well once work on the well is completed. Ms. Pavlick addressed the boat noise, which is kept to a minimum and does not exceed the 55 decibel limit, and confirmed trailer sewage is pumped by Johnson Septic of Longmont or taken off site to a proper dumping site. She noted the surrounding neighbors were contacted prior to the original 951329 PL0476 RE: HEARING CERTIFICATION - LAKEVIEW VILLAGE, INC., C/O DORIS PAVLICK PAGE 2 Permit and there were no objections. Ms. Pavlick also confirmed all proper building permits were obtained. Mr. Hodges recommended the maximum noise level, as required in Development Standard #9, be changed from 70 to 55 decibels, and Ms. Pavlick agreed. Responding to further questions from the Board, Trevor Jiricek, Health Department, stated the Tri-Area Sanitation District water is disinfected and chlorinated and all water is tested for bacteria. He confirmed samples are done monthly pursuant to State requirements, and no problems have occurred. Mr. Hodges confirmed trailers can be on site year round and screening is not required since the site is fairly well screened naturally. He reiterated no violations are on record and a recent inspection was completed. Mr. Hodges also noted Development Standard #18 requires to the property owner or operator to comply with the Operation Standards of Section 24.6 of the Zoning Ordinance, which includes weed control. Mr. Morrison read said section into the record and confirmed it is automatically attached to Special Review Permits. Mr. Hodges noted random inspections and notification by surrounding property owners are possible ways of discovering problems. Commissioner Harbert stated there is no record of noncompliance and after hearing staffs testimony she will move to approve the request of Lakeview Village, Inc., do Doris Pavlick, for a Site Specific Development Plan and Amended Special Review Permit for an existing recreational facility to hold competitive events in the A (Agricultural) Zone District, based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record, and changing Development Standard #9 from 70 to 55 decibels. The motion was seconded by Commissioner Webster, and it carried unanimously. This Certification was approved on the 26th day of June, 1995.
