RE: APPROVE MEMORANDUM OF UNDERSTANDING IMPLEMENTING THE
COLORADO WORKS PROGRAM AND THE COLORADO CHILD CARE ASSISTANCE
PROGRAM AND AUTHORIZE CHAIR TO SIGN - COLORADO DEPARTMENT OF
HUMAN SERVICES
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with a Memorandum of Understanding
Implementing the Colorado Works Program and the Colorado Child Care Assistance Program
between the County of Weld, State of Colorado, by and through the Board of County
Commissioners of Weld County, and the Colorado Department of Human Services, with terms
and conditions being as stated in said memorandum of understanding, and
WHEREAS, after review, the Board deems it advisable to approve said memorandum of
understanding, a copy of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the Memorandum of Understanding Implementing the Colorado
Works Program and the Colorado Child Care Assistance Program between the County of Weld,
State of Colorado, by and through the Board of County Commissioners of Weld County, and
the Colorado Department of Human Services be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized
to sign said memorandum of understanding.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 24th day of May, A.D., 1999.

MEMORANDUM OF UNDERSTANDING
The State of Colorado Department of Human Services
and
The Board of County Commissioners of County, Colorado
This Memorandum of Understanding (or"MOU") made this day of
1999, between the State of Colorado Department of Human Services (the "Department") and the
Board of County Commissioners of Weld County, Colorado (the "County").
WHEREAS, the Department is the sole state agency having the responsibility to
administer or supervise the administration of the human services programs set forth in §26-1-
201, C.R.S. (1997); and
WHEREAS, the Colorado General Assembly enacted Senate Bill 97-120 in response to
the passage of the federal "Personal Responsibility and Work Opportunity Reconciliation Act of
1996" and thereby adopted the Colorado Works Program (the "Works Program") and the
Colorado Child Care Assistance Program(the "Child Care Program"); and
WHEREAS, §26-2-715, C.R.S. (1997), requires the Department and the County to enter
into an annual performance contract identifying the County's duties and responsibilities in
implementing the Works Program and the Child Care Program; and
WHEREAS, nothing in this MOU shall create a legal entitlement in any person to
assistance provided pursuant to the Works Program or the child care assistance provided
pursuant to the Child Care Program; and
WHEREAS, the parties understand and agree that the services and assistance
contemplated in this MOU are subject to available appropriations by the General Assembly and
the County, and neither party shall be obligated to provide services or assistance if adequate
appropriations have not been made; and
WHEREAS, the State Controller has approved execution of this MOU without State
Controller examination pursuant to the State fiscal rules.

NOW, THEREFORE, it is agreed that:
1. MOU MEETS PERFORMANCE CONTRACT REQUIREMENT.
The parties hereto specifically agree that the provisions of this MOU in their
entirety constitute compliance with the provisions of§26-2-715, C.R.S. (1997).
2. TERM.
The term of this MOU will be from the date set forth above to and including
December 31, 1999.
3. DUTIES OF THE COUNTY.
a) The County shall administer and implement the Works Program and the
Child Care Program using fair and objective criteria and in compliance
with federal law; and
b) The County shall not reduce the basic assistance grant administered
pursuant to §26-2-709, C.R.S. (1997), except as otherwise provided by
law; and
c) The County shall not restrict eligibility or the provisions of services, nor
shall it impose sanctions, in a manner inconsistent with Part 7 of Article 2
of Title 26, C.R.S. (1997), or the State Plan submitted by the Department
to the federal government pursuant to §26-2-712, C.R.S. (1997); and
d) For the term of this MOU from January 1, 1999, to September 30, 1999,
the County shall achieve a work participation rate of zero percent (0%) for
single-parent families and a work participation rate of twenty-three percent
(23%) for two-parent families. For the portion of the term of this MOU
from October 1, 1999, to December 31, 1999, the County shall achieve a
work participation rate of zero percent (0%) for single-parent families and
a work participation rate of twenty-three percent (23%) for two-parent
families; and

e) The parties acknowledge that the work participation rate is, as of the
signing of this MOU, the only performance goal identified pursuant to
§26-2-712(4), C.R.S. (1997); and
f) The County shall maintain the records, and shall permit the Department,
its duly designated agents and/or appropriate representatives of the federal
government, to inspect the records and shall make such records available
to the Department as specified in §26-2-717, C.R.S. (1997). The County
shall also continue to report to the Department as required by § §26-2-716,
26-2-717, C.R.S. (1997), and shall report to the Department in the future
as required by law; and
g) The County agrees to provide the Department with written information as
specified herein. The County may, in its sole discretion, change the way in
which it implements the Works and Child Care Programs in any manner
consistent with state and federal law. The County agrees to provide the
Department with updated written information, when or if changes to these
Programs are made. At a minimum, the County agrees to provide
information to the Department as requested on Attachments A through N.
If the County has developed written policies for implementing the Works
and Child Care Programs, it agrees to provide copies of these policies to
the Department. The County agrees to provide the information and policies
specified in this paragraph(g)to the Department within thirty (30) days of
their adoption by the County, and
h) The parties expressly agree and understand that information and policies
provided by the County to the Department as set forth in paragraph (g)
above are for informational purposes and are provided to assist the
Department in discharging its responsibilities with respect to these
Programs. Nothing in this MOU gives the Department the authority to
approve, deny or require any County policies. The County acknowledges
the Department's right to review, comment upon or request reasonable

additional information or clarification of any such County policies or
records. Such requests shall be made in writing and directed to the County
department of social services director. The County asserts that it will
consider such comments in its implementation of these Programs without
being obligated to incorporate in its Programs any Department comments
or suggestions.
4. DUTIES OF THE DEPARTMENT.
a) The Department shall oversee the implementation of the Works Program
statewide, and in connection therewith, shall develop, in consultation with
the Counties, standardized forms that shall streamline the application
process, delivery of services, and tracking of participants; and
b) The Department will monitor the County's provision of basic assistance
grants, and if necessary,perform those duties set forth in §26-2-712(5)(e),
C.R.S. (1997); and
c) The Department shall develop and provide training for Works Program
staff as required by §26-2-712(7), C.R.S. (1997); and
d)(i) Sanctionable actions. Subject to the other limitations set forth herein, the
Department may impose sanctions as provided in this MOU if the actions
of the County result in the County:
(A) Failing to maintain the minimum cash assistance grant to a family
in which the single caretaker of a child under six years of age has
not complied with work requirements due to an inability to obtain
needed child care as determined by the County or in violation of
federal law.
(B) Misusing federal or state Works Program or Child Care Program
funds, including receipts or recoveries that are not reported, where
a federal or state law or regulation enacted before the use of the
funds requires the funds to be spent in a different way. County

