HomeMy WebLinkAbout990617.tiff HEARING CERTIFICATION DOCKET NO. 99-17 RE: APPROVE SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW PERMIT #1212 FOR A PRIVATE AIRSTRIP IN THE A (AGRICULTURAL) ZONE DISTRICT - WILLIAM WILLCUTTS A public hearing was conducted on March 24, 1999, at 10:00 a.m., with the following present: Commissioner Dale K. Hall, Chair Commissioner Barbara J. Kirkmeyer, Pro-Tem Commissioner George E. Baxter Commissioner M. J. Geile Commissioner Glenn Vaad Also present: Acting Clerk to the Board, Esther Gesick Assistant County Attorney, Lee Morrison Planning Department representative, Scott Ballstadt Health Department representative, Sheble McConnellogue Public Works representative, Don Carroll The following business was transacted: I hereby certify that pursuant to a notice dated March 10, 1999, and duly published March 13, 1999, in the Fort Lupton Press, a public hearing was conducted to consider the request of William Willcutts for a Private Airstrip in the A(Agricultural) Zone District. Lee Morrison, Assistant County Attorney, made this a matter of record. Scott Ballstadt, Department of Planning Services, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. Mr. Ballstadt gave a brief description of the location of the site which is approximately 86.75 acres in size. He stated twelve referral responses were received which had no conflicts; their comments have been addressed in the Conditions of Approval and Development Standards. Mr. Ballstadt stated this proposal will take minimal farmground out of production and can be easily converted back into agricultural uses since it will be a grass runway. He gave a brief description of the surrounding uses and stated the Towns of Windsor and Severance have no concerns with the application. The City of Greeley requested the airstrip be limited to four trips per month for the private use of the owner only. In response to Commissioner Geile, Mr. Ballstadt stated he called Marcia Hoffer, FAA, and she stated the applicant has met the necessary requirements as described in the Conditions of Approval and Development Standards. Commissioner Vaad expressed concern that the use of the airstrip may need to be defined to clarify who is allowed to use the airstrip and how often and with what type of planes they fly. Bill Condon,Attorney, represented the applicant and stated Mr. Willcutts is a pilot for a commercial airline and is not able to attend today's meeting. Mr. Condon described the type of plane Mr. Willcutts owns and plans to use the runway for his private use and possibly be used by his children when they are older. Mr. Condon stated the runway is grass and the applicant is making no changes to the area. Mr. Willcutts intends to fly five to ten times per month and the applicant has received no objections to his proposal. In response to Commissioner Vaad, Mr. Condon stated (� 990617 (1( �, ,;�/tc- ii YL PL1295 HEARING CERTIFICATION - WILLIAM WILLCUTTS (USR #1212) PAGE 2 there will be no ultra-lights using the runway and the reason the applicant does not want a the number of flights limited because the use is based primarily on the weather and the applicant's spare time; however, he will agree to limit use of the runway to him and his family. Mr. Morrison stated the application addresses what is intended by private use; however, it can also be clarified as a Condition of Approval or Development Standard. Commissioner Vaad stated he is satisfied that Development Standard #11 refers to the private use as indicated in the application materials and it does not need to be restated. In response to Commissioner Kirkmeyer, Mr. Condon stated the applicant has reviewed and agrees with the Conditions of Approval and Development Standards. No public testimony was offered concerning this matter. Commissioner Kirkmeyer moved to approve the request of William Willcutts for a Site Specific Development Plan and Special Review Permit #1212 for a Private Airstrip in the A (Agricultural) Zone District, based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record. The motion was seconded by Commissioner Vaad, and it carried unanimously. This Certification was approved on the 29th day of March, 1999.
