p .( County Treasurer ' s report for the month of November 1904 was presented, examined and
on motion audited and ordered placed on file .
The petition of George B. Johnson praying for an abatement of taxes for the year 1903
was presented, and after carefully examining same and the Board being fully advised in the
premises on motion ordered that he be granted a rebate on a valuation of *100. on improve-
ments .
The following claims were then presented, examined and on motion approved and warrants

The petition of Geo , J . Spear % Schedule H./220 assessment 1903 was presented and after
carefully investigating the claim made therein and the Board being in possession of all thr
facts connected therewith, on motion ordered that he be granted a rebate of taxes for the
year 1903 % erroneous assessment on W.- S .W.k Sec . 26--4--67 on a valuation of w.8O .
! 1 IN THE MATTER OF COUNTY WARRANT NO . 7010 "E"
It appearing to the Board that Rebecca E . Hoggatt
did on or about January 5 , 1904 file a petition praying for an abatement of taxes for the
year 1903 on moneys and credits on a valuation of $700 . and which ptition was duly granted
August 7 , 1904, County Warrant No . 7010 Series "E" for $32 . 55 being darn on the County Treas-
urer therefor ; now it appears that an error was made by the clerk in as much as he computed
same with the levies of 1902 when in fact he should have figured same by the 1903 levy, said
error making a difference of $10 .85 ; after making a thorough investigation of the matter and the
Board being fully advised in the premises , on motion ordered that County Warrant No . 7010
series "E" be and the same is hereby cancelled and held for naught and the clerk is directed
. to draw a new warrant for the correct amount .

PROPOSALS.
The time having arrived for the opening of the several bids received for furn;shinl/
Weld County with all necessary record .books blank books, stationery and all other supplies
for the year 1905, the clerk opened and read the proposals of The Out West Printing and
Stationery Company, The C . F. Hoeckel Blank Book Co and The Merchants Publishing Co . and
after making a thorough investigation of all proces contained therein and believing that the
Bid of The C. F. Hoeckel Blank Book Company was the best and most satisfactory received, on
motion it was ordered that the bid of The C . F. Hoeckel Blank Book Company be and the same
is hereby accepted, and the clerk is directed to so notify them.
This being the second day fixed by the Board for persons appearing not to have voted
at the last election to show cause why their names should not be stricken from the registra-
tion lists, the following named persons having stated their reasons for not voting and , ex-
pressing a desire to have their names retained on their respective registration lists , . it _

The following resolution was unanimously passed and adopted, viz
BE IT RESOLVED, By the Board of County Commissioners of Weld County, Colorado, that
there is hereby appropriated from the General Road Fund of 1904, to cover the existing over-
drafts now in the several road districts and to pat the unpaid claims against said districts
the following sums , to-wit : --

The official Bond of Paul Gregory as Constable in and for Justice Precinct No . 5) in
the penal sum of $1000 . was presented, examined and the sureties thereon being considered
ample and sufficient, it was on motion ordered accepted, approved, recorded and placed on
file.

The Justice account of E. P. House; People vs. Roy and Guy 'bite, and the accounts of
L . B. Willard in the cases of the People vs . Roy and Guy white; Paul Gregory et al; Charles
Durango and Frank Door were presented, and after carefully examing the claims made therein

December 1904 was presented, examined and on motion approved and ordered placed on file.
County Sheriff' s report for the month of December 1904 was presented, examined and on
motion ordered audited and placed on file.
County Clerks report for the month of December, 1904 and also his annual report for the
,i year endind December 31, 1904 were presented, examined and on motion audited and ordered
placed on file.
IN THE MATTER OF
TRANSFERRING FUNDS.
On motion of Commissioner Rea and seconded by Commissioner Wattenberg the
following resolution was unanimously passed and adopted, to-wit : --
WHEREAS, It appearing to the aowru that an overdraft exists in the General County fund,
and,
Whereas, It appearing that there is a balance to the credit of the contingent fund in
the sum of 03.54.0.q./45.-. . . ;
Therefore Resolved, That the County Treasurer be and he is hereby authorized and di-
rected to transfer to the General County Fund the balance now to the credit of the Contingent
fund, for the purpose of reducing the overdraft now existing in the General County fund:
In the Matter of Road Viewers Report on Abandonment of Road
through center of Section 30, Township 6 N. , Range 65 West .
The Report of C . H Rea, A. L .
Camp, Jr . and 0 . M. McElroy, Viewers appointed November 29, 1904 to view the following de-
scribed line of road petitioned to be abandoned, viz : --
Commencing at the half section corner common to sections 29 and 30, Tp . 6N. , ' R. 65 West
and running thence due West along the one half section line in said section 30 to the
half section corner common to said sections 30--6--65 and section 25--6--66 as said
road is now established and laid out
was presented to the Board when the following action was taken and entered of record, to-wit:
The Board having carefully considered the report of the viewers herein, as well as the
objections made thereto, and finding the report correct as to form, and believing the public
good requires the abandonment of the road as recommended by the viewers, it was on motion
ordered that the report be approved and adopted, and the road therein described and recom-
mended by the viewers be and is hereby declared vacated and abandoned. The Clerk is directed
to record the report, vacate the road, and cause notices to be posted of the closing of said
road, and notify the road overseer of the proper district to close the same to travel at once.

