HomeMy WebLinkAbout981143.tiff RESOLUTION RE: APPROVAL OF TEMPORARY PERMIT FOR A RETAIL 3.2% BEER LICENSE FOR EQUILON ENTERPRISES, LLC, DBA TEXACO #095 WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Equilon Enterprises, LLC, dba Texaco#095, 10963 1-25 Access Road West and Highway 119, Longmont, Colorado 80501, presented to the Board of County Commissioners of Weld County, Colorado, an application for a Change of Ownership of a Retail 3.2% Beer License, for the sale of 3.2% fermented malt beverages in sealed containers not for consumption at the place where sold, said License previously held by Texaco of Colorado, Inc., dba Texaco #095, and WHEREAS, Section 12-47-106.5, C.R.S., which became effective July 1, 1991, allows for the issuance by the Board of County Commissioners of a temporary permit to the transferee of an existing Retail 3.2% Beer License to authorize the transferee to conduct business and sell alcoholic beverages at retail in accordance with said license, subject to compliance with certain conditions, and WHEREAS, Equilon Enterprises, LLC, has complied with all of the conditions set forth in said Section, and WHEREAS, Equilon Enterprises, LLC, has also submitted the required application fee for said temporary permit of$100.00. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that having examined said application and other qualifications of the applicant for the transfer of the Retail 3.2% Beer License and having considered said request for a temporary permit, does hereby grant to Equilon Enterprises, LLC, dba Texaco#095, 10963 1-25 Access Road West and Highway 119, Longmont, Colorado 80501, a Temporary Permit to conduct business and sell 3.2% fermented malt beverages in sealed containers not for consumption at the place where sold, at retail at said location in accordance with the license previously held by Texaco of Colorado, Inc., dba Texaco#095, subject to all other rules and regulations set forth by the Board of County Commissioners of Weld County, Colorado, for a period of 120 days, or until such time as the application for Change of Ownership is approved by the State of Colorado, whichever shall occur first. BOX 758 /1..Je-Je____ GREELEY, COLORADO 80632 1111 1 I el zL..., t_ t/L ,COLORADO 7- z - ,1(> Y PLEASE POST NEAR EXISTING LICENSE July 1, 1998 TO WHOM IT MAY CONCERN On the July 1, 1998, the Board of County Commissioners of Weld County, Colorado, did approve the Transfer of Ownership request of Equilon Enterprises, LLC, dba Texaco #095, for a 3.2 Percent Beer License, with said license previously being held by Texaco of Colorado, Inc., dba Texaco #095, and expiring on August 28, 1998. The required documents for the Transfer of Ownership have been submitted to the State Department of Revenue for its approval. Until notification has been received from the State advising whether this Transfer of Ownership request has been approved or disapproved, the Board hereby authorizes the continued sale of 3.2 Percent Beer at this establishment which is located at 10963 1-25 Access Road West and Highway 119, Longmont, Colorado 80501, under a Temporary Permit which has been approved by the Board. This Temporary Permit allows Equilon Enterprises, LLC, dba Texaco#095, to conduct business and sell 3.2 percent fermented malt beverages in sealed containers not for consumption at the place where sold, in accordance with the license previously held by Texaco of Colorado, Inc., dba Texaco #095, subject to all other rules and regulations set forth by the Board of County commissioners of Weld county Colorado, for a period of 120 days, or until such time as the application for Transfer of Ownership is approved by the State of Colorado, whichever shall occur first.
