Dear Mr. and Mrs. Dent:
The parcel as described above and consisting of approximately 2.69 acres,more or less,is considered a
buildable, legal lot. The parcel is separated by a deeded right-of-way on the east side,and by county
roads to the south and west, as was recognized during the processing of RE-1795 as a separate buildable
parcel. However,the property is located within the 100 year floodplain,as defined on the FEMA map
community-panel number 080266 0488 C. A Flood Hazard Development Permit would be required for
any kind of construction,building,etc. I have included a copy of both the FEMA map as well as a copy of
the Flood Hazard Development Permit procedural guide. Should you have any additional questions,I may

RESOLUTION
RE: ACTION OF BOARD CONCERNING SUBSTANTIAL CHANGE HEARING (SCH) #16
REGARDING RE #1795 - MARTIN/DIERKS
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners held a public hearing on the 29th day of
May, 1996, at the hour of 9:00 a.m. in the Chambers of the Board, on behalf of Harold Martin and
Colleen Dierks, do A. Bruce Johnson, 801 8th Street, Suite 220-I, Greeley, Colorado 80631, for
the purpose of considering whether or not there has been a substantial change in the facts and
circumstances regarding the application for RE #1795 which was denied by the Board of County
Commissioners by Resolution dated October 18, 1995, and
WHEREAS, said action was taken concerning property described as:
Part of the SW'/4, Section 5, Township 6 North,
Range 65 West of the 6th P.M., Weld County,
Colorado
WHEREAS, at said hearing on May 29, 1996, the Board deemed it advisable to continue
said matter to June 10, 1996, at 9:00 a.m., and
WHEREAS, at said hearing on June 10, 1996, Harold Martin, applicant, and Bruce
Johnson, real estate agent, were present, and
WHEREAS, said hearing was conducted pursuant to the Board's policy concerning
applications for land use for property previously denied, as set forth in the Weld County
Administrative Manual, and
WHEREAS, the Board of County Commissioners heard all of the testimony and statements
of those present, studied the request of the applicant and having been fully informed, finds that said
request to apply for a recorded exemption shall be approved for the following reasons:
1. It is the opinion of the Board of County Commissioners that the applicant has
demonstrated that a substantial change in facts and circumstances has occurred.
a. Approval of RE #1795 would have resulted in the potential for
sprawl-row-type development and the addition of another buildable site to
the immediate area.
b. The applicants now propose an arrangement of the lots whereas no
additional potential for a residential buildable lot would exist, since both
proposed lots include an existing residence.

NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that there has been a substantial change in the facts and circumstances
regarding the application of Harold Martin and Colleen Dierks for a Recorded Exemption #1795.
BE IT FURTHER RESOLVED by the Board that the request of Harold Martin and Colleen
Dierks to apply for a recorded exemption be, and hereby is, approved.
The above and foregoing Resolution was, on motion duly made and seconded, adopted by

Dear Commissioners:
This request for a recorded exemption is submitted by J. Moody. The parcel of land under consideration
is part of the SW4 of Section 5,Township 6 North,Range 65 West of the 6th.P.M.,Weld County,Colorado.
The property lies within the urban growth boundary of Eaton,approximately one mile southeast of the town.
No residence currently exists on proposed Lot A. Currently,proposed Lot B consists of the two residences
and improvements,with the remainder of the property in agricultural production. Agricultural production
is consistent with the majority of the surrounding properties.
An existing septic system provides Lot B with sewage disposal. A septic system is proposed for Lot A.
There are two existing accesses serving proposed Lot B off of WCR 39, and one existing access serving
proposed Lot A off of WCR 72. Currently,proposed Lot B is served by public water from the North Weld
County Water District. Proposed Lot A would also be served by public water from the North Weld County
Water District.
The applicant is proposing to divide an 18 acre parcel,created by deeded ditch right-of-ways, into two Lots
of 13 acres+/-, and 5 acres+/-. The application states the purpose of the division of land is "...to sell the
building and 13 +1-acres to a couple and their daughter who desire this specific arrangement. The daughter
and parents will share care taking responsibilities of the farm and buildings. The parents will soon be
retiring."

