RE: SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW PERMIT #1032 FOR
TWO INJECTION WELLS IN THE A (AGRICULTURAL) ZONE DISTRICT - BASIN
OPERATING COMPANY
A public hearing was conducted on March 8, 1995, at 10:00 a.m., with the following present:
Commissioner Dale K. Hall, Chairman
Commissioner Barbara J. Kirkmeyer, Pro -Tern
Commissioner George E. Baxter
Commissioner Constance L. Harbert
Commissioner W. H. Webster
Also present:

Assistant County Attorney, Lee Morrison
Planning Department representative, Keith Schuett
The following business was transacted:
I hereby certify that pursuant to a notice dated February 15, 1995, and duly published February 23,
1995, in the Windsor Beacon, a public hearing was conducted to consider the request of Basin
Operating Company for a Site Specific Development Plan and Special Review Permit for two
injection wells in the A (Agricultural) Zone District. Lee Morrison, Assistant County Attorney, made
this a matter of record. Keith Schuett, Planning Department representative, stated he spoke with
Jerry Dietz, Basin Operating Company representative, this morning on the telephone and he will
not be attending this hearing. He stated Mr. Dietz was unsure whether another representative
would be available to attend. Mr. Schuett entered the favorable recommendation of the Planning
Commission into the record as written and noted for the record that Mr. Dietz agreed to the
following changes: deleting Condition of Approval #3, which was met prior to scheduling this matter
before the Board; and amending Condition of Approval #4 to include "... and show and identify
all existing facilities on site." He explained an additional storage tank for production water, three
chemical tanks, and an office structure were not shown or identified on the plat map. Mr. Morrison
confirmed the applicant chose not to appear, and Mr. Schuett confirmed notice was sent and a sign
was posted on the property. Responding to a question from the Board, Mr. Schuett stated the
requirements are as consistent as possible with other injection wells and confirmed the Health
Department's comments were incorporated into the Resolution. He stated he is not aware of
regular inspections made by the Health Department; however, staff may enter onto the property
at anytime. Mr. Schuett stated Mr. Dietz was unsure why Well B9 was plugged other than it was
not producing to its capacity. The applicant was not represented, and no public testimony was
offered concerning this matter. Commissioner Harbert moved to approve the request of Basin
Operating Company for a Site Specific Development Plan and Special Review Permit for two
injection wells in the A (Agricultural) Zone District, based on the recommendations of the Planning
staff and the Planning Commission, with the Conditions of Approval and Development Standards
as entered into the record including the deletion of Condition of Approval #3 and the amendment
to Condition of Approval #4 as read into the record by Mr. Schuett. The motion was seconded by
Commissioner Webster, and it carried unanimously.
