RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL
ACTION AGAINST ARTHUR KOHN FOR VIOLATION OF THE WELD COUNTY
ZONING ORDINANCE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Arthur Kohn, VI #9700171, is allegedly in violation of the Weld County Zoning
Ordinance, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 14th day of April, 1998, a public hearing was held before the Board of
County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Arthur Kohn, property owner, was present at said hearing, and
WHEREAS, the Board of County Commissioners deems it advisable to refer said
violation to the Weld County Attorney's Office for legal action, with an instruction for immediate
action.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that said violation be, and hereby is, referred to the Weld County Attorney's
Office for legal action against Arthur Kohn to remedy the violation of the Weld County Zoning
Ordinance, and any other persons occupying the properties, any persons claiming an interest in
the properties, and any persons acting in active concert with the identified parties, with an
instruction for immediate action.

CASE SUMMARY
September 29, 1997 Initial complaint received.
September 30, 1997 Site inspection conducted by Julie Chester. There is a noncommercial junkyard located
on the property. No one was home, could not verify anything on the kennel compliant.
October 15, 1997 Five day letter sent.
November 7, 1997 Office visit. Mr. Kohn came into the Department of Planning Services demanding that
staff tell him who complained. The information was not in the file.
November 7, 1997 Telephone call between Todd Hodges, Current Planner II and Arthur Kohn. Mr. Kohn
became very agitated and abusive toward staff. He stated he would be calling
Commissioner Kirkmeyer and hung up while Todd Hodges was obtaining the phone
number.
January 27, 1998 Progress inspection. No one was home. Left a note on the front door stating the
property is still in violation.
January 28, 1998 Thirty day letter sent.
February 2, 1998 Telephone conversation between Sharyn Frazer,Zoning Compliance Officer and Arthur
Kohn. Mr. Kohn stated that he was going to file criminal trespassing charges against
Ms. Frazer. It was explained to Mr. Kohn that the inspection was conducted from the
road right-of-way and a note was left on his front door. Mr. Kohn hung up. Property
is still in violation.
February 2, 1998 Telephone conversation between Sharyn Frazer and Deputy Mark Profitt. Deputy
Profitt responded to a complaint from Mr. Kohn and explained that someone leaving
a note on the front door of his residence did not constitute criminal trespassing charges.
Incident report number WC98-515, included in the violation file.
March 3, 1998 Progress inspection from the road right-of-way. Property is still in violation. There are
approximately 11 cars and trucks(derelict-weeds and grass growing underneath), an old
bus, an old camper trailer, pallets and miscellaneous debris located on the property.
March 5, 1998 Letter sent to Mr. Kohn scheduling him to appear at the violation hearings before the
Board of County Commissioners on April 14, 1998.

before the Board of County Commissioners on April 14, 1998, at 10:00 a.m.
The noncommercial junkyard is still located on the property, therefore is a violation of Sections 31.2 and 31.3.9
of the Weld County Zoning Ordinance. To bring the property into compliance the noncommercial junkyard
must be removed from the property or screened from adjacent properties and road rights-of-way.
The Department of Planning Services also recommends that the County Attorney authorize legal action against
any other persons occupying the properties, any persons claiming an interest in the properties, and any persons
acting in active concert with the identified parties.

