HomeMy WebLinkAbout992690.tiff RESOLUTION RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL ACTION AGAINST ROBERT THURTELL FOR VIOLATION OF THE WELD COUNTY BUILDING CODE ORDINANCE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Robert Thurtell, VI #9900266, is allegedly in violation of the Weld County Building Code Ordinance, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 9th day of November, 1999, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Robert Thurtell was not present or represented at said hearing, although all parties were notified of said hearing by Department of Planning Services staff, and WHEREAS, the Board of County Commissioners deems it advisable to refer said violation to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon such referral until December 9, 1999, to allow adequate time for the property owners to bring the subject property into compliance and for an inspection of the property by the Department of Planning Services staff. One inspection was done on October 24, 1997 and the inspection was approved; no other inspection have been completed. May 28, 1999 A 10 Day Letter was sent out by Bob Trenary. August 18, 1999 A follow-up phone call was made. There was no answer. August 26, 1999 Building Code Violation was issued. 30 Day Letter was sent out by Joe Mendez. September 02, 1999 A follow-up phone call was made. There was no answer. September 16, 1999 A follow-up phone call was made. There was no answer. October 04, 1999 I made contact with Mr. Thurtell regarding the permit and the final inspections. He stated that he needed more time to complete the landing & steps and the tie downs. I told him that he needed to call in the inspections within 10 days for the items that have been completed and that he also needed to send me a request in writing for the one month extension. October 18, 1999 There have not been any inspections requested as required and I have not received the request in writing for the extension. There has not been any contact since the 10/04/99 phone call and there have not been any office visits to remedy the situation with the violation. October 19, 1999 A site inspection was completed. I had left a hand-written letter on the door with my card. It appears that the landing&steps are not completed and all the other inspections still need to be completed. Photos were taken of the mobile home and letter. October 28, 1999 Scheduled Hearing Certified Letter was sent out by Joe Mendez. There was no response regarding this violation. The Department of Planning also recommends that the County Attorney be authorized to proceed with legal action against any other persons occupying the properties, any persons claiming an interest in the properties, and any persons acting in active concert with the identified parties.
