REQUEST: Site Specific Development Plan and Planned Unit Development Final Plan for a redesign of
Rademacher Business Park PUD (26 lots).
LEGAL DESCRIPTION: Part of the NW/4 of Section 23, T3N, R68W of the 6th P.M.,
Weld County, Colorado
LOCATION: South of and adjacent to WCR 32; east of and adjacent to 1-25.
PARCEL: 1207 23 002000
THE DEPARTMENT OF PLANNING SERVICES' STAFF RECOMMENDS THAT THIS REQUEST
BE APPROVED FOR THE FOLLOWING REASONS:
1. The submitted materials are in compliance with the application requirements of Section 28.9 of the
Weld County Zoning Ordinance, as amended.
2. The request is in conformance with Section 28.13 of the Weld County Zoning
Ordinance, as amended as follows:
a. The proposed P.U.D. Final Plan is consistent with the Weld County Comprehensive Plan and
is compatible with the future development as permitted by the existing P.U.D. District and

plans of affected municipalities. This proposal is an amendment to case S-241 which was
approved on November 28, 1984 for a final planned unit development plan for a commercial
and industrial subdivision. This proposal is located within the referral area of the Town of
Mead.
b. The P.U.D. Plan conforms to the approved P.U.D. District. The Utility Coordinating Advisory
Committee reviewed and conditionally approved the P.U.D. utility plan at its March 13, 1997
meeting. The concerns of the Utility Coordinating Advisory Committee have been addressed
by the applicant.
c. The uses, buildings, and structures shall be compatible with the existing and future
development of the surrounding area as permitted by the existing zoning, and with the future
development projected by the Comprehensive Plan or Master Plan of affected municipalities.
d. The proposed P.U.D. Final Plan conforms with the performance standards in Section 35.3 of
the Weld County Zoning Ordinance.
e. The proposed P.U.D. Final Plan will be in compliance with the Weld County Zoning
Ordinance, Section 50, Overlay Districts. The site is not located within any Overlay Districts.
This recommendation is based, in part, upon a review of the application materials submitted by the applicant,
other relevant information regarding this request, and responses from referral entities.
The Department of Planning Services' staff recommendation for approval is conditional upon the
following:
1. Prior to recording the P.U.D. Final Plan plat:
a. The Board of County Commissioners shall review and approve the subdivision improvements
agreement for on -site improvements and the form of collateral. The security for the agreement
shall be tendered and accepted by the Board of County Commissioners for the subdivision
improvements agreement.

b. The applicant shall submit written evidence to the Department of Planning Services that the
concerns of the Colorado Geological Survey as listed in the letter from Celia Greenman, dated
February 25, 1997 have been addressed.
c. The applicant shall submit written evidence for review and approval by the Department
of Planning Services that the residential use of Lot 10 and the existing access have been
on site prior to the PUD Zone Change in 1984. If a Non -conforming Use file can be
established for the existing use of Lot 10 once the use of the property changes the existing
access to WCR 9 1/2 shall be removed and the uses on Lot 10 shall conform with the PUD
Zone District and the PUD Final Plan.
2. The following notes shall be placed on the P.U.D. Final Plan plat prior to recording:
a. The uses permitted within the P.U.D. Final plan for the redesign of Rademacher Business Park
are commercial and industrial uses which comply with the P.U.D. zone district requirements
and as described in the application materials.
b. Approval of this plan may create a vested property right pursuant to
Section 90 of the Weld County Zoning Ordinance.
c. Little Thompson Water District shall provide domestic water service to all commercial and
industrial uses within the PUD Zone District.
d. Individual septic systems will provide sewage disposal for each lot. At the Site Plan Review
stage the applicant and/or property owner shall designate an appropriate area, on each lot, for
a replacement septic system. The area shall be based on the approximate hydraulic flows
considered for the proposed use as well as any further expansion.
e. Any operation which will produce a non -domestic sewage wastewater must
submit a plan of disposal with the Site Plan Review for review and approval by the Weld
County Health Department. The plan must describe the process which creates the wastewater,
proposed method of treatment, and any additional information as determined necessary by the
Weld County Health Department.

