After review by the Department of Planning Services and the State of Colorado Oil & Gas Conservation Commission it has been determined that the mining of the 1.5 acres will not be a substantial change to the special use permit. The amended area is to be mined to a depth of 20 feet and reclaimed as part of the reservoir (see Exhibit D). An abandoned gas well is also located within the proposed mining area. In January 1997, the well was plugged end a field inspection was conducted by our office. Final plugging and • inspection approval was also given in January of this year. This mining proposal will remove a small portion of the cement plug installed and will be recapped prior to the filling of the reservoir. This portion of land is within the permitted area approved under permit M -79-0831t and is part of the acreage added by the January 1994 amendment to this permit. In January 1997, the existing well was abandoned and sealed with cement to 280 and 900 foot depths (see Exhibit D-1, circled text). Ninety pound sacks of cement were used to plug the well (80 and 40 sacks respectively). A well abandonment report was submitted to and passed by the Oil and Gas Conservation Commission in February 1997 (see Exhibit D-2, circled text). This amendment proposes to excavate the well area to a depth of 20 feet below the existing grade, making it a part of the lined reservoir. As conveyed to and approved by staff of the Oil and Gas Commission, a small portion of the cement plug will be removed and a concrete cap will be installed over the well prior to filling the reservoir. The gas line will be tied off along the west property line and the portion of line south of the well will be abandoned (see Exhibit C). Other information provided in the January 1994 amendment regarding the mining plan will not change with this proposal.