Works Program and Child Care Program funds that are misused
will not qualify toward meeting the County maintenance of effort
or County share requirements.
(C) Failing to satisfy work participation rates as contained in this
MOU.
(D) In violation of state or federal law, reducing the basic assistance
grant, restricting eligibility or the provision of services, or
imposing sanctions in a manner inconsistent with state law or a
state plan, which is in compliance with federal law.
(E) Failing to comply with any other provision of the Colorado Works
Program if such failure causes the Department to incur a federal
fiscal sanction.
(d)(ii) Sanction Procedures. In any instance where the Department determines
that the County has failed in an obligation specified in paragraph 4(d)(i) of
this MOU, causing the Department to incur a fiscal sanction and the
Department is considering a fiscal sanction against the County, the
Department shall proceed as follows:
(A) The Department shall provide the County thirty (30) days written
notice of the proposed sanction before imposing any fiscal
sanction. Such written notice shall include: 1) All of the reasons
for the imposition of the sanction; 2) Documentation specifying
how the sanction was calculated, and documentation supporting the
amount of the sanction; 3) A specific indication of what constitutes
a remedy or correction that will allow the County to avert the
sanction, if any remedy or correction is possible; and 4) An
acknowledgment that if the County remedies or corrects the
sanctionable action as set forth in the notice, a sanction will not be
imposed by the Department. The corrective action contained in the
notice shall be specific to the action giving rise to the sanction, and

shall not extend beyond such violation. Upon receiving such
notice, the County shall have the opportunity within thirty (30)
days to contest, explain, offer evidence of mitigating factors,
and/or submit a plan to correct the alleged failure before the
Department imposes the sanction.
(B) If the County fails to correct the action, and a sanction is imposed,
the Department may impose a sanction for the failure of the County
in an amount no greater than the fiscal sanction imposed by the
federal government against the Department. Additionally,the
amount of said sanction cannot exceed the funds spent by the
Department for a sanction incurred because of the County's failure
to meet its obligation. If the Department has incurred a sanction
due to the failure of more than one County to meet its obligations,
the County shall only be sanctioned for its share of the sanction
incurred by the Department.
(C) The Department agrees to provide the County with all documents
received from the federal government related to any proposed or
imposed federal sanction within twenty (20) days of receipt by the
Department, together with all Department documents related to the
actions giving rise to that federal sanction, or which relate to the
sanction process.
(D) The County may appeal to the Governor any sanction imposed
pursuant to this section. Such appeal must be initiated by notice
provided to the Governor and the Department by certified mail no
later than thirty (30) days after the date of the imposition of the
sanction. The appeal shall consist of the exchange of memoranda
briefs. The Governor may either affirm or reverse the imposition
of the sanction.
e) The Department (or its duly designated agent) may assume the County's

administration and implementation of the Works Program and the Child
Care Program if the County deliberately or consistently fails to meet its
obligations under this MOU or under the federal or state law pertinent to
the Works Program or the Child Care Program. The Department shall
provide the County thirty (30) days written notice before assuming these
duties. Upon receiving such notice, the County shall have the opportunity
to contest explain, offer evidence of mitigating factors, or to correct the
failure before the Department assumes the duties; and
f) The Department shall allocate the amount of moneys that are provided to
the County as part of the County's block grant for the purpose of its
administration and implementation of the Works Program pursuant to the
formulas described in §26-2-714, C.R.S. (1997). Payment of all money so
allocated shall be made to the County in accordance with §26-1-122(3)(b),
C.R.S. (1997); and
g) The Department will, in consultation and in conjunction with the County,
develop or modify automated systems to meet the reporting requirements
of§26-2-717, C.R-S. (1997). However, if any automated system
developed by the Department is incompatible with any existing County
system, and a reporting error or discrepancy results, the Department shall
not, for that reason, impose sanctions on the County.
5. DISCRETIONARY MATTERS REMAIN THE SAME.
The parties agree that all portions of Senate Bill 97-120 that grant discretion to either
party regarding the administration of the Works or Child Care Programs in the County
shall not be affected by the execution of this MOU.
6. SEVERABILITY.
To the extent that this MOU may be executed and performance of the obligations of the
parties may be accomplished within the intent of the MOU, the terms of the MOU are

severable, and should any term or provision hereof be declared invalid or become
inoperative for any reason, such invalidity or failure shall not affect the validity of any
other term or provision hereof The waiver of any breach of term hereof shall not be
construed as a waiver of any other term or of the same term upon subsequent breach.
7. INTEGRATION OF UNDERSTANDING.
This MOU is intended as the complete integration of the understanding between the
parties concerning the matters negotiated between them and incorporated in this MOU.
No prior or contemporaneous addition, deletion, or other amendment hereto shall have
any force or effect whatsoever unless embodied in writing. No subsequent notation,
renewal, addition, deletion, or other amendment hereto shall have any force or effect
unless embodied in a written amendment executed by the parties.
The parties, however, recognize the nature of the relationship between the County and the
State. This relationship is governed more broadly by pertinent provisions of the Colorado
Constitution and of state statutes and rules, including lawful rules promulgated by the
state Board of Human Services. The parties further recognize that this MOU is not
intended to supersede or change the relationship between the County and the State as
established by any legal authority.
8. NO THIRD PARTY BENEFICIARY.
Except as herein provided otherwise, this MOU shall inure to the benefit of and be
binding upon, the parties and their respective successors and assigns. It is expressly
understood and agreed that the enforcement of the terms and conditions of this MOU, and
all rights of action relating to such enforcement, shall be strictly reserved unto the
Department and the County, to the extent permitted by law. Nothing contained in this
MOU shall give or allow any claim or right of action whatsoever by any other third
person. It is the express intention of the Department and the County that any such person
or entity, other than the Department or the County, receiving services or benefits under

this MOU shall be deemed an incidental beneficiary only.
9. DISPUTE RESOLUTION.
The parties shall work in good faith to resolve any disputes arising from this MOU. If the
parties are unable to resolve such disputes, with exception of the appeal of sanctions
imposed by the Department, pursuant to paragraph 4.d)(ii)(D) of this MOU, they may
refer the matter to a dispute resolution panel for non-binding mediation. The dispute
resolution panel will consist of three members: One selected by the County, one selected
by the Department, and one selected by the other two members of the panel. The parties
shall provide the panel with the information necessary to consider the dispute. The panel's
decision shall be made by a majority vote of its members. Such mediation is not a
jurisdictional prerequisite to legal action by either party.

Dear Ms. Hammon:
Enclosed is the original Memorandum of Understanding between the State of Colorado
Department of Human Services and the Board of County Commissioners of Weld County,
Colorado ("MOU"). The MOU+has been approved by the Board, signed, and attested to by
the Clerk to the Board. Attachments A. through N.have been completed and are attached.
Please note that the enclosed MOU has a number of changes from the version which your
office sent to Weld County in November, 1998. The changes include the following:
a. Paragraph 2.sets the term from the date of signature to December 31, 1999.
b. Paragraph 3.d)includes the work participation rates for single-parent families
and two parent families for Weld County using the County's case load
reduction factor of 67%. See the enclosed document produced by Judy
Griego,Directory Weld County Department of Social Services, entitled"Case
Load Reduction Factor.
c. Paragraph 4.d)(ii), entitled: "Limitations on Sanctions for Failure to Meet
Work Participation Rate,"has been eliminated in it entirety. The former
paragraph 4.d)(iii), entitled: "Sanction Procedures when Department has been
Sanction," has been renumbered as 4.d)(ii) and entitled: "Sanction
Procedures."
d. Subparagraph 4.d)(ii)(D) has been added. This subparagraph provides for an
appeal by the County directly to the Governor if sanctions are imposed.

