W. DeVinny, W. R. Adams, Clerk. By A. . J. Luther, Deputy. IN THE MATTER OF ROAD VIzw1HS REPORT ON ROAD IN TOWNSHIP 4, Range 67 West. The report of H. J. Parish, John J. Thornton and A. J. Swanson, viewers appointed on the 8th day of March 1902, to view a line of road as follows, viz: Commencing at the terminus of the present County road at the Northeast corner of the S. E. 4 of Sec. 16, Township 4, Norte ; Range 67 west; Thence South one and one half miles on section line to the Northeast corner of Section 25, Tp. 4, N., R. 67 W. was presented when the following action was taken and entered. of record, to—wit: The Board having carefully considered the report of the viewers herein, as well /? ( the objections made thereto, and finding the report correct as to form, and believing O the public good requires the laying out of the, road as recommended by the viewers, it . was on motion ordered that the_ report be approved and adopted, and the road therein ,.,ascribed and recommended by the viewers be and is hereby declared a public hiGhway. The Clerk is directed to record the report, plat the road, draw warrants in favor of t&c1 parties for damages awarded, and cause notices to be posted of opening of said road, and notify. the road overseer of proper district to open the same to travel in sixty days as required by law. IN THE MATTER OF. VACATING PART OF ROAD NO. 91. The report of J. W. Whowell and Wm. Clark, viewers appointed on the 3rd day of February 1902, to view a line of road asked to be vacated, to-wit : Beginning .at the N.E.. corner of the S.W.` of the S.W.* of Sec. 4, Tp. 3, N. R. 61 W. and thence running East Three Quarters of a mile to the presAnt County road along the East side of said Sec. 4, the sane being known as a portion of the County Road No.91 was preented to the Board when the following action was taken and entered of record, y to-wit: The Board having carefully considered the report of the viewers herein, as well as the objections made thereto, and finding the report correct as to form, and believi'11 the public good does not require said road as recommended by the viewers to be vacated, a it was on motion ordered that the report be approved and adopted, and the road therein described and. recommended by the viewers be and is hereby declared vaca .wu and ..ban- doned. Steck, viewers appointed March 72 1902, to view a line of road asked to be vacated, to- wit: , _ Commencing• at• the N.W. Corner of the N.W.* of Sec. 26, Tp. 5 N. R. 64 W. ; Thence running East on Section line to the N.E. Corner of said N.W.4 of said Section 26; thence running in a southeasterly direction to the East line of ,i7o2 said section 26; Thence running south on section line to the- S.E. Bryant, Viewers appointed March 52 1902, to view a line of road as follows, viz: Commencing at the Southwest corner of section 8, Township 4, North, Range 65 West, Thence running Due East two miles to intersect the present County Road run- ning North and South at the Southwest Corner of section 10, Tp. 4,North, Range 65 Nest. Also to vacate the present County Road running East and West along the fib 3'-(P half section line through sections 8 and 91 Tp. 41 N. 1 R. 65 W. A petition was presented from the Union Pacific Railroad Company objecting to the amount of damages allowed by the viewers in a certain Road Viewers Report and praying that a jury be appointed to ascertain the compensation to which it may be entitled by reason of damages sustained by the altering, or laying out the road . which is described as follows, to-wit : "Commencing at the terminus of the present County Road at the East line of the N.W.4 Sec. 30, Tp. 5, R. 63 ; thence running North across the track of the Union Pacific Railroad Company to the Borth line of the riGht of way of said railroad company; thence in a Southeasterly direction along the north line of the right of way of said Company through sections 30, 29, 2$ and. 33 Tp. 5, R. ( 2 63, to intersect the present County Road at Hardin Station on the North side of said Railroad; also to extend the present County Road on section lines between Secs.22 and 33, Tp. 5, R. 63 East, across the Union Pacific Railroad.Company to intersect said proposed road above described. Whereas, the -viewers on Road VIEWERS Report. on Road No. 449 re- ported in favor of vacating COUNTY Road No. 326, said road running East and West through , the center of Sections 8 and 9 Tp. 4, N. , R. 65 W. ; - �: And •Whereas, said recommendation was not approved by this Board in the action had on said report for the reason that certain objections were then made to the vacating of said road which objections have since been withdrawn- ' Now -Therefore, it is ordered that the action of the Board upon that part of said report as far as pertains to the vacating of the present County Road running EAST AND West along the half section line through sections 8 and 92 township 4' N. R. 65 W. be , and the same is hereby rescinded and held for naught and the road be and -the same is hereby vacated and ,abandoned as recommended by the viewers.