f. Installation of all utilities shall comply with Section 10 (Design Standards) of the Weld County
Subdivision Ordinance, as amended.
g.
All uses within the P.U.D. Final Plan shall comply with the requirements of the Mountain
View Fire Protection District.
h. Access to the development shall be from Weld County Road 9 1/2 and the I-25 frontage road.
i. Street signs and lot identification shall be in place prior to release of building permits.
j. Exterior illumination of structures, yards, and driveways shall be restricted as follows:
(I)
Sources of light shall be shielded so that beams of light will not shine directly onto
adjacent properties.
(2) Neither the direct or reflected light from any light source may create a traffic hazard
to operators of motor vehicles on public or private streets.
k. All liquid and solid wastes shall be stored and removed for final disposal in a manner that
protects against surface and groundwater contamination.
I. No permanent disposal of wastes shall be permitted at this site.
m. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust,
blowing debris, and other potential nuisance conditions.
n. Fugitive dust shall be controlled on this site.
o. Interior lot line utility easements shall be required only when needed by the utility or service
company.
P.
No structures shall be permitted on the gas pipeline easement as shown on the Final Planned
Unit Development Plan Plat.

q.
The site shall maintain compliance with the requirements/standards of the Colorado
Department of Transportation.
r. Prior to any development of lots within the Rademacher Business Park PUD a Site Plan Review
application shall be submitted, reviewed, approved and all conditions met. The Site Plan
Review shall include landscape design which meets the intent of the landscaping requirements
of Ordinance 191.
s. Once the Non -conforming use of Lot 10 changes, Lot 10 shall conform with the existing
PUD Zone District and the PUD Final Plan.

Subject: S-422 - Request for approval of a Planned Unit Development Final Plan for a Redesign of
Rademacher Business Park Planned Unit Development (26 lots) on a parcel of land described
as a part of the NW4 of Section 23, T3N, R68W of the 6th P.M., Weld County, Colorado
Dear Mr. Leffler:
Your application and related materials for the request described above are complete and in order at the
present time. I have scheduled a meeting with the Weld County Planning Commission for Tuesday, April
15, 1997, at 1:30 p.m. This meeting will take place in the Weld County Centennial Center, 915 Tenth
Street, Greeley, Colorado. In addition, I have scheduled a meeting with the Weld County Utilities Advisory
Committee for Thursday, March 13, 1997, at 10:00 a.m. This meeting will take place in the Weld County
Administrative Offices, 1400 N. 17th Avenue, Greeley, Colorado.
It is the policy of Weld County to refer an application of this nature to any town or municipality lying within
three miles of the property in question or if the property under consideration is located within the
comprehensive planning area of a town or municipality. Therefore, our office has forwarded a copy of the
submitted materials to the Mead Planning Commission for its review and comments. Please call Kelly
Smith with the Town of Mead at 970-535-4477, for information regarding the date, time and place of the
meeting and the review process.
It is recommended that you and/or a representative be in attendance at each of the meetings described
above in order to answer any questions that might arise with respect to your application.
Sometime prior to April 5, 1997, a representative from the Department of Planning Services will be out to
the property to post a sign adjacent to and visible from a publicly maintained road right-of-way which
identifies the hearing time, date, and location. In the event the property under consideration is not adjacent
to a publicly maintained road right-of-way, one sign will be posted in the most prominent place on the
property and post a second sign at the point at which the driveway (access drive) intersects a publicly
maintained road right-of-way.
The Department of Planning Services' staff will make a recommendation concerning this application to the
Weld County Planning Commission. It is the responsibility of the applicant to contact the Department of
Planning Services office a few days before the date of the hearing to obtain that recommendation.