OUT-OF-WEDLOCK BIRTH RATIO

The federal welfare reform law requires each state to have a plan to reduce out-of-wedlock pregnancies with
special emphasis on teenage pregnancies for calendar years through the year 2005. Senate Bill 97-120 requires the
State Department to establish and monitor statewide goals for the reduction in the incidence of out-of-wedlock
pregnancies. This program is not required to be implemented by any county. To meet these requirements,the
State requests the following information from each county to be provided at the option of the county. States that
are successful in reducing out-of-wedlock births may qualify for up to$25 million in incentive payments.
Counties may be a recipient of these funds which may in part be allocated to counties based on their performance
in this area.

Describe the process involved for Colorado Works and Low-Income families to apply for child care. The
description must include:
1. How parents are informed of the availability of child care and of available child care options:
a. Colorado Works families: All families are informed of child care
availability at the time of application for Colorado Works.
Child Care staff inform applicants and recipients of Colorado
Works on the available types of child care in the community:
centers, family day care homes, legally exempt care providers
and in—home care. Referrals are also made to other community
resource agencies.
•
b. Low-Income families: Parents are informed of the Low Income Child
Care Program by agency staff, child care centers, licensed
providers, high schools, and community agencies. Social Services
staff attend public meetings to provide information and outreach
for the Low Income Child Care Program. A newsletter is distributed
quarterly to child care providers informing them of rule changes,
application procedures, and eligibility requirements.
2. Where and how are applications made?
a. Colorado Works families: Applications for Colorado Works Child Care are
made/available at the time of application for Colorado Works or
anytime thereafter as the need arises. The application is made
at the Department of Social Services.
b. Low-Income families: Applications are available every day from
8:00 to 4:30 p.m. at the Department of Social Services.
Orientations for Child Care services are conducted two times
per week. Special arrangements are made for individuals who
are unable to attend the Low Income Child Care orientation
sessions.

period from date of contact maximum) . Eligibility starts with the date

are made for individuals who are unable to attend the orientation sessions.
b. Receive notice that s/he is eligible for child care assistance after the Low-Income application
is completed: Individuals are informed of their eligibility at the time of
application. Low Income Child Care staff calculate/determine eligibility
during the interview. process whenever possible.
c. Receive a certificate after the application is completed and a provider has been selected:
Certificates are provided with-in 10 days.

assigned to the Colorado Works in Weld County Program determine

Parental education is defined as consumer information that promotes informed child care choices.

education component of Weld County's child care program consists of the
following:
1. Orientation sessions for all applicants which includes information

selection.

Procedures:
Parental education is provided at the time of application and ongoing
as needed and requested. Informational brochures are distributed in
addition to informational meetings for all new applicants. An emphasis
is made for the Department of Social Services to communicate and network

and knowledge of child care programs, availability and quality.

6.001 Definition and Legal Basis
The Governor and the State Legislature created the Colorado Works Program on July 1,
1997, in response to Federal welfare reform legislation that replaced the Aid to Families
with Dependent Children under Part A of Title IV of the Social Security Act. The
Colorado Works Program also incorporated the Colorado Child Care Assistance Program.
Under the Colorado Works Program,the Board of County Commissioners, as the Board of
Social Services, is provided certain policy responsibilities under the law and state
regulations. The Board of Social Services outlines policies and procedures under the
Weld County Department of Social Services Operations Manual,through resolution. The
Board of Social Services may amend the Department's Operations Manual, through
resolution and as appropriate.
The legal basis of the Colorado Works in Weld County Program is as follows:
A. "Personal Responsibility and Work Opportunity Reconciliation Act of 1996",
Public Law 104-193.
B. "Colorado Works Program Act", Article 2 of title 26, Colorado Revised Statutes,
Part 7, Section 26-2-701 through Section 26-2-722,and other associated statute
revisions.
C. "Colorado Child Care Assistance Program Act",Article 2 of title 26, Colorado
Revised Statutes, Part 8, Section 26-2-801 through Section 26-2-806.
D. Colorado State Rules Section 3.600,Volume III, Income Maintenance Programs.
E. Colorado State Plan for Temporary Assistance to Needy Families, as adopted and
revised by the Colorado Board of Human Services,the Governor of Colorado, and
the Federal Department of Human Services.
F. "The Weld County Department of Social Services Operations Manual",as
adopted and revised by the Board of Weld County Commissioners, as the Board
of Social Services,through resolution.

6.002 Eligibility and Basic Grant Assistance
Effective 9/10/97
6.002.1 _ Eligibility
The Department will follow those general eligibility guidelines for Colorado Works in
Weld County as established by the Colorado Department of Human Services. The State
Department outlines these guidelines in Section 3.600,Volume III, Income Maintenance
Programs, and the Colorado State Plan for Temporary Assistance to Needy Families.
Eligible recipients for Colorado Works in Weld County benefits are subject to the
availability of funds. If funding is available,the family will be eligible for a cash grant,
services, or vouchers if:
A. The family's gross income is under the standards in effect on July 16, 1996, and;
B. Resources do not exceed $2000. Countable resources are the same as included in
Colorado's State Plan in effect on July 16, 1997, for AFDC except that one car is
exempt from countable resources.
C. Additional incentives may be available to employed individuals as outlined in the
county plan.
D. The family may be eligible for family preservation services as determined under
the standards effective as of September 30, 1995.
E. Minor parents under age eighteen:
Revised 3/98 1. who are not married must reside or intend to return to their parent's or
guardian's home unless there are indications that this may be an abusive
or neglectful environment. Those situations where there is suspected
abuse of neglect will be referred to Child Welfare Service for Evaluation;
2. who have not completed high school or its equivalent, must also attend
high school, work on a GED, or be in an alternative education or training
program approved by the State to be eligible for assistance.
F. Teen parents will be approved if they attend an educational program. If they have
dropped out,they will need to meet the provisions of eligibility for minors.
The following persons will be ineligible for Colorado Works in Weld County:
A. Fugitive felons and parole probation violators.
B. Persons convicted of drug-related felonies after July 1, 1997, unless such person is
determined to have taken action toward rehabilitation.
C. Qualified legal aliens entering the country after August 22, 1996, except federally
Colorado Works in Weld County and Child Care Policies and Procedures
authorized exceptions.
6.002.2 Domestic Violence Screening
Colorado Works in Weld County will follow the State rules concerning domestic violence
screening. All Colorado Works in Weld County applicants and recipients will be given
the opportunity voluntarily and confidentially to identify themselves as victims of
domestic violence. The Department will inform staff of support services for domestic
violence victims and make appropriate referrals to those services. Training will be
provided to Department staff on domestic violence issues and how to identify domestic
violence victims and circumstances. Colorado Works in Weld County applicants and
recipients who are domestic violence victims will have the opportunity to apply for the
county's temporary good cause exemption from work participation.
6.0023 Basic Cash Assistance
Basic cash assistance grants will be provided to eligible Colorado Works in Weld County
recipients in accordance with statewide benefit levels and other Colorado State
Department of Human Service regulations identified in Volume III, section 3.600.

