RE: ACTION OF BOARD AT SHOW CAUSE HEARING CONCERNING REVOCATION OF
SPECIAL REVIEW PERMIT #820 - HUSKER DAIRY% GENE HOYER
A public hearing was conducted on June 15, 1998, at 10:00 a.m., with the following present:
Commissioner Constance L. Harbert, Chair
Commissioner W. H. Webster, Pro-Tem
Commissioner George E. Baxter
Commissioner Dale K. Hall
Commissioner Barbara J. Kirkmeyer
Also present:
Acting Clerk to the Board, Esther Gesick
Assistant County Attorney, Lee Morrison
Planning Department representative, Julie Chester
Health Department representative, Trevor Jiricek
The following business was transacted:
I hereby certify that pursuant to a notice dated August 13, 1997, and duly published October 16,
1997, in the South Weld Sun, a Show Cause hearing was conducted on November 5, 1997, to
consider the revocation of Special Review Permit #820 for a Livestock Confinement Operation
(2,500-head dairy) in the A (Agricultural) Zone District, currently held by Husker Dairy, % Gene
Hoyer, owner, P.O. Box 69, Broken Bow, Nebraska 68822. At said hearing, the Board deemed
it advisable to continue said matter to May 6, 1998, at 10:00 a.m. On May 6, 1998, Health and
Planning staff recommended this matter be continued to June 15, 1998, due to progress being
made at the site. Lee Morrison, Assistant County Attorney, made this a matter of record. Trevor
Jiricek, Health Department representative, presented a joint recommendation from the Health and
Planning Services staff that this Show Cause Hearing be closed. Mr. Jiricek explained the facility
has complied with the Conditions of Approval as listed on the May 6, 1998, Resolution, Confined
Animal Feeding Operation Control (CAFO) Regulations, Special Review Permit#820 Conditions of
Approval and Development Standards, and the Weld County Zoning Ordinance. The applicant was
not present. No public testimony was offered concerning this matter.
Commissioner Hall moved to close the Show Cause Hearing. The motion was seconded by
Commissioner Baxter, and it carried unanimously.
