RE: ADOPT POLICY REGARDING SETTING AND POSTING OF SPEED LIMITS IN
CONSTRUCTION ZONES ON WELD COUNTY ROADS
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, pursuant to Sections 42-4-111 and 42-4-1102, C.R.S., the Board of County
Commissioners has the authority to reduce speed limits in construction zones on Weld County
Roads when, based upon traffic investigations or surveys, such reduced speeds are warranted
for safety of motorists and construction crews, and
WHEREAS, the Director of the Weld County Public Works Department reports that
based upon his expert opinion after reviewing various traffic investigations and surveys of
previous construction zones, a recommended safe maximum speed is 35 miles per hour
("MPH"), with some construction zones requiring slower speeds due to the hazards presented
by such construction, and
WHEREAS, the Director of the Weld County Public Works Department recommends
that the Board set the maximum speed limit in construction zones on Weld County Roads at 35
MPH, but delegate the authority to the Director of the Public Works Department to set the
maximum speed in specific construction zones at speeds less than 35 MPH where such slower
speeds are necessary because of specific hazards presented by such construction, and
WHEREAS, the Director of the Weld County Public Works Department further
recommends that such slower speeds be only for the time period during construction and that
posting of the slower speeds be done in accordance with the standards set forth in the most
current edition of the Manual of Uniform Traffic Control Devices, and
WHEREAS, the Board of County Commissioners hereby deems such recommendations
advisable and orders the speed in construction zones on Weld County roads to be as set forth
below.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the maximum speed for motorists traveling within construction
zones on Weld County Roads be, and hereby is, 35 MPH, for the time period necessary to
complete such construction as determined by the Director of the Weld County Public Works
Department.
BE IT FURTHER RESOLVED by the Board that the authority to set the speed within a
specific construction zone where such slower speeds are necessary because of specific
hazards presented by construction be, and hereby is, delegated to the Director of the Weld
County Public Works Department.
BE IT FURTHER RESOLVED by the Board that the Director of the Weld County Public
Works Department shall post the slower speeds in construction zones in accordance with the
standards set forth in the most current edition of the Manual of Uniform Traffic Control Devices.