6.003 Client Assessment
Effective 9/10/97
6.003.1 _ Applicants
6.003.11 Department Responsibilities
A. At initial application, Department staff will assess the individual's eligibility for
public assistance. The Department's screeners will refer applicants to the child
support enforcement unit immediately after they have expressed their intent to
apply for Colorado Works in Weld County services. An appointment will be
scheduled for the applicant to meet with the eligibility technician. The applicant
will provide a completed application and supporting documents to the technician
at this meeting.
B. The Department Eligibility Technician will complete an initial eligibility
assessment for all applicants. This assessment will identify those applicants who
may be temporarily exempt for good cause from work participation.
C. Department staff will initiate an Individual Responsibility Contract(IRC) with the
applicant. Department staff will explain verbally and in writing the Colorado
Works in Weld County program provisions, participant responsibilities, and
participant rights as outlined in the first section of the IRC. Department staff will
obtain the necessary applicant and Department staff signatures.
D. Department staff will schedule an appointment and send the applicant to
Employment Services of Weld County(Employment Services),which is a
subdivision of the Weld County Division of Human Services. The Department's
referral constitutes a referral of the applicant to employment.
6.003.12 Employment Services Responsibilities
A. At Employment Services,the applicant will complete an employment assessment
for individuals who are not temporarily exempt from participation in work
activities.
B. An employment assessment will be completed on all scheduled applicants. This
assessment will identify the work history,education, employment interests, skill
levels and employment goals of the applicant. The employment assessment will
also assess the applicant's need for supportive services and identify their barriers
to employment. Employment Services' staff will give applicants information on
the local labor market and current employment opportunities at the time of this
assessment.
C. The employment assessment will be the basis for completing the work activity
assignment under the IRC. Employment Services' staff will schedule applicants,
unless exempted after the employment assessment,to attend an IRC Skill
Development Seminar.

D. Upon the completion of the IRC Skill Development Seminar, Employment
Services' staff will reassess applicants who have not obtained employment and
have become recipients. Employment Services' staff will determine any
additional work activities and/or supportive services the applicant may need to
obtain or retain unsubsidized employment. This assessment may include
additional testing, including basic skills,academic,vocational assessments,or
employment and career exploration.
E. The Employment Services' staff, along with the applicant, will complete the

6.003.2 Recipients
6.003.21 Department Responsibilities
A. Department staff will provide an initial eligibility and employability assessment
for the current case load as of July 1, 1997, through a mailed assessment form.
These recipients will complete mailed assessment forms between July 1, 1997,
through October 1, 1997.
B. Department staff will initiate an Individual Responsibility Contract(IRC)with the
recipient. Department staff will explain verbally and in writing the Colorado
Works in Weld County program provisions, participant responsibilities, and
participant rights as outlined in the first section of the IRC. Department staff will
obtain the necessary recipient and Department staff signatures.
C. Department staff will schedule an appointment and send the recipient to
Employment Services. The Department's referral constitutes a referral of the
recipient to employment.
D. Department staff will reassess recipients who are temporarily exempted from work
participation within three months of the last IRC to determine their readiness to
participate in an employment assessment.
6.003.22 Employment Services Responsibilities
A. At Employment Services, the recipient will complete an employment assessment
for individuals who are not temporarily exempt from participation in work
activities.
B. An employment assessment will be completed on all scheduled recipients. This
assessment will identify the work history,education,employment interests, skill
levels and employment goals of the recipient. The employment assessment will
also assess the recipient's need for supportive services and identify their barriers
to employment. Employment Services' staff will give recipients information on
the local labor market and current employment opportunities at the time of this
assessment.

C. The employment assessment will be the basis for completing the work activity
assignment under the IRC. Employment Services' staff will schedule recipients,
unless exempted after the employment assessment,to attend an IRC Skill
Development Seminar.
D. Upon the completion of the IRC Skill Development Seminar, Employment
Services' staff will reassess recipients who have not obtained employment and
have become recipients. Employment Services' staff will determine any
additional work activities and/or supportive services the recipient may need to
obtain or retain unsubsidized employment. This assessment may include
additional testing, including basic skills, academic, vocational assessments, or
employment and career exploration.
E. The Employment Services' staff, along with the recipient, will complete the
Second Section of the IRC as a result of this screening and assessment process.
6.003.3 Participant Assessment
An applicant or recipient entering employment or those placed in work activities will
undergo a participant assessment at the one month, three month, and six month intervals
of their participation.
A. Department staff, Employment Services' staff, or contractor staff will provide this
follow-up assessment to offer participants mentoring services, if appropriate.
These mentoring activities are designed to help the person retain employment and
may include,but not limited to, counseling in work ethics and job retention.
B. Department staff or Employment Services' staff will assess participants to identify
and provide, if appropriate, any additional supportive service needs the participant
may require to maintain their employment or work activity participation.

6.004 Individual Responsibility Contracts

Revised 12/98 - A. IRC for Non-Diversion Program
The Department will develop with a client and monitor the Individual
Responsibility Contact(IRC). The Individual Responsibility Contract(IRC) is
attached to this section and is set forth in Exhibit A.
The provisions and responsibilities of the IRC clearly define the expectations and
responsibilities of the Colorado Works in Weld County applicant and recipient for
assistance under the Colorado Works in Weld County Program.
If an applicant refuses to sign an IRC, the applicant shall not receive assistance
and processing of his or her application will cease.

B. IRC for Diversion Programs Only
A client who will be participating the Weld County Grant Division (State
Diversion Program) under Section 6.007 of the Job Retention and Skills Training
Program (County Division Program)under section 6.008 will complete an IRC as
set forth in Exhibit A-2.
6.004.1 Department Responsibilities with the IRC
A. Department staff will explain verbally and in writing the First Section of the IRC.
The Department staff will describe program provisions, participant
responsibilities, and participant rights under the IRC. Department staff will obtain
the necessary signatures of the applicant or recipient and Department staff on the
First Section of the IRC.
B. Department staff will use the Second Section of the IRC to identify steps the
applicants or recipients may need to take which will enhance the recipient's or
applicant's employability. These steps may include addressing mental health,
physical health, drug, and alcohol, or other issues that would limit the recipient or
applicant from participating on work participation activities. The Department
staff will obtain the necessary signatures of the applicant or recipient and
Department staff on the Second Section of the IRC.
C. Department staff will schedule an appointment and send the recipient to
Employment Services. The Department's referral to Employment Services
constitutes a referral of the recipient to employment.
D. Department staff will review all temporarily exempted recipients who are not
engaged in an authorized work activity between a one and three month period for
continued exemption from work participation.
E. Depai fluent staff will reassess recipients who are temporarily exempted from work
participation within three months of the last IRC to determine their readiness to

participate in an employment assessment.
6.004.2 -- Employment Services Responsibilities with the IRC
A. Employment Services' staff will complete an employment assessment that will be
used as the basis of completing the work activity assignment section under the
second section of the IRC. Employment Services' staff will schedule applicants,
unless exempted after the employment assessment, to attend an IRC Skill
Development Seminar.
B. Upon the completion of the IRC Skill Development Seminar, Employment
Services' staff will reassess applicants who have not obtained employment and
have become recipients. Employment Services' staff will determine any
additional work activities and/or supportive services the applicant may need to
obtain or retain unsubsidized employment. This assessment may include

D. The Employment Services' staff will update the Second Section of the IRC, as
appropriate, with the applicant or recipient.
E. If Employment Services' staff identify employment barriers of an applicant or
recipient, the Employment Services' staff, through the IRC, will direct the
applicant or recipient to the Department for the needed additional supportive
services.