: PLANNING AND ZONING PROBLEM, REPORTING PARTY BELIEVES COMPLIANCE
OFFICER HAD TRESPASSED ONTO HIS PROPERTY AND WANTED TO FILE A COMPLAINT.
DETERMINED THAT THERE WAS NO CRIME INVOLVED, REPORT FOR INFORMATION
PURPOSES ONLY.
NARRATIVE/FACTS:
AT THE LISTED TIME AND DATE, I RESPONDED TO 2790 175TH AVENUE ON A
POSSIBLE CRIMINAL TRESPASS. UPON MY ARRIVAL, I CONTACTED ARTHUR
KOHN, WHO SHOWED ME A NOTICE THAT HAD BEEN PLACED ON HIS DOOR FOR
PLANNING AND ZONING, CONCERNING SOME JUNKED VEHICLES THAT HE HAS ON
THE BACK OF HIS PROPERTY. HE WAS UPSET THAT HE BELIEVED THE
INSPECTOR HAD GONE ONTO HIS PROPERTY TO CHECK THE VEHICLES TO SEE
IF THEY WERE PROPERLY TAGGED AND TO CHECK ON A KENNEL.
HE SHOWED ME A LETTER FROM SHARON FRASER, IN WHICH HE STATED THAT
IN THE LETTER, SHE HAD NOT BEEN ABLE TO CONDUCT THE INSPECTION TO
HIS NOT BEING AVAILABLE AND THE VEHICLES ARE VISIBLE FROM THE ROAD,
WHICH I WAS ABLE TO CONFIRM. WHILE I NOTICED THAT SOME OF THE
VEHICLES DID HAVE TAGS, I NOTICED THEY APPEARED TO HAVE NOT BEEN
MOVED IN RECENT MEMORY AND THERE WERE GRASS AND WEEDS GROWING UP
AROUND THE TIRES AND UNDERNEATH ONE, IN PARTICULAR, A WHITE CAMARO
ON THE VERY BACK OF HIS PROPERTY HAD THE HOOD UP AND HAD GRASS
APPROXIMATELY TWO FEET TALL AROUND THE VEHICLE ' S BODY. MR. KOHN
WENT ON TO STATE HE BELIEVES THIS IS RETRIBUTION BECAUSE OF HIS
FIGHTING THE APPLICATION FOR THE NEW ERIE TRASH DUMP AT COUNTY
ROADS 5 AND 6 , AND THIS IS THE COUNTY' S WAY AT GETTING BACK AT HIM.
HE FURTHER STATED HE IS UPSET WITH THE COUNTY BECAUSE OF THE FACT
THEY ALLOWED ERIE TO ANNEX THE PROPERTY, WHERE THE DUMP WAS
LOCATED, AND THE DUMP IS RECEIVING HAZARDOUS MATERIALS FROM ROCKY
FLATS. I ADVISED MR. KOHN DUE TO THE FACT ANYONE COULD COME UP TO
HIS FRONT DOOR, KNOCK ON THE DOOR AND LEAVE A NOTE, THIS DID NOT
CONSTITUTE CRIMINAL TRESPASS, BUT I WOULD DO A REPORT AND I WOULD
CALL FRASER AND ASK HER IF SHE CAME BACK TO THE PROPERTY, TO AT
LEAST CALL AND MAKE AN APPOINTMENT PRIOR TO THAT.
I THEN TELEPHONE SHARON FRASER IN PLANNING AND ZONING AND ADVISED
HER OF WHAT MR. KOHN HAD TOLD ME. SHE REQUESTED A COPY OF THIS
REPORT BE SENT OVER TO HER, AND SHE ALSO STATED SHE WOULD BE
CALLING MR. KOHN IN THE FUTURE IF SHE NEEDED TO GO BACK DOWN TO TRY
AND ALLEVIATE ANY FURTHER PROBLEMS OF THIS NATURE .
DUE TO THE FACT THERE IS NO CRIMINAL ACTIVITY INVOLVED, I TOOK NO
FURTHER ACTION AND CLEARED WITHOUT FURTHER INCIDENT. REQUEST A
COPY OF THIS CASE BE SENT OVER TO PLANNING AND ZONING, ATTENTION:
SHARON FRASER, COUNTY COMPLIANCE OFFICER.

Dear Mr. Kohn:
The uses on the above described property are being considered as a zoning violation of Sections 31.2, 31.3,
31.3.9, 31.4 and 31.4.8 of the Weld County Zoning Ordinance.
I attempted to conduct an inspection on Tuesday, January 27, 1998. No one was at home and I left a note on
the front door. Without being able to inspect the property, I was able to view the.number of derelict vehicles still
located on the property. The question regarding the kennel remains unanswered, due to the fact that without
permission, I will not conduct an actual walk through inspection.
It is the intention of this office to assist and cooperate with you without imposing undue hardships; however, we
have no discretion in this matter if you fail to correct this violation. You have 30 (thirty) days from January 30,
1998, to correct this zoning violation. Failure to do so will result in this office scheduling the violation before
