RE: APPROVE INTERGOVERNMENTAL AGREEMENT FOR REPAIRING BRIDGE
#11/16C WITH TOWN OF FREDERICK, COLORADO, AND AUTHORIZE CHAIR TO
SIGN
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with an Intergovernmental Agreement for
Repairing Bridge #11/16C between the County of Weld, State of Colorado, by and through the
Board of County Commissioners of Weld County, on behalf of the Department of Public Works,
and the Town of Frederick, Colorado, with terms and conditions being as stated in said
agreement, and
WHEREAS, after review, the Board deems it advisable to approve said agreement, a
copy of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the Intergovernmental Agreement for Repairing Bridge #11/16C
between the County of Weld, State of Colorado, by and through the Board of County
Commissioners of Weld County, on behalf of the Department of Public Works, and the Town of
Frederick, Colorado, be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized
to sign said agreement.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 12th day of May, A.D., 1997.

INTERGOVERNMENTAL AGREEMENT FOR REPAIRING BRIDGE 11/16C
THIS INTERGOVERNMENTAL AGREEMENT (the "Agreement") if made and entered
into as of the/ol day of '%'] , 1997, by and between the Town of Frederick, whose
address is P.O. Box 435, Frederickrado, 80530, hereinafter referred to as "Frederick," and
the County of Weld , State of Colorado, by and through the Board of County Commissioner of
Weld County, whose address is P.O. Box 758, Greeley, Colorado 80632, hereinafter referred to
as "Weld County."
WITNESSETH:
WHEREAS, Weld County Bridge 11/16C, hereinafter referred to as "Bridge 11/16C,"
located over the Sullivan Ditch on Weld County Road (WCR) 11, has a badly corroded metal
deck which is in need of replacement, and
WHEREAS, the west one-half of WCR 11 was annexed by the Frederick in 1988 as part
of the Grant Annexation and, as a result, Frederick and Weld County share maintenance
responsibility for said Bridge 11/16C, and
WHEREAS, the parties hereto now desire to split the cost of the deck replacement of said
Bridge 11/16C on a 50/50 basis.
NOW, THEREFORE, in consideration of the mutual promises and covenants contained
herein, the parties hereto agree as follows:
DECK REPLACEMENT FOR BRIDGE 11/16C AND SHARING OF COSTS: Weld
County shall proceed with the replacement of the deck for Bridge 11/16C at its earliest
convenience, but in no event later than December 31, 1997. The estimated cost of
replacement of the deck is $30,000.00. Frederick agrees to pay one-half of the cost of
replacement for an amount not to exceed $15,000.00. Upon completion, Weld County
shall bill Frederick for it's portion of the cost. Frederick shall pay the same on or before
July 30, 1998. In the course of said work, Weld County shall use its best efforts to detour
traffic and to sign said detour in accordance with the requirements of the Manual on
Uniform Traffic Control Devices.
2. TERM: This Agreement shall be for the term beginning upon signature of the
parties and ending upon completion of the deck replacement and payment by Frederick
for its portion of the cost.
3. NO WARRANTIES OR GUARANTEES OF WORK: Weld County shall use all
appropriate methods to completing the work contemplated herein and provides no
warranties or guarantees of its work.
4. AMENDMENTS/ENTIRE AGREEMENT: This Agreement may be amended if done so

in writing by the parties. This Agreement comprises the entire agreement of the parties
with respect to the work contemplated herein.
5. NO WAIVER OF IMMUNITIES/NO THIRD PARTY ENFORCEMENT: None
of the provisions of this Agreement shall be interpreted or construed as a waiver of any of
the immunities to liability held by either or both of the parties. This Agreement is
intended to benefit only the parties hereto and may not be enforced by any third party,
either on its own behalf or on the behalf of either party hereto.
IN WITNESS WHEREOF, the above parties hereto have caused this Agreement to be
executed.

A recent inspection of bridge 11/16C has revealed the bridge's metal deck is badly corroded. The
bridge is over the Sullivan Ditch on WCR 11 approximately 3/10 mile south of WCR 18. It has been
posted for a three ton weight limit.
The west one-half of WCR 11 was annexed by the Town of Frederick in 1988 as part of the Grant
Annexation; therefore, bridge 11/16C is a shared responsibility between the Town of Frederick and
Weld County.
Bridge 11/16C was constructed in 1959. It has a good concrete foundation, and the steel beams are
in good condition. The corroded metal deck and the old guard rails could be replaced for
approximately $30,000. The existing structure is only 24 feet wide. Weld County's minimum width
for new structures is 32 feet. We do not recommend widening the existing structure because it is 38
years old, and the cost would exceed $80,000. To construct a new bridge 32 feet wide with concrete
foundations, steel beams, and a metal deck will cost approximately $130,000.
At the present time, the traffic on WCR 11 is approximately 200 vehicles per day. Although a 24
foot width is minimal, redecking the old bridge will accommodate the present traffic. If
development occurs in the area and traffic increases, the 24 foot width will not be adequate. On the
other hand, when development does occur, part of the cost of a new bridge could be recovered from
the new development.

It is the Commissioners' policy to split the cost of joint projects on a 50/50 basis. Weld County will
either redeck or replace bridge 11/16C based on the Town of Frederick's decision. When I hear from
you, I will draft a brief Intergovernmental Agreement for the Town Board and Commissioners
approval.
