We are writing this letter in reference to a Special Use Permit
for a 2000 head cattle feedlot requested by John Wardlaw. We
very strongly oppose the approval of this permit. Our property
adjoins the Wardlaw property and our home is approximately 200
yards from their feed lot area. The increase in size and volume
of this operation is causing us problems with the enjoyment of
our property.

Listed below are some of our problems.
1. Traffic--- Trucks hauling onions, potatoes, carrots,
cattle, beet pulp, Budweiser by-products
and other feed products to the property.
Trucks hauling feed out to cattle in other lots,
since approximately 4600 head are fed from
this location. Which causes noise, dust and rough
roads.
2. Hay Grinding--- They grind hay, day and night right next to
our property, sometimes for several hours and
days at a time. We can no longer open windows
to cool the house in the summer, or enjoy our patio
and yard. It's either the flys, smell, dust, noise,
or hay grinding.
3. Smell--- The smell has increased with the increase in size
of this operation.
4. Property value--- With the increase in problems with this feedlot
we are getting a decrease in the value of our home.
We realize we may be the only property owners who are opposing this permit,
since we own the property for 11 mile on the west, and rent out the homes.
If renters have a problem they just move. The owners of the farm on the
east live in town and have had several different renters of the property
in past years.
This has been a illegal feedlot since Wardlaw purchased the two houses,
corral and 4 acres along with 12 acres across the road on 11-17-88.
On 3-8-91 he purchased Lot B of the recorded exemption and then
approximately doubled the size of the feedlot.
If this request is granted, when this is a illegal feedlot, then what
protects us from them or a new owner from building more illegal corrals
and then getting approval after the fact. It is our understanding that
this property is "For Sale". If the Wardlaws are given this permit for
their illegal feedlot whether they sell or keep the property it will 950445
be to their benefit and profit and to our detriment and expense.
Thank you for considering our concerns.
Conditions
1. Limit the number of head of cattle to no more than the average
that was there when it was a working farm. Mr. Sitzman raised the
feed and fed it to the cattle. Now it is a 21 acre commercial
feedlot.
2. Treat the county road twice a year for 100 yards in front of
our home to keep the dust down from the large amount of traffic
hauling feed either in or out of this commerical feedlot, to feed
over 2500 head of cattle at other locations.
3. Move feed storage and hay grinding operation to north side of
county road and to the east of feed lot, on the additional ground
added to Lot A.
4. Special Use Permit can not be transferred to new owner if
property is sold.
5. Wardlaws should replace and keep in good condition the fence
between our farms to keep their cattle which are always out from
getting into our field.
G. Deed restriction that there could be no more cattle on the
property than would be agreed upon.
7. Manure can never be piled on the south side of WCR 60.