SEMI-ANNUAL STATEMENT .
The County Clerk presented his semi-annual report for the six months ending
December 31 , 1904, showing the financial condition of the county, together with the standing of
the several State , County , School Districts and town funds , and after carefully examining same , it
was on motion ordered approved, and that portion usually printed was ordered published, and the
statement , in duplicate showing the standing of the several state funds was ordered signed by the
Board and one copy thereof placed on file and the other one forwarded to the Auditor of State .

The resignation of C . W. Shannon as Justice of the

Two petitions were then presented praying for the appointment of J . W . Rowe and W . J .Henderson

Be it Resolved by the Board of County Commissioners of Weld
County , Colorado that for the purpose of careing for and furnishing medioal , surgical and
other assistance to the indigent and poor persons of Weld County, that the county be divided
into three separate divisions and that said divisions be the same that now constitute and
make the three Commissioner and Road Districts of the county; and that for the purpose of
:eurnishing medical and surgical assistance to paupers of the county and to others who it is
the ditty of the county to furnish medical attention, that there be employed by written con-

tract some competent Licensed physician and surgeon in each of said separate districts ac-
cording to terms and conditions 'to be specified in each written contract hereinafter to be
entered into between this Board and such physician and surgeon so employed.

WHEREAS , It further appearing to the Board that Will Hill , the duly elected Constable has
failed to qualify as required by law, and the Board believing that the public good requires the
appointment of some good, reliable person to fill the vacancy ;
THEREFORE, BE IT RESOLVED By the Board of County Commissioners of Weld County Colorado that
said office be declared vacant , and that said A. J . Konantz be and he is hereby appointed to the

Report of H. A . Irons , Fred S . Dresser and A . M. Plumb , viewers
appointed September 10 , 1904 to view a proposed Bridge across the South Platte River about one
mile east of Hardin Station, Weld County, Colorado was presented to the Board when the following

The Board having carefully considered the report of the viewers herein and as well as all the

The contract and specifications of Charles G. Sheeley for the erection of a

with regard to same , and the Board fully believing the price to be very reasonable and being

7 , 12, 21 and 36 AND CREATING NEW PRECINCTS NO . 43 AND 44.
WHEREAS, It appearing to the Board
that at the last General Election held November 8, 1904, more than 500 votes were cast in
Southwest Greeley voting precinct No . 12 ; Northwest Greeley voting precinct No . 7 and South-
east Greeley voting precinct No . 36, and in order to comply with the statutes in relation
thereto it becomes necessary to change the boundary lines of said several precincts ,
THEREFORE, It was on motion ordered that the Boundary lines of said voting precincts 7, 12,
21 and 36 , which said precincts are situated wholly within the corporate limits of the city of
Greeley, be and the same are hereby changed and said precincts shall be situated within the
following boundary lines , to-wit : --
PRECINCT NUMBER 7 . --A11 that portion of the city of Greeley situated West of the center
line of Ninth ( 9th) Avenue in said city and a continuation thereof North to the city limits
and North of the center line of Seventh (7th) Street in said city shall constitute and form
Northwest Greeley voting precinct No . 7, with the voting place thereof at the City Hall in
said city.

PRECINCT NUMBER 12 . --All that portiion of the city of Greeley situated West of the center
line of Ninth Avenue in said City and lying between the center line of Seventh Street and the
center line of Eleventh Street in said City shall constitute and form voting Precinct No . 12,
with the voting place thereof at the Court House in said city.
PRECINCT NUMBER 21 . --All that portion of the City of Greeley situated East of the center
line of Ninth Avenue in said city and a continuation thereof North to the city limits and
North of the center line of Eighth Street in said city shall constitute and form Northeast
Greeley voting precinct Number 21 , with the voting place thereof at the Fire Engine House in
said City .
PRECINCT NUMBER 36 . --All that portion of the city of Greeley situated East of the center
line of Ninth Avenue in said city and lying between the center line of Eighth Street and the
center line of Twelfth Street in said city shall constitute and form East Greeley voting
Precinct No . 36 , with voting place thereof to be established hereafter.
And it is hereby further ordered that Two new voting precincts be and the same are hereby
created, the boundary lines of which shall be as follows , viz : --
PRECINCT NUMBER 43 . --All that portion of the city of Greeley situated south of the center
line of Eleventh Street in said city and West of the center line of Ninth Avenue in said city

PRECINCT NUMBER 44. --Ail that portion of the city of Greeley situated South of the center
line of Twelfth Street and East of the Center line of Ninth Avenue in said city shall con-
stitute and form Southeast Greeley voting precinct Number 44, the voting place thereof to be
established hereafter .
And it is further ordered that for judicial purposes said voting precincts 43 and 44 shall
be included in and made a part of Justice Precinct . No . 7 .
The clerk is hereby authorized and directed to prepare at the expense of the county, com-
plete or new registration lists , in conformity with the above changes , and all registered
electors in each and all of said changed and new election precincts shall be transferred to
their new and respective precinct in accordance with the above and foregoing order.

