HomeMy WebLinkAbout962094.tiff tq8 EMERGENCY ORDINANCE NO. 193 IN THE MATTER OF SETTING THE MILL LEVY FOR THE ANNUAL APPROPRIATION FOR WELD COUNTY, COLORADO, FOR FISCAL YEAR 1997 BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF WELD, STATE OF COLORADO: WHEREAS, the Board of County Commissioners of the County of Weld, State of Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, it is necessary, by Colorado statute and by the Weld County Home Rule Charter, to set the mill levy for the annual appropriation for Weld County Colorado for Fiscal Year 1997, and WHEREAS, the Board of County Commissioners of Weld County, Colorado, adopted the annual budget in accordance with the Local Government Budget Law, on December 9, 1996, and WHEREAS, the amount of money necessary to balance the budget for County funds is as follows: FUND AMOUNT County General Fund $19,187,023 Road and Bridge Fund 2,133,587 Social Services Fund 4,163,848 Capital Expenditures 3,226,000 IGS - Insurance Fund 550,000 $29.260.458 WHEREAS, the 1996 valuation for assessment for the County of Weld as certified by the County Assessor is $1,327,727,491 for Budget Year 1997. NOW, THEREFORE, BE IT ORDAINED by the Board of County Commissioners in and for the County of Weld, State of Colorado, that for the purpose of meeting all legal expenses under Section 29-1-301 through 29-1-305, CRS, as amended, and Section 14-7 of the Weld County Home Rule Charter, there is hereby levied the following mills upon each dollar of the total valuation for assessment of all taxable property within the County for Fiscal Year 1997: FUND MILLS REVENUE County General Fund 14.451 $19,187,023 Road and Bridge Fund 1.607 2,133,587 Social Services Fund 3.136 4.163.848 Capital Expenditures Fund 2.430 3,226,000 IGS - Insurance Fund .414 550.000 22.038 $29,260,458 2525198 B-1581 P-598 12/16/1996 03:53P PG 1 OF 2 REC DOC 962094 Weld County CO JA Suki Tsukamoto Clerk & Recorder 0.00 ORD193 RE: ORDINANCE NO. 193 PAGE 2 BE IT FURTHER ORDAINED by the Board that the County Assessor and the County Treasurer of Weld County, Colorado, be, and hereby are, authorized and directed to make such entries upon their books, at such time or times as will be necessary to make this Mill Levy Ordinance for the annual appropriation for Weld County, Colorado, for Fiscal Year 1997, effective. BE IT FURTHER ORDAINED by the Board that an emergency exists inasmuch as State law requires that the mill levy of Weld County, Colorado, be enacted on or before the 15th day of December, 1996, therefore, this Ordinance is declared to be an Emergency Ordinance under the provisions of Section 3-14 of the Weld County Home Rule Charter. BE IT FURTHER ORDAINED by the Board, if any section, subsection, paragraph, sentence, clause, or phrase of this Ordinance is for any reason held or decided to be unconstitutional, such decision shall not affect the validity of the remaining portions hereof. The Board of County Commissioners hereby declares that it would have enacted this Ordinance in each and every section, subsection, paragraph, sentence, clause, and phrase thereof irrespective of the fact that any one or more sections, subsections, paragraphs, sentences, clauses, or phrases might be declared to be unconstitutional or invalid. The above and foregoing Ordinance Number 193 was, on motion duly made and seconded, adopted by the following vote on the 9th day of December, A.D., 1996.
