HomeMy WebLinkAbout982101.tiff LAI R.aolud ORDINANCE NO. 30-D IN THE MATTER OF AMENDING WELD COUNTY ORDINANCE NO. 30-C, REGARDING THE GREELEY-WELD COUNTY AIRPORT AUTHORITY BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF WELD, STATE OF COLORADO: WHEREAS, the Board of County Commissioners of the County of Weld, State of Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners has the power and authority to enact Ordinances, pursuant to Section 3-14 of the Weld County Home Rule Charter, and WHEREAS, Section 41-3-101, C.R.S., et. seq., otherwise known as the "Colorado Public Airport Authority Act," authorizes the creation of airport authorities, corporate and politic, by cities and counties, and WHEREAS,on February 1, 1993,the Board of County Commissioners enacted Weld County Ordinance 30-C, entitled: "In the Matter of Amending Weld County Ordinance 30, Regarding the Greeley-Weld County Airport Authority," and WHEREAS, the Board of County Commissioners and the Greeley City Council have determined that it is in the best interests of the citizens of the City of Greeley and the County of Weld, State of Colorado, to amend Weld County Ordinance 30-C, so as to change the staggering of terms of the Airport Commissioners who are not City Councilpersons or County Commissioners, and to change the quorum from five Airport Commissioners present to four Airport Commissioners present. NOW, THEREFORE, BE IT ORDAINED by the Board of County Commissioners of the County of Weld, State of Colorado, that Weld County Ordinance No. 30-C, enacted February 1, 1993, effective February 9, 1993, be, and hereby is, amended as follows: DELETE THE THIRD FULL PARAGRAPH OF SECTION 6, AND INSERT THE FOLLOWING: The term of each City Councilperson and each County Commissioner shall be four years, or until such time as he or she is no longer a member of the Greeley City Council or Board of County Commissioners of the County of Weld, whichever is sooner, except that the initial terms of one of the City Councilpersons and one of the County Commissioners shall be two years. The Airport Commissioners who are not City Councilpersons or County Commissioners shall each be appointed for four year terms, except that, for those terms beginning January 1, 1999, the terms shall be as follows: the City of Greeley appointee shall be one year, the County of Weld appointee shall be two years, and the joint appointee shall be four years. A quorum for the Board shall consist of four Airport Commissioners present. ORD30 982101 RE: ORDINANCE NO. 30-D PAGE 2 DELETE THE FOURTH FULL PARAGRAPH OF SECTION 6. BE IT FURTHER ORDAINED by the Board of County Commissioners: A. That a certified copy of this Ordinance shall be filed with the Director of the Division of Local Government in the State of Colorado, Department of Local Affairs. B. That if any section, subsection, paragraph, sentence, clause, or phrase of this Ordinance is for any reason held or decided to be unconstitutional, such decision shall not affect the validity of the remaining portions hereof. The Board of County Commissioners hereby declares that it would have enacted this Ordinance in each and every section, subsection, paragraph, sentence, clause, and phrase thereof irrespective of the fact that any one or more sections, subsections, paragraphs, sentences, clauses, or phrases might be declared to be unconstitutional or invalid. C. That this Ordinance No. 30-D shall become effective on November 17, 1998, or the effective date of a City of Greeley Ordinance amending City of Greeley, Colorado, Ordinance , consistent with this Ordinance, whichever is later in time. The above and foregoing Ordinance Number 30-D was, on motion duly made and seconded, adopted by the following vote on the 14th day of December, A. D., 1998.