Staff feels the application for a recorded exemption is not consistent with the intent of the recorded
exemption:
A. Enable the property owner who is retiring an opportunity to live on or sell the existing farm
improvements.
B. Enable the property owner to sell off agricultural land that is nonproductive for one single
family dwelling homesite.
C. Enable the property owner to provide a residence for direct members of the farm family and also
for workers employed at the farm.
Furthermore,there are potentially six buildable lots on WCR 72, from WCR 39 to WCR 41. The approval
of the recorded exemption would leave seven potential buildable lots along c mile of WCR 72. The
addition of another buildable site to the area is not consistent with the agricultural uses surrounding the
proposed recorded exemption, thus contributing to sprawl row type development.
The Department of Planning Services requests that the Board of County Commissioners consider this
application and determine if Sections 11.5.1 through 11.5.7 of the Weld County Subdivision Ordinance have
been met.

CONDITIONS OF APPROVAL

1. A Weld County Septic Permit is required for any proposed home septic system, and shall be
installed according to the Weld County Individual Sewage Disposal Regulations.
2. Any existing septic system(s) which is not currently permitted through the Weld County
Health Department will require an I.S.D.S. Evaluation prior to the issuance of the required
septic permit(s). In the event the system(s)is found to be inadequate,the system(s)must be
brought into compliance with current I.S.D.S. regulations.
3. The following note shall be placed on the recorded exemption plat prior to recording:
A Flood Hazard Development Permit shall be required for any new construction or
substantial improvements of existing structures in the Flood Hazard Overlay District located
on the property.
4. The applicant shall submit a mylar plat to the Department of Planning Services to be
recorded in the office of the Weld County Clerk and Recorder. The plat shall be prepared
in accordance with the requirements of Section 11.7 of the Weld County Subdivision
Ordinance. The plat shall be submitted within sixty(60) days from the date of approval by
the Department of Planning Services. The applicant shall be responsible for paying the
recording fee.

regulations.
-The Town of Eaton has reviewed this request and has no conflict of interest.
-The Eaton Fire Protection District has reviewed this request and has no conflict of
interest.
STAFF RECOMMENDATION: The addition of another buildable sight to the area is not
consistent with the agricultural uses surrounding the proposed recorded exemption, and will
contribute to sprawl row type development. Approval of the recorded exemption would result in
potentially seven buildable lots along 1/2 mile on WCR 72.

APPLICATION FOR LAND USE FOR THE PROPERTY PREVIOUSLY DENIED
1 . Substantial Change In Facts and Circumstances: Applicant is
the current owner of 18 acres + which are the lands in RE 1795
previously denied October 1995, being that portion of SW2,1 of
Section 5, Township 6 North, Range 65 West of the 6th P.M. , lying
between the McLellan Ditch and the Eaton Draw deeded 9-10-1887 and
12-16-1887 respectively (an isolated parcel of land) . The
applicant was not a part of the RE 1795 application process . The
original Recorded Exemption application requested to have Lot A be
a new parcel of five acres with Lot B being 13 acres with the
existing two houses . That process would have created the
opportunity for three houses on 18 acres. Applicant is desirous of
splitting the 18 acres and the two houses in such a manner as to
have one existing house on proposed Lot A with 2 + acres of the
existing yard and machine shed, and Lot B will have 16 + acres with
the other house. Thus, only the existing two houses will be
possible. This process will enable the applicants to split their
tenants-in-common ownership of the entire property so that retiring
parents may have the northerly Lot A while their daughter and her
family may have the farm and southerly house. The southerly house
has already been upgraded, and this will allow the north house to
also be enhanced because it will be a separate lot .
It is the applicant' s belief that the above reason is a
"substantial change in facts and circumstances" that occurred since
the denial of RE 1795, and applicant hereby requests Weld County to
rehear this matter and to grant an approval of a recorded exemption
when formally submitted.
Please see former plat and proposed plat . Formal submission shall
occur upon your approval of rehearing.
If their is additional information needed, we or our agent in this
matter shall do our best to cooperate. Thank you for hearing this