6.005 Temporary Good Cause Exemptions from Work Participation
Effective 9/10/97
The Department will exempt individuals receiving or applying for benefits from
_ participation in work or training activities based on individual or family situations.
These exempted people will still qualify under Weld County's work participation rate
6.005.1 Reasons for Temporary Good Cause Exemption from Work Participation
Temporary good cause reasons for exemption from work participation will include but not
be limited to those listed below:
A. Child Care-If child care is not available, the caretaker relative is exempt from
work activities.
B. Transportation - An applicant or a recipient residing at a location too remote for
effective participation in work activities is exempt from participation. The person
must demonstrate that he or she is unable to get to and from the site of a work
activity within a reasonable commuting time or does not have alternative
transportation.
C. Temporary Incapacity-An applicant or a recipient who has an illness or injury
(may include domestic violence)which prevents entry into employment or
training for a temporary period not to exceed three months.
D. Incapacitated Household Member- An applicant or a recipient needed in the
home to care for an incapacitated member of the household.
E. Jobs or Work Sites - If the Department's program does not have available jobs
and work sites,the applicant or recipient is exempted from participation.
F. Relative Care- A non-parent participant who has children living with him or her
for whom out-of-home placement would be necessary if the Department
discontinued the assistance.
6.005.2 Redetermination of Temporary Good Cause Exemptions
The Department will redetermine the recipient's exempt status not to exceed three months,
and possibly sooner, depending on the individual or family situation.
6.005.3 Participant Appeal of Non-Exempt Status Under Temporary Good Cause
Exemptions
The Department will send a notice of adverse action to all applicants and recipients, who
in the opinion of the Department,do not meet the exempt status of temporary good cause.
The Department's process is outlined in Section 6.011.12 of the Department's Operations
Manual.
The participant may appeal his or her nonexempt status under Temporary Good Cause

Exemption(Sections 6.0051 and 6.0053) by following the procedures outlined in Section
6.011.12 of the Department's Operations Manual.

6.006 Work Participation Requirements and Work Activities

6.006.1 Work Participation Requirements
All caretaker relatives with the exception of those caretaker relatives having a temporary
good cause exemption from work participation will be mandatory participants in work
activities.
6.006.12 Job Ready
Job Ready is defined as any Colorado Works in Weld County applicant or recipient who
does not have temporary good cause reasons, as established in the Department's
Operations Manual, that would prevent the applicant or recipient from participating in
- Work, training, or educational activities.
Participants will be determined to be job ready by assessments being completed during
various stages of the application process as previously described in Section 6.003.
6.006.2 Work Activities
A. Applicants and recipients will be referred to full-time or part-time work for wages
that the employer has paid in total. Employment may occur with any public,
profit,nonprofit, or a private employer.
Revised 3/98 B. An applicant or recipient refusing to accept a referral or an actual job offer will be
sanctioned 100% of the family grant for a minimum of one month.
C. All part-time employed participants will be required to seek full-time
employment.
D. Other mandatory participants will be assessed for participation in other work
activities as described in Section 6.006.2.
6.006.21 Work Supplementation Program

An employer may participate in a Work Supplementation Program for clients of the
Colorado Works in Weld County. The Work Supplementation Program is a
private/public sector employment program specifically designed for recipients of the
Colorado Works in Weld County Program as an Employer and as an instructional training
facility.
6.006.211 Work Participation Standard with an Employer
The employer must provide a minimum of three months of unsubsidized, continuous, full
time employment. The employer will provide participants with wages and benefits that
are comparable to other employees doing comparable work and provide liability and
worker's compensation. The employer may provide an additional three months of

continuous, full time employment,to those participants who need additional training to
continue employment with the employer or preparation for employment with another
employer.
6.006.212 Work Supplementation Responsibilities of an Employer
A. Provide participant screening criteria to the Department of Colorado Works in
Weld County participants for initial placement with the employer.
B. Provide a forty-hour work week for the participant that provides for a combination
of work and education.
C. Provide training to the participant in job specifics and mentoring of recipients in
work ethics and employment retention skills for either continued employment_
with the employer or for employment with another employer.
D. Reinforce employer basic skills competencies with the participant through the
Department's prescribed performance evaluations and/or counseling forms.
E. Determine if the training will be provided directly by the employer or through
subcontracts with training provider(s).
F. Furnish all equipment and materials for the participant.
G. Inform the Department within 24 hours when the employer terminates the
Colorado Works in Weld County client and documents its reason(s) for its action.
H. Adhere to certain program assurances provided by the Department.
6.006.213 Work Supplementation Responsibilities of the Department
A. Provide the employer with an orientation session outlining the specific procedures
and policies that the Department requires of the employer.
B. Encourage participants to apply for available positions with the employer and
assess participants to determine their job readiness for positions with the
employer.
C. Arrange for space for the employer to interview applicants referred to the
employer.
D. Refer, if available, the agreed upon number of participants to the employer for
employment.
E. Reimburse the employer a monthly work supplementation fee of 50% of the
participant's gross salary for the month.
F. Reimburse the employer a training allowance bonus on behalf of the participant as
follows:

1. A training allowance bonus of$300 for a participant who is placed in a
three-month Work Supplementation Program. The employer will be
-- reimbursed the total training allowance bonus at the end of the three-
month period not to exceed$300.
2. A training allowance bonus of$300 for a participant who requires an
additional three months of participation in the Work Supplementation
Program. The employer will be reimbursed the total training allowance
bonus at the end of the-three-month period not to exceed$300.
3. A training allowance bonus of$500 for a participant whom the employer
has hired after a successful completion of a three month or six month
work supplementation program and retained in full time employment for
three months.
G. Assist the employer, upon the employer's request, in resolving any possible
disputes with the participant.
H. If the employer terminates a participant, the Department will determine the
eligibility and sanction status of the participant.
I. Complete a Work Supplementation Agreement with the employer. The Work
Supplementation Agreement between an employer and the Department is attached
and is set forth in Exhibit B.
J. Complete a Work Supplementation Participation Agreement with the participant.
The Work Supplementation Participation Agreement between the participant and
the Department is attached and is set forth in Exhibit B.
K. Provide the participant with the appropriate supportive services and work related
expenses.
6.006.214 General Participant Screening Criteria
A. The Department will not refer those participants whom the Department may
directly refer to employment.
B. The Department will refer those participants whom the Department has identified
as having the motivation and aptitude for the Work Supplementation Program
position, as meeting the screening criteria of the employer, and as having certain
barriers as follows:
1. limited or no work experience
2. irrelevant work history, skills, or training, i.e., truck driving training with
DUI issues.
6.006.215 General Requirements for Training

A. The Department will authorize with the employer the training plan for the
participant including training criteria,methods by which the training outcomes

B. The employer may choose to provide this training directly or to provide this
training, through subcontracts,with training providers. Training providers are
defined,but not limited to, as public schools,private non profits,private for
profit,post secondary,community colleges,and proprietary schools.
C. The Department will authorize training-providers in the training areas of:
1. Job Specifics
2. Mentoring of Recipients in Work Ethics and Job Retention Skills
D. To ensure that the job specific and mentoring training meets the local demand of
employers, local private sector employers,through the Weld County Private
Industry Council, will recommend to the Department the authorization of training
plans and training providers.
6.006.22 Work Supplementation Program with Temporary Employment Agencies
A temporary employment agency, as the employer, may participate in a specially designed
Work Supplementation Program for clients of the Colorado Works in Weld County
Program. The Work Supplementation Program is a private sector employment program
specifically designed for Colorado Works in Weld County participants as an employer and
as an instructional training facility.
6.006.221 Work Participation Standard with Temporary Employment Agencies
The temporary employment agency, as an employer, must provide a minimum of three
months of unsubsidized, continuous, full time employment. The temporary employment
agency will provide participants with wages and benefits that are comparable to other
employees doing comparable work and provide liability and worker's compensation. The
temporary employment agency may provide an additional three months of continuous, full
time employment, to those participants who need additional training to continue

Program. The temporary employment agency will be reimbursed the total
training allowance bonus at the end of the three-month period not to
exceed$300.