Craven, viewers appointed November 19 , 1904 to view a line of road described as follows , viz : --
Commencing at the corners common to sections 27 and 26 and 34 and 35 Tp . 4N . , R. 64 W. ;
Thence running South TWO miles between sections 34 and 35--4--64 and sections 2 and 3--3--64
b 0 to the S . E . corner of section 2 thereof ; thence east one mile between sections 2 and 11--3--64
to the S . E . corner of said section 2 and connecting with the present county road running -North
and south from the last named point .
Your petitioners further pray that the line of road as now granted and running one mile
East from the N .W. corner of section 35 and between sections 26 and 35 Tp . 4N . , R. 64 W. ; Thence
South Two miles and between sections 35 and 36--4--64 and sections 1 and 2--3--64 be vacated
and abandoned for the reason that said road is and will alway be impassable---was presented

objections made thereto, and it appearing from the objections made that there might have been
a mistake made in the location of the road as viewed, therefore it was on motion ordered that

Upon investigating the matter it was found that all of said property was sold to Weld
County during the years 1895, 1896, 1897 , 1899 and 1901 for the taxes of prior years ; that
said property is still held by Weld County by virtue of said tax sales ; that in consequence
of said property being held by said Weld County no taxes have been collected thereon since
the issuance of the said several certificates and in order to place said property back upon
the tax rolls it was thoucht best to dispose of the same ;
THEREFORE It was on motion ordered that the County Treasurer make a thorough investiga-
tion of all of said certificates , and if he finds them all to be correct and true as stated by
Mr. Snider, that the offer of Mr. Snider be accepted, and it is also further ordered that the

On motion of Commissioner Bradfield and seconded by Commissioner DeVinny the
following resolution was unanimously passed and adopted, viz : --
BE IT RESOLVED By the Board of County Commissioners of Weld County , Colorado, that from
and after March 1 , 1905 all orders issued for the support of poor shall be given to one mer-
chant one month at a time , to another merchant the following month, and so on in turn to each
until . the list has been completed ; Provided however, that the prices given are satisfactory
to this Board and are equal ; the clerk is directed to request of each merchant at the begin-
ning of each month to furnish to the Board his or their very best and lowest prices per pound
on the following list of groceries , and which in all cases are to be of good, first class
quality, viz : --FLOUR, 50 and 100 pound sacks--POTATOES , per sack--SALT SIDE ; --LARD--CORNMEAL--504 p---
OATMEAL--RICE--BEANS--SALT--PEPPER--YEAST per cake--OIL, per gallon--SUGAR--COFFEE--TEA and
DRIED APPLES AND PRUNES , and the prices so quoted by the merchant or merchants to whom said
orders are given will be the guide by which this Board will be governed in the auditing of
his or their bills for that month, and further that all provisions issued during that month
shall in each and every case be selected from said list . Any merchant or merchants found
furnishing an inferior quality of goods will forfeit his or their contract for that month.

The following petition praying for a right of way over and across certain public roads as
enumerated therein; --viz : --
TO THE HONORABLE BOARD OF COUNTY COMMISIONERS,
OF WELD COUNTY, COLORADO .

