RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL
ACTION AGAINST JAMES AND BARBARA DURFEE/GERALD COOPER FOR VIOLATION
OF THE WELD COUNTY ZONING ORDINANCE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, James and Barbara Durfee/Gerald Cooper, VI #2267, are allegedly in violation
of the Weld County Zoning Ordinance, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not
been corrected, and
WHEREAS, on the 9th day of April, 1996, a public hearing was held before the Board of
County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS,James Durfee, property owner, and Gerald Cooper, tenant, were present at said
hearing, and
WHEREAS, the Board of County Commissioners deems it advisable to delay referral of said
violation to the Weld County Attorney's Office for a period of ninety days to allow adequate time for
the property owners and tenant to bring the subject property into compliance and for an inspection
of the property by the Department of Planning Services staff, and
WHEREAS, the Board deems it advisable to proceed with legal action against the above
named individuals without further Board action if the subject property is not brought into compliance
within ninety days.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that if said violation still exists on July 9, 1996, the Weld County Attorney be, and
hereby is, authorized to proceed with legal action against James and Barbara Durfee and Gerald
Cooper to remedy the violation of the Weld County Zoning Ordinance, and any other persons
occupying the properties, any persons claiming an interest in the properties, and any persons acting
in active concert with the identified parties.

Dear Mr. and Mrs. Durfee:
The property referenced above remains in violation of the Weld County Zoning Ordinance. I
have scheduled a meeting with the Board of County Commissioners on April 9, 1996 at
10:00 a.m. to consider the Zoning Violation occurring on your property. This meeting will take
place in the County Commissioners' Hearing Room, first floor, Weld County Centennial Center,
915 Tenth Street, Greeley, Colorado. It is recommended that you or a representative be in
attendance to answer any questions the Board of County Commissioners might have about the
violation.
The Department of Planning Services' staff will be recommending that the Board of County
Commissioners authorize the County Attorney to proceed with legal action to remedy the
violation. Our records indicate that you were made aware of the nature of the violation,the
action necessary to correct the violation, and that you were given sufficient time to remedy the
violation.

The property was inspected to determine compliance with section 32.6.2 of the Weld County
Zoning Ordinance. The property is not in compliance at this time.
There is still a huge non-commercial junkyard located on the property that consists of derelict
vehicles, furniture, household items, car parts and miscellaneous junk and trash. I did meet with
the tenant, Geralatooper,at the time of inspection ITe ndicated e may want to build a fence
to screen the non-commercial junkyard. I told him that he would need to check into the
covenants of Hill-N-Park. The covenants may prohibit him from building a privacy type fence in
the front part of the property where the non-commercial junkyard is located. To bring the
property into compliance the non-commercial junkyard must be removed from the property. The
derelict vehicles must be removed or totally screened from all adjacent properties and public
rights of way. Only two derelict vehicles may be screened. If the derelict vehicles are to be
screened, a detailed screening plan must be submitted to and approved by the Department of
Planning Services staff prior to installation.

The property was inspected to determine compliance with section 32.6.2 of the Weld County
Zoning Ordinance. The property is not in compliance at this time.
I met with the tenant on the property, Gerald Cooper, at the time of inspection. There is a huge
non-commercial junkyard located in front(south) of the mobile home. Mr. Cooper said that he
was going to have a yard sale to get rid of most of the items (furniture, household items and
miscellaneous junk) and was also interested in opening an indoor flea market in downtown
Greeley to dispose of the rest of it. I explained that I would be back out to inspect the property
sometime after February 20 since that is when the Zoning Violation Notice expires. If the
property is not in compliance at that lime I told Mr. Cooper that the Department of Planning
Services would schedule the violation before the Board of County Commissioners on April 9,
1996. To bring the property into compliance the non-commercial junkyard must be totally
removed from the property. The derelict vehicles on the property must be removed or totally
screened from all adjacent properties and public rights of way. Only two derelict vehicles may
be screened. If the derelict vehicles are to be screened a detailed screening plan must be
submitted to and approved epartment of Planning Services Staff prior to installation.

the Weld County Zoning Ordinance. There is a non-commercial junkyard located on the property. It
consist of large amounts of furniture and other miscellaneous junk. There is also a derelict car located on
the property. This is not a use allowed by right in the R-5 (Mobile Home Residential)zone district. The
violation can be corrected by removing the non-commercial junkyard.
It is the intention of this office to assist and cooperate with you without imposing undue hardships;
however,we have no discretion in this matter if you fail to correct this violation.You have 30(Thirty)
days from January 19, 1996 to correct this zoning violation.Failure to do so will result in this office
scheduling the violation before the Board of County Commissioners to consider whether to refer the
violation to the County Attorney's office for legal action.

Dear James M. and Barbara J. Durfee:
It has come to the attention of the Department of Planning Services' staff that the uses on your
property(4520 Grand Canyon) may not be in compliance with the Weld County Zoning
Ordinance, 32.6.2. The potential noncompliance with the zoning ordinance is a noncommercial
junkyard in an R-5 (Mobile Home Residential) District. The noncommercial junkyard consist of
three derelict cars, furniture, furniture parts, carpet,chairs, speakers, a television, fencing, an
exercise machine, shelves, and miscellaneous other junk material.All of these items are visible
from the road and adjacent properties. To bring the property into compliance the noncommercial
junkyard must be removed.
In accordance with Section 32.2.3.6, two of the derelict vehicles may remain if they are screened
from adjacent properties and roads. If screening two vehicles is the option you choose to take
then a detailed screening plan needs to be submitted to the Department of Planning Services for
review and approval prior to installation.
Please call me within five working days of the date of this letter to review the concerns with me.
