HomeMy WebLinkAbout950183.tiffRESOLUTION RE: APPROVAL OF RECORDED EXEMPTION #1697 - YEAGER WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners, pursuant to its authority under Section 30-28-101(10)(d), CRS, as amended, did determine at a public meeting held in the Chambers of the Board, that a certain parcel of land, to be divided into two parcels, as shown on the plat known as Recorded Exemption #1697, does not come within the purview of the definition of the terms, "subdivision" and "subdivided land", and WHEREAS, the request for Recorded Exemption #1697 was submitted by Raymond and Dorothy Yeager, Route 1, Keenesburg, Colorado 80643, for property which is described as Lot A of Recorded Exemption #198 described as being part of the SE% of Section 22, Township 1 North, Range 63 West of the 6th P.M., Weld County, Colorado, being more particularly described in the plat which shall be provided by the applicant and known as Exhibit "A", said plat to be recorded, and WHEREAS, this request is to divide the property into parcels estimated to be approximately 140.0 acres and 4.0 acres. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the hereinabove described parcel of land be, and hereby is, exempt from the definition of the terms, "subdivision" and "subdivided land". BE IT FURTHER RESOLVED by the Board that Recorded Exemption #1697 submitted by Raymond and Dorothy Yeager be, and hereby is, approved conditional upon the following: 1. The applicant shall submit a mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be prepared in accordance with the requirements of Section 11.7 of the Weld County Subdivision Ordinance. The plat shall be submitted within sixty days from the date of approval by the Board of County Commissioners. Dear Commissioners: This request for a recorded exemption is submitted by Raymond S. and Dorothy M. Yeager. The parcel of land on which this request is being made is Lot A of RE -198 described as the SE4 of Section 22, TIN, R63W of the 6th P.M., Weld County, Colorado. The property is located north of and adjacent to Weld County road 6 and west of and adjacent to State Highway 79. This request is to divide a 143.717 acre parcel into two parcels of 140 acres and 4 acres, more or less. The applicants have indicated through the application materials that they plan on selling Lot B because they are retiring. Lot B will remain in agricultural production. Lot A contains an existing residence. The parcel under consideration was created in 1976 by Recorded Exemption 198, therefore this proposal is the further subdivision of the property utilizing the recorded exemption process. Access to Lot A is existing onto State Highway 79 and access to Lot B is existing onto Weld County Road 6. The State Department of Transportation reviewed this request and feel re-evaluation of access is not necessary at this time since no change of use of the property is being proposed. The Weld County Health Department and Division of Water Resources has reviewed this request and have no concerns. The Department of Planning Services' staff recommends conditional approval of this request. It is the opinion of the Department of Planning Services staff that this request complies with the standards of Sections 11.5.1 through 11.5.6 of the Weld County Subdivision Ordinance. This Recorded Exemption is being proposed to split off a four acre parcel with existing improvements from the entire 144 acre farm. Mr. and Mrs. Yeager purchased the Southeast one - quarter (SE1/4) Section 22, Township 1 North, Range 63 West in 167. From 1969 thru 1972, limited crops were harvested, due to frost and hail, which in turn caused a financial hardship. A fifteen acre parcel was sold in the SE corner of this parcel to prevent foreclosure. To date a portion of the original mortgage still exists. The Yeagers are reaching retirement age and would like to stay in their existing home which is situated on the proposed four acre parcel. They are proposing to sell the remaining 140 acre farm and pay off the mortgage because they feel they cannot afford the mortgage payment upon retiring. 2. The 144 acre parcel is located in the Southeast one - quarter Section 22, Township 1 North, Range 63 West. Presently the entire parcel is being used for agricultural purposes except approximately four acres in the Northeasterly corner where there is an existing house and outbuildings. 3. This Recorded Exemption is consistent with the Weld County Comprehensive Plan because it will allow the Yeagers to remain in their home which they have resided in for approximately 25 years. Access to the 140 acre parcel is from Weld County Road 6 and Colorado State Highway 79. An access off Colorado State Highway 79 now exists for the four acre parcel. This parcel does not lie within any boundaries of a municipal master plan. 4. This parcel and the surrounding parcels are primarily agricultural lands. There are no changes proposed for the use of this parcel. It will remain agricultural. 5. This application is consistent with the traditional use and zoning district (agricultural) since no changes are being proposed. 6. No development of this parcel is going to occur. 7. We offer the following comments: RIGHT-OF-WAY Right-of-way (ROW) has not been addressed by the submittal. Projected traffic along SH 79 indicates the need for a 150 foot total ROW, 75 feet each side of the highway centerline. Additional width to meet the projected need should be protected by reservation or, preferably, dedication as permitted by County regulations. ACCESS The application states that both parcels of the property are to continue their existing use and that no development is planned. The application further states that there is an existing dwelling on Parcel B. Since a change of use of the property is not proposed, re-evaluation of access is not necessary at this time. Access to the state highway is controlled by the State Highway Access Code (SHACode), and the subdivision of property requires that access be brought into conformance with the Code at such time as the property changes use. Conformance with the Code along this section of SH 79 would require that a access for the 144 acres be provided by way of WCR 6. The narrative states that Parcel A has access to both SH 79 and WCR 6, and Parcel B has access to SH 79. The applicant should be aware that at such time as a change of use of either parcel would be proposed, the Department would have a warrant to re-evaluate access. The re-evaluation could require closure, relocation or improvements to the overall access picture. My comments are based upon the submittal as received January 17, 1995. 1\`.