The Northern Construction Company, a corporation duly organized and existing under
the laws of Colorado, and the petitioner herein, is constructing a railroad from the town of �,
Windsor to the Town of Eaton, for the purpose of hauling sugar beets , farm products and for
other traffic necessary in the conduct of its business and in the construction thereof it is
necessary to cross a number of Public Highways along the line thereof , and at each and every
crossing there is required a strip of land 80 feet in width, the same being 40 feet on either
side of the center line of the track of said railroad as the same is now located by the engi-
neer of said company .
By reason of the premises , The Northern Construction Company, Petitioner herein as afore-
said, does hereby petition to your Honorable body, for a right of way for a crossing, 80 feet
in width, the same being 40 feet on each side of the center line of the track of said railroad
through over and across the following Public Highways , described as follows , to-wit : --
In Township 6 North of Range 67 , West of 6th P . M. Public Highway No . 8, running East and
West between Sections 15 and 22 and where this railroad crosses the same diagonally at a point
2004 feet East of the Southwest corner of said section 15 ,
Public Highway No . 342 , running North and South between sections 14 and 15 and where this
Railroad crosses the same diagonally at a point 2524 feet north of the Southeast corner of sat d/
Section 15 .
Public Highway running East and West upon the section line between sections 11 and 14
which right of way has been aquired yet such road has never been opened for public use, and
yet subject to your order for such purpose and where this railroad crosses said road diagon-
ally at a point 1396 feet East of the Southwest corner of said section 11 .
Public Highway No . 207 , running East and West between sections 2 and 11 and where this
Railroad crosses the same diagonally at a point 1475 feet west of the Southeast corner of said
section 2 .
Public Highway No . 188 , which is upon the East and West Township line between townships
6 and 7 of range 67 and where this railroad crosses the same diagonally at a point 632 feet
west of the Northeast corner of said section 2 in Township 6 north of range 67 .
Public Highway No . 116 , running North and South upon the section line between sections
35 and 36 in Township 7 North of Range 67 and where this railroad crosses the same diagonally
at a point 1118 feet north of the southeast corner of said section 35 .
Public Highway running north and south upon the township line at a point upon the east
and west center line of section 36 , in Township 7 North of Range 67 and of "Bknge 66 .. ip said
township 7 which right of way has been aquired but such road has never been opened for public
use yet subject to your order for such purpose and where this railroad crosses said highway
line at a point upon said-, center line East and West of said section 36 in Township 7 North of
Range 67 and of Section 31 , in Township 7 North of Range 66 .

33 and 34 and where this railroad crosses the same at right angles upon the East and West cen-
ter line of said Sections 33 and 34.
Public Highway No . 122 running North and South upon the section line between sections
34 and 35 and where this railroad crosses the same at right angles at a point upon the East ad
west center lines of said sections 34 and 35 .
Public Highway No . 122 running North and South upon the section line between sections
35 and 36 and where this railroad crosses said highway at a point upon the East and West cen-
ter line of said sections 35 and 36 at right angles .
Public Highway No . 105, upon the North and South township line between township 7 North
of range 66 and township 7 north of Range 65, and where This railroad crosses the same at
right angles at a point upon the East and West center line of said section 36 in Township 7,
North of Range 66 and of Township 7 North of Range 65, upon the East and West center line of
section 31 , where the same enters the Town of Eaton, Weld County, Colorado.
Also the' right to cross any other highway necessary to be crossed in the construction and
operation of said Railroad.
The rights of Way to be granted by your Honorable Body through over and across the af ore-
said Public Highways is to be granted to this Corporation for the purpose as stated herein
and such occupation by this corporation its successors and assigns shall be subject to the
condition_ that in the construction, operation and maintenance of said railroad that they will
do and perform whatever a reasonable public necessity will require to maintain said crossings

asdpublic highway as public safety and convenience may require .

The said petition and all matters therein contained having been duly, regularly and faith
fully considered, the rights of way and each and all of them as prayed for in said petition
be and the same are hereby granted upon the terms and conditions as in said petition set forth
and prayed for, and a further consideration that said crossings and each of them shall be
constructed as near as may be possible and practical, so as to conform tar the present grade
of said highways , and shall be so constructed and maintained as not to interfere with the
proper and necessary use of said highways for public travel as well as for the proper drain-
age thereof , add of any irrigating ditches . And whenever necessity requires that said cross-
ings be made at a grade higher or lower than the highway the said company shall construct and
maintain a broad and easy crossing and approaches thereto, which shall when done be subject
to the approval and acceptance of this Board or the Road Overseer within the District wherein
said roads are located
It is further ordered that said petition be entered of record in and upon the records of

County Clerk ' s report for the month of April A . D . 1905 was presented, examined and on
motion approved, audited and ordered placed on file .
The claim of Chas . I . Colwell in the WWII of 023 . 00 for services as Water Commissioner in
and for Water district No . 1 for the month of February and also the claim of Ross & Sheffield
in the sum of 5 . 00 for livery hire Qy Pauper were presented, and after carefully considering
the claim of each were on motion ordered disallowed and placed on file .
The petition of the 1st National Bank of Greeley, praying for a rebate of taxes assessed
against it for the year 1904 was presented, and after carefully considering same and the Board
being fully advised in the premises on motion ordered that it be disallowed and placed on file .

On motion of Commissioner Bradfield and seconded by Commissioner De-
Vinny the following resolution was unanimously passed and adopted, viz : --
BE IT RESOLVED By the Board of County Commissioners of Weld County, Colorado, at a meeting
regularly held, that this Board for and on behalf of Weld County, recommends His Excellency, Hon.
Jesse F . McDonald, Governor of the State of Colorado to appoint Mr . Edward Autrey to the
position of Water Commissioner in and for water district No . 6 . -
