The entire action herein taken is based solely on facts as presented and by reason of the County Surveyor by speoial request of representatives of the peti- tioners having made a survey of said lands and his report thereof shows that the said lands were incapable of cultivation by irrigation from the irrigation system of said irrigation di st r is t. BE IT FURTHER RESOLVED , that before this order shall go into effeot o t as to any of the tracts of land in this resolution described, the owner of such tract shall pay to the County Treasurer all taxes , other than .axes for irrigaT ion dis- triot purposes , levied or assessed thereon, together with wall interest , penalties and fees as are or may be by law properly chargeable thereon. • WHEREAS, it has been further certified by the Board of Directors of the Denver-Greeley Valley Irrigation District to the Board of County Commissioners of Weld County, Colorado , that Hiram A . Shinkle heretofore made a contract for the inclusion in the said Denver-Greeley Valley Irrigation Dstrio t of the East Half of - the Southeast Quarter of Section 6 , T owns hIp 3 North, Rage 64 West , in Weld County, Colorado ; and , further , that said oontraot `was not , nor was any notice thereof' , recorded in the office of the Clerk and Recorder of said Weld County ; and , fur- ther , that Jacob Oster, the present owner of said land, purchased the same without any notice of said oontraot , but assents to the inclusion of said land in the dis- trict and has filed a petition for the inclusion thereof , on cA ndit ion that the taxes assessed against said land in 1917 be cancelled. THEREFORE in consideration of the faots as presented by the said Board of Directors to the Board of County Commissioners of Weld County, Colorado , relating to the inclusion of said land in said district and the assessment thereof for the year 1917 for the purposes of said district, BE IT HEREBY RESOLVED AND ORDERED that the Treasurer cf Weld Cal my be and he is hereby authorized to cancel the taxes assessed against said land for the purposes of said district for the year 1917. WHEREAS, The Union j aoifio Railroad Company made claim that the assessment placed upon its property in Weld County for taxation purposes in the year 1912 was on a basis of 33 1-3 per cent of actual value , and assessments placed upon pRoperty in said County locally assessed was upon a basis of not to exceed 20 per cent of aotual value and on that account said Company refused to make payment of its taxes in full and made effort to enjoin the collection thereof and upon trial in thee -Distriot Court of the United States , the application for restraining order was denied , which decision was thereafter affirmed by the Circuit Court of Appeals and upon appeal from the Cirou it Court of Appeals to the United States Supt ems Court was overruled and the case remanded to the District Court for trial; and WHEREAS, conditions have changed since the trial of said case making it very expensive and unadvisable to continue said litigation; and WHEREAS, said Union Pacific Railroad Company paid 60 per cent of its taxes at the oommenoe meat of said litigation and now offers to pay one-half the balance due together with 6 per cent interest from the date of delinquency; NOW, THEREFORE, BE IT - RESOLVED that the application of said Union Paoif io Railroad Company for abatement be granted in full.
