Hall, Chair - EXCUSED Commissioner Barbara J. Kirkmeyer, Pro-Tem Commissioner George E. Baxter Commissioner M. J. Geile Commissioner Glenn Vaad Also present: Acting Clerk to the Board, Esther Gesick Assistant County Attorney, Lee Morrison Planning Department representative, Sheri Lockman Health Department representative, Sheble McConnellogue Public Works representative, Don Carroll The following business was transacted: I hereby certify that pursuant to a notice dated August 25, 1999, and duly published August 28, 1999, in the Fort Lupton Press, a public hearing was conducted to consider the request of John Eichman and Harold Tateyama and Sons for a Site Specific Development Plan and Special Review Permit#1238 for an excavation business in the A(Agricultural)Zone District. Bruce Barker, County Attorney, made this a matter of record. Sheri Lockman, Department of Planning Services, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. Ms. Lockman gave a brief description of the location of the site which is 2.77 acres in size. She explained the site is located on Lot B of Recorded Exemption#2525, and the Conditions of Approval for the Recorded Exemption must be met prior to recording the plat for this Use by Special Review Permit. She explained Lot A of Recorded Exemption#2525 is required to be at least one acre,and displayed an overhead showing the new lot configuration. Ms. Lockman stated the applicant will still meet the current setback requirements, there are two existing residences on Lot A, and she gave a brief description of the surrounding uses. She stated eleven referral agencies responded favorably with recommended conditions and one did not respond. Ms. Lockman stated because the application includes the provision for seasonal onion storage, the Weld County Department of Public Health and Environment staff is requesting an additional Development Standard, which she submitted as Exhibit E. In response to Commissioner Geile, Ms. Lockman stated the existing storage structure is over 11,500 square feet, there are two residences on Lot A of Recorded Exemption#2525, and this permit will approve the office and residence on Lot B. She further stated the four percent rule recently adopted in the Zoning Ordinance does not apply because this use is located within a Recorded Exemption rather than a Subdivision. Bruce Johnson, real estate broker, represented the applicant and stated he is also working on behalf of Harold Tateyama and Sons, sellers of the property. He stated there will be no outdoor storage of onions and indoor storage will be used seasonally. In response to Commissioner Geile, Mr. Johnson stated according to the Development Standards, any equipment that may need to be stored outside while storing onions inside, will be at the back of the building and screened. No public testimony was offered concerning this matter. Commissioner Baxter moved to approve the request of John Eichman and Harold Tateyama and Sons for a Site Specific Development Plan and Special Review Permit #1238 for an excavation business in the A (Agricultural)Zone District, based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record with the addition of the Development Standard as submitted by health staff. (Clerk's Note: Development Standard added as a new#13 and remaining Development Standards renumbered.) The motion was seconded by Commissioner Vaad, and it carried unanimously. This Certification was approved on the 13th day of September, 1999.