farm and buildings . The parents will soon be retiring.
2 . Describe the location, size and present use of the area
where each proposed lot will be created.
Lot A of the proposed RE is located along North side of WCR
72 and East of WCR 39. It is approximately 5 acres in size
with the dimensions being approximately 310 feet North and
South and approoximately 700 feet East and West . This site
has no buildings and will be used as an irrigated farm and
future residence .
Proposed Lot B is adjacent North of proposed Lot A and
adjacent to WCR 39 North of WCR 72 and part of the W 1/2 SW
1/4 of Section 5, Township 6 North, Range 65 West. It will
be approximately 13 acres more or less . It will remain an
irrigated farm with the existing buildings .
3. Explain how the proposal is consistent with the Weld County
Comprehensive Plan and any adopted municipal plan, if
applicable.
The proposal is consistent with the Weld County
Comprehensive Plan which allows for Recorded Exemptions via
the subdivision ordinance 173 and as amended in Ordinance
173-A effective August 10, 1993. The buildings are allowed
to be split from or with the farmland which allows a track
(with or without buildings) . Section 11 . 2 explains the
exemptions and is in compliance with Section 11 . 8 . This
land does lie within three miles of the Town of Eaton. Lot
B will remain a small farm rural residence and Lot A will
remain irrigated farmland, and future residence
(agriculture) which are consistent with the Comprehensive
Plan Exemptions . Lot B has two (2) houses . One lot will
have two (2) houses and 11+ acres farmland and the other lot
will have 5+ acres irrigated farmland and an eligability for
a residence.

4 . Explain how the uses permitted will be compatible with
existing uses surrounding the proposed recorded exemption.
The neighborhood is primarily irrigated farmland with
farmsteads . The property to the North is an irrigated farm
and no residence . The land to the East is irrigated farmland
and no residence . To the South is irrigated farmland and
farmstead. To the West is irrigated farmland and two
farmsteads .
5. Explain how the proposal is consistent with the intent of
the zoning district it is located within.
Both Lot A and Lot B are in the agricultural district which
allows lot sizes greater than one (1 ) acre, and this
application complies . Historic and proposed uses are the
same (agriculture) . A zoning change is not applicable nor
desirable at this time. There is other agricultural zone
land between subject land and the Town of Eaton.
6. Explain how the proposal is consistent with efficient and
orderly development.
The proposed Recorded Exemption is not part of an approved
Recorded Exemption within the past five (5) years (actually
never) . The proposed is not part of an approved subdivision
or recorded subdivision plat or unincorporated community and
does not evade the requirements and statement of purposes as
set forth in Section 1 . 3 of the Weld County subdivision
Ordinance.
7 . Explain how adequate provision for the protection of the
health, safety, and welfare of the inhabitants of the
neighborhood and the County will be accomplished.
The water supply for Lot A and Lot B has North Weld County
Water District water available (see letter included in this
application package) . Its quality, quantity and
dependability is proven.
The homes on Lot B each have their successfull operating
septic systems . Lot A, if needed shall comply with the Weld
County Health Department Individual Sewage Disposal System
( ISDS) permit and requirments .
The two existing acesses to Lot B are from WCR 39 and the
Lot A existing access is from existing WCR 72 (See Plot Plan
Map) .

District Regulations . It is not in the airport location,
approach, transitional, horizontal or conical zones .
Geologic Hazard layers do not appear present nor in an
overlay. Geither Lots are in a flood plain Sufficient
drainage is available to handle irrigation and rainwater
through normal ditches present on the subject property. No
Planned Unit Development District exists for subject
property.
Existing rights of way are present for existing county roads
servicing said properties . If wider reservations are
reserved, they will be noted on the Mylar Plot which will be
recorded. Utility rights of ways are also present along
subject property for electricity, water and telephone.
The economic welfare of the community will be enhanced by
owner occupied buildings, through higher taxes, and the
buildings are also normally remodeled and upgraded.
