Recently the Board of Directors of the Greeley Loveland
Irrigation Company and the City Council met to begin resolving
some of the problems we were having on the portion of the
ditch bordering Brentwood and abutting areas.
From the discussion we modified the ditch from W. 25th
Street Road to near W. 24th Street, (See enclosed map) with
the stipulation the City of Greeley must take care of over-
flows from storms and runoffs in the ditch. It was agreed
the logical point to receive this overflow was at West 28th
Street and Sunset Memorial Gardens.
Our design told us to use a 24" Concrete line for a
distance of some 1170' East of Sunset Gardens running beside
a present 12" submerged line. From this point we will be on
open ditch flow at the present time. Ultimately though the
system will have pipe from Sunset Gardens to 23rd Avenue and
beyond.
To complete the project we would need an Easement of a
strip of land as described in the enclosed papers from Sunset
Gardens to 23rd Avenue from Weld County. I had Mr. Richardson
screen a copy of the Easement request and it cleared his desk
with just a small change.
The line would parallel the road all the way with it being
on the south side of the first portion and north after the road
goes past the reverse curve. The first portion will involve a
strip where the farmer has cultivated out to the border of
the road but as you can see in the papers we would have to pay
any crop damage.

Mr. Cruce has discussed these problems once with the
farmers involved but I would be glad to discuss any of this
with you and them if you so desire.
If there are any questions and you wish to talk with
me please contact the office here and I will meet with you
as soon as you wish. It is our hopes to get this portion
of the system in as soon as possible if all is agreeable.

of weld , State of Colorado, Owner (s) , for and in consideration of the sum of ONE DOLLAR and other good
and valuable consideration to the Owner(s) in hand paid by the City of Greeley, a municipal corporation, the receipt
whereof Is hereby acknowledged, has granted and conveyed, and by these presents does grant and convey unto the
City of Greeley, its successors and assigns, an easement of a strip of land of sufficient width for a right of way for on
underground pipeline of the City of Greeley, to be constructed along the following described line, to -wit:
A twenty foot easement. ten foot in each side of section line. and
parallel to the section line between Section 13 and Section 24, T. 5N

together with right of ingress and egress for the purpose of constructing, maintaining, repairing and operating an
underground pipeline over and across said premises along the line above described.
It is understood and agreed between the parties hereto that said pipeline shall be placed underground =NS
, and when the pipeline is laid
the trench shall be properly filled and brought to the original ground surface; that the City of Greeley will pay for
damages to crops, If any, and existing improvements; that the City of Greeley agrees to remove from said right of
way and dispose of same, all rock brought to the surface by construction of the pipeline; that no fence shall be
constructed by the City along the line of the right of way hereby conveyed; that said pipeline shall not interfere
with any ditch or lateral on said premises and that the Owner (s) shall have the right, subject to rights of the City of
Greeley, to make any use of said land hereby granted for farming purposes which shall not in any manner interfere
with the proper construction, use, maintenance, repair and operation of said pipeline. The Owner (s) agree that they
shall not use said right of way so as to injure or impair said pipline or the proper use thereof.
• The City shall hold the County blameless in the operation maintenance,
repairs, construction of said pipe line and further the City shall
accomplish the above stated functions with the minimum amount of
interference of traffic and inconvenience to the general public.