6.006.23 Public Sector Work Activity
Public.Sector Work Activity is designed to help the near job ready to enter the world of
work,develop occupational skills and good work habits, and help the participant in
obtaining permanent unsubsidized employment. Work sites will be in the public sector.
The Department will enter into agreements with the public work site sponsor and the
participant. These agreements will outline the work activity, expectation from a work site
sponsor and participants and the length of the agreement.
6.006.231 Public Sector Work Activity Agreements
The hours outlined in Public Sector Work Activity Agreements must conform to the Fair
Labor Standards Act. The total dollar amount of the cash assistance will be composed of
basic cash assistance from the Colorado Works in Weld County Program, Food Stamp
assistance and other cash assistance(work incentives, training allowances). The total
dollar amount of cash assistance will be divided by the comparable per hour wage amount
of the client's work activity position to determine the required hours of participation.
Food Stamp recipients will be co-enrolled in the Food Stamp Work Fare Program. Work
Activity Agreements will be established for no more than three months per agreement.
Public Service Work Activity Agreement is Exhibit D.
6.006.232 Optional Training Under the Public Sector Work Activity Agreement
Under the Public Sector Work Activity Agreement, the public sector sponsor may provide
job specific training necessary for the participant to retain or obtain employment.
A. The Department will authorize with the public sector sponsor the training plan for
the participant including training criteria, methods by which the training outcomes
will be measured, duration of the training, and associated costs.
B. The public sector sponsor will provide this training directly or provide this
training, through subcontracts,with training providers.
C. The Department may authorize the job specific training plan and associated costs
not to exceed$1,500.
D. To ensure that the job specific training meets the local demand of employers, local
private sector employers, through the Weld County Private Industry Council, will

recommend to the Department the authorization of training plans and training
providers.
6.006.24 Private Sector Work Activity
Private Sector Work Activity is designed to help the near job ready to enter the world of

amount of the cash assistance will be composed of Colorado Works in Weld County
assistance and food stamp assistance. The Private Sector Work Activity Agreement is
Exhibit E.
6.006.242 Optional Training Under the Private Sector Work Activity Agreement
Under the Private Sector Work Activity Agreement, the private sector sponsor may
provide job specific training necessary for the participant to retain or obtain employment.
A. The Department will authorize with the private sector sponsor the training plan for
the participant including training criteria,methods by which the training outcomes
will be measured, duration of the training, and associated costs.
B. The private sector sponsor will provide this training directly or provide this
training, through subcontracts, with training providers.
C. The Department may authorize the job specific training plan and associated costs
not to exceed 51,500.
D. To ensure that the job specific training meets the local demand of employers, local
private sector employers, through the Weld County Private Industry Council, will
recommend to the Department the authorization of training plans and training
providers.
6.006.25 On-the-Job Training Program
The On-the-Job Training (OJT) Program is designed to teach and/or improve skills of the
participant on the job.
A. Employers must adhere to the hire first philosophy, and train the participant
during the contract period.

B. If an individual needs additional classroom training,beyond the employer
training,the costs of tuition and books will be included as reimbursable costs to
-- the employer from the Colorado Works in Weld County Program or other federal
or state resources.
C. The Department will reimburse the employer for the training costs. The costs and
duration of the off are calculated by determining the Dictionary of Occupational
Titles(DOT)code for the job description and the hourly wage.
6.006.26 IRC Skill Development Seminar(Job Search and Job Readiness Assistance)
Job search and job readiness assistance will be provided through the IRC Skill
Development Seminar. The IRC Skill Development Seminar is an activity that:
A. Screens and assesses an applicant's or recipient's job readiness.
B. Provides for an intensive job search activity during the participant's
application/eligibility process for the Colorado Works in Weld County Program.
C. Results in the completion of the IRC with the participant and assignment to other
authorized work activities.
D. Is up to four weeks.
E. If an applicant is successful in obtaining employment through the activity, the
applicant may not be eligible for cash assistance, or the length of time they
required public assistance may be reduced.
F. If an applicant or recipient is unsuccessful in finding unsubsidized employment,
he or she will be assigned to other authorized work activities and may return to the
IRC Skill Development Seminar later.
6.006.27 Community Service Program
The Department will not implement the Community Service Program at this time.
6.006.28 Vocational Education Training(not to exceed 12 months with respect to any
participant)
The Department will not implement Vocational Education Training at this time.
6.006.29 Job Skills Training
The job skills training gives participants specific job skills training necessary to do a
specific job or a group of jobs.
A. Participant selection for this work activity will be based on assessment,
availability of employment in the skill area, the probability of receiving a self-
sufficient wage when employed, and the participant's interest in completing
•
Colorado Works in Weld County and Child Care Policies and Procedures
training.
B. Guidelines in developing or approving specific job skills training are as follows:
1. Tailored toward employer needs.
2. In line with the skills, aptitudes and interests of the participant.
3. Geared toward entry level employment,if appropriate.
4. Not exceed twelve months with respect to any participant.
5. Use-labor market projects, such as the Supply/Demand Report, in,
determining training areas. -
C. To ensure that the job skills training areas are in demand, local employers will
help in the determination of specific training. Employers are involved initially to
ensure-that training efforts result in actual jobs,-and these jobs are available in the
Weld County labor market or in an area where the participant is willing to
relocate.
6.006.30 Education Directly Related to Employment(for a participant who has not received a
high school diploma or a certificate of high school equivalency)
Education will be provided for those participants who have not received a high school
diploma or a certificate of high school equivalency.
A. The participant must maintain satisfactory attendance, as defined by the
Department, at the Employment Services computer laboratory, Aims Community
College, or other accredited schools to achieve a GED or high school diploma.
B. The work activity must meet the work participation requirement.
6.006.31 Secondary School or Equivalent Education
Secondary school or equivalent education will be available to those participants who are
the head of household and have not attained twenty years of age.
A. The participant must maintain satisfactory attendance, as defined by the
Department,at a secondary school or its equivalent.
B. This work activity must meet the work participation requirement.
6.00632 County Designed Occupational Skills Training Program(not to exceed twelve months
with respect to any participant)
Pursuant to Section 3.6214 of the proposed rules of the Colorado Department of Human
Services, Weld County has chosen to develop another work activity that will lead the
participant to self sufficiency. The Individual Responsibility Contract will detail activity
designed to comply with the requirements of the program. Program requirements are as
follows:
A. The County Designed Occupational Skills Training Program is a short-term
Colorado Works in Weld County and Child Care Policies and Procedures
educational activity intended to prepare an individual-for employment:The
Program will not exceed twelve(12)months of continuous participation with
respect to any individual. Providers of this training include,but are not limited to,
community colleges,proprietary schools and nonprofit organizations.
B. Post secondary education will not be an allowable work activity for all new
applicants to the Colorado Works in Weld County Program effective July 1, 1997.
C. Post secondary education will be an allowable work activity for a recipient who is
already enrolled in or attending a post secondary or self-initiated education or
training at the time she or he would otherwise commence participation in the
Colorado Works in Weld County Program and meets the criteria of a recipient
•
who:
1. is receiving Aid to Families of Dependent Children or Aid to Families of
Unemployed Heads of Households as of June 30, 1997; and
2. is undergoing an assessment under the Colorado Works in Weld County
Program in Weld County before October 31, 1997, and
3. has a cumulative GPA of 2.5 or above as demonstrated by transcripts; and
4. has physically attended,within the previous twelve month period, at least
two semesters out of the last three semesters of a university schedule or
three quarters out of the last four quarters of a community college
schedule as demonstrated by transcripts; and
5. is enrolled in full-time training as defined as follows:
a. Secondary school attendance (includes cooperative training
programs) of twenty-five clock hours per week or as defined by
the school; or
b. Vocational or technical school attendance of twenty-five clock
hours per week, thirty(30) in a program involving shop practice;
6. is enrolled in education that is in a demand occupational area leading to
employment upon completion of the degree as determined by the
Employment Services of Weld County; and
7. will finish a degree within a one year period from the date established in
the Individual Responsibility Contract; and
8. is not in a master or doctorate degree program.
D. Recipients enrolled in the County Designed Occupational Skills Program must
maintain an acceptable level of performance, which shall be detailed in the
Individual Responsibility Contract. To achieve an acceptable level of
performance, as measured by semester or quarter, the recipient must:

1 maintain a GPA of 2.5 or above as demonstrated by transcripts; and
2. physically attend post secondary education by continuous attendance at
school with no semester or quarter interruptions in a year period; and
3. maintain full-time enrollment.
6.006.33 Other Work Activities as Approved and Authorized
Added 12/98 -
Individuals who are not capable, as determined by the case manager, of participating in
work activities as defined in Sections 6.006.1 through 6.006.32 of the Colorado Works in
Weld County Child Care Policies and Procedures may also be considered as engaged in
work activities and meeting the 24-month federal work requirement if they are actively
participating in one of the activities listed below which are designed to lead to self-
sufficiency. The work activity must be stated in the current IRC and be approved by the
case manager and his/her supervisor. The individual must participate in the work activity
for the number of hours identified in the IRC and demonstrate achievement in accordance
with the objectives stated in the IRC. The case manager(with authorization from the
supervisor)will not allow participants to continue in these activities longer than three
months without a re-assessment of their capabilities.
A. Receive counseling for mental health, substance abuse or domestic violence by an
approved counselor and as approved the case manager and specified in the IRC.
B. Fully participate in a medical treatment plan for a verified illness of participant or
family member and as approved by the case manager and specified in the IRC.
C. Fully participate in activities to resolve court related child welfare issues as
approved by the case manager and specified in the IRC.
D. Fully participate in activities designed to resolve family crisis as approved by the
case manager and specified in the IRC. These activities may include family
counseling mediation, etc.
E. Fully participate in self-improvement classes; i.e., self-esteem, life skills, etc., as
approved by the case manager and specified in the IRC.
F. Providing home schooling, as certified by the local school district, to a disabled
child. The Colorado Works in Weld County participant must be the caretaker
relative for the disabled child and the activity must be approved by the case
manager.
G. Other activities designed to prepare the individuals for self-sufficiency, as
approved by the case manager and that are specified in the IRC.

6.007 Weld County Grant Diversion Program(State Grant Diversion Program)

Revised 12/98_- The purpose of the Weld County Grant Diversion Program is to offer an alternative to
participants who are eligible for Colorado Works in Weld County Program,but could
avoid the need of such cash assistance if the Department granted the recipient assistance in
•
another form,in either a monthly payment or a "lump sum"payment. The Department
will comply with the general guidelines established by the Colorado Department of
Human Services and outlined in Section 3.602,Volume III,Income Maintenance
Programs.
6.007.1 Client Assessment
The Department will assess a client who requests a Grant Diversion Payment as follows:
A. Determine the client's eligibility for the Colorado Works in Weld County
Program.
B. Identify the level of monthly benefits the client is eligible to receive.
C. Identify any special conditions attached to the eligibility determination of the
client.
6.007.2 Payment Limit and Types of Payments

The client may be eligible for payments,not to exceed$3,300 for a family unit per year, as
follows:
A. Vision correction necessary for employment-related activity.
B. Tools necessary for employment-related activity.
C Cost of repair of a vehicle to enable transportation to employment-related activity.
D. Clothing/Grooming necessary for employment-related activity.
E. One-way transportation and/or moving expense assistance to relocate to site of
new employment.
6.007.3 Pre-Authorization Information
For each client,preauthorization information shall be considered by the authorizing
Department supervisor, in determining if a payment should be provided and the amount of
payment to the client. This preauthorization information must justify such cash assistance
to secure or maintain employment. The authorizing Depaitalent supervisor shall consider
the client's information as follows:
A. A potential employer must verify an employment opportunity in writing.
B. A client must demonstrate that he or she has the opportunity, willingness and
ability to participate in work-related activity.

• C. A client must demonstrate qualifications or minimum screening criteria for the
employment-related activity.
D. A client does not have major supportive service issues or bathers that would
prohibit his or her success in securing or maintaining employment and result in
long-term dependency on Colorado Works in Weld County cash assistance.
6.007.4 Authorization of Payment under the Individual Responsibility Contract and
Limitations -
The client may receive a cash assistance payment if the Department provides it under the
Individual Responsibility Contract.A payment cannot exceed$1,650 for a family unit per
year. The authorizing Department supervisor will use the Department's schedule in
calculating or authorizing payment; however,the authorizing Department supervisor may
request an exception by the Director. The Director may authorize such exception in
writing.
A. Vision Assistance- $175.00 per Client
B Tools - $200.00 per Client
C. Repair of a vehicle - $300.00 per Participant.
D. Clothing/Grooming - $150.00 per Participant.
E. Transportation/moving assistance-$800 per Participant.
6.007.5 Eligibility Waiver Period for Colorado Works in Weld County Assistance
Clients receiving Grant Diversion Assistance shall agree to waive eligibility for Colorado
Works in Weld County assistance payments for a period specified in the Individual
Responsibility Contract. The duration of the waiver is negotiable between the client's
assigned Department staff member, the authorizing Department supervisor, and the client.
The duration of the waiver should generally be calculated by dividing the grant diversion
payment by the client's monthly grant assistance amount.
6.007.6 Authorized Payee
Grant diversion payments will be made payable to the vendor providing the product or
service,not the client. The Department Director must authorize any exception to this
provision in writing. Exceptions should be considered extremely rare and will only be
authorized upon full demonstration that all other available options have been explored and
determined to be unfeasible.
6.007.7 Submission of Payment
The Department's Business Office will generate payment for the grant diversion payment
once each of the following procedural steps is completed:

A. The Department's Eligibility Technician submits the Individual Responsibility
Contract to the authorizing Department supervisor for signature of authorization.
B. The authorizing Department supervisor reviews the Individual Responsibility
Contract for thoroughness,accuracy and reasonableness. If a contract meets
standards,the Supervisor signs contract authorizing purchase of product or
service.
C. The Business Office returns the Individual Responsibility Contract to the
Eligibility Technician who coordinates with a provider or providers to purchase
the product or service.
6.007.8 Vendor Accepts Voucher Payments
If a vendor accepts vouchers from the Department, the Eligibility Technician issues a
voucher to the client specifying:
A. The vendor from whom product or service is to be purchased,
B. The maximum dollar amount authorized for payment, and
C. The expiration date of the voucher. This date shall be a period of from one day to
one month, depending on the type of assistance being provided and the
circumstances of the case.
6.007.9 Vendor Does Not Accept Voucher Payments
If a vendor does not accept vouchers from the Department, the Eligibility Technician
requests that the vendor issue an invoice to the Department. This invoice must include the
following information:
A. The name of the client being served.
B. The specific products and/or services being provided.
C. Detailed breakdown of the price of each product and/or service being provided.
D. Total amount of payment requested.
E. Acknowledgment of the vendor that the Department is exempted from Colorado
State Sales Tax requirements.
6.007.10 Responsibility of the Department's Eligibility Technician
The Eligibility Technician submits copy of an authorized Individual Responsibility
Contract and either the Invoice from Vendor, authorized for payment, or copy of Voucher
to the Business Office for payment.

6.007.11 Responsibility of the Department's Business Office
.. The Business Office will pay for grant diversion payments according to a predefined
payment time schedule,which they shall make available to the authorizing Department
supervisor. Any request for payment in advance of a payment time schedule must be
authorized in writing by the Department's Director. Exceptions should be considered
extremely rare and will only be authorized upon full demonstration that they have
explored and determined all other available options to be unfeasible.

6.008 Job Retention and Skills Training Program(County Diversion Program)

The Department will conduct or implement a County Diversion Program through
the Job Retention and Skills Training Program.
6.008.1 Eligible Participants
Revised 7/1/98
Eligible participants of the Job Retention and Skills Training Program will be
those individuals who:
A. were hired by an employer in unsubsidized, continuous, and full-time
employment prior to final eligibility determination of the Colorado Works
in Weld County Program. Application for Colorado Works must have
been-made within the past twelve months; or
B. were recipients who terminated their participation from the Colorado
Works in Weld County Program within the past twelve months; and
C. have a present income of below 185% of the poverty level for their
household size; and
D. request job retention supportive services within one year of termination of
financial assistance in the Colorado Works in Weld County Program and
whose termination from the Colorado Works in Weld County Program is a
result of employment.
6.008.2 General Requirements for Training
A. Under the Job Retention and Skills Development Agreement, the employer
may participate in the program as follows:
1. For an initial three month period, the employer may train his or her
employee in, but not limited to, mentoring services for purposes of
job retention,job specific training, basic skills development,
English as a Second Language, necessary for the participant to
retain or obtain employment.
2. An additional three month period may be authorized by the
Department, if the employee requires additional training in, but not
limited to, mentoring services for purposes of job retention,job
specific skills, basic skills development, English as Second
Language, necessary for the employee to retain or obtain
employment.
3. If at the end of the initial three month period or at the end of the
Colorado Works in Weld County and Child Care Policies and Procedures
additional three month period, the employer is eligible for an
additional six month training period for the employee who the
employer promotes and gives a salary increase.
B. The Department will authorize with the employer the training plan for the
participant including training criteria, methods by which the training
outcomes will be measured, and associated costs.
C. The employer may choose to provide this training directly or to provide
this training,through subcontracts, with training providers. Training
providers are defined,but not limited to, as public schools,private non
profits, private for profit, post secondary, community colleges, and
proprietary schools.
D. The Department will authorize training providers in the training areas
identified by the employer.
E. To ensure that the job specific and mentoring training meets the local
demand of employers, local private sector employers, through the Weld
County Private Industry Council, will recommend to the Department the
authorization of training plans and training providers.
C. The Department may authorize the job specific training plan and
associated costs not to exceed $1,800 as follows:
1. A training allowance bonus of$300 to be reimbursed at the end of
the initial three month period.
2. A training allowance bonus of$300 to be reimbursed at the end of
the additional three month period.
3. A training allowance bonus of$500 for the employee whom the
employer promoted and successfully completed the initial three
month period and, if applicable, an additional three month period
of training. This training allowance bonus will be reimbursed at
the end of a three month period.
4. An additional training allowance bonus of$500 for the employee
whom the employer promoted and continues his or her training.
This training allowance bonus will be reimbursed at the end of a
three month period.

6.0083 General Requirements for Supportive Services Needed for Job.Retention

The Department will assess a client who requests Job Retention Support Services as
follows:
A. ' Determine the client's financial eligibility for Job Retention Supportive Services.
Revised 12/98 B. Identify the level of benefit the individual is in need of and eligible.for. The
benefit level cannot exceed$1,650 per family assistance unit the first six months
for Job Retention Support Services and an additional $1,650 in the second six
months of eligibility.
C. Clients receiving Job Retention Supportive Services shall agree to waive
eligibility for Colorado Works in Weld County assistance payments for a period
specified in the Individual Responsibility Contract. The duration of the waiver is
nogitiable between the client's assigned Department staff member, the authorizing
superivsor, and the client. The duration of the waiver should generally be
calculated by dividing the grant diversion payment by the client's monthly grant
assistance amount.

6.009 Participant Sanctions or other Assistance and Separate County Diversion

6.010 Supportive Services (non-Child Care)
Effective 9/10/97
The Department's case managers will arrange supportive services for the participant, as
appropriate. Participation related expenses and supportive services are those expenses and
services determined necessary by the case manager for an individual to participate in any
Colorado Works in Weld County work component and/or activity. Supportive services
will be provided for the participant engaged in an activity that is part of his or her
Individual Responsibility Contract.
6.010.1 Transportation
Those transportation costs necessary and directly related to Colorado Works in Weld
County work and/or training component participation shall be made according to the
individual's situations:
A. Calculated at .20 cents per mile; or
B. A flat daily rate of$2.00 may be provided.
6.010.2 Participation Related Services
Other participation related expenses and supportive services may include but are not
limited to,clothing, uniforms,eyeglasses,dental work,tools, auto repairs, dues and fees,
and also licensing exams, such as RN,LPN, electrician, and self improvement classes.
6.010.3 Start to Work Support Services
Start to work support is specific expenses determined necessary by the case manager for a
Colorado Works in Weld County participant to accept or maintain employment. Start to
work support may include but not be limited to clothing, uniforms,eyeglasses, medical
and dental needs,tools, auto repairs, relocation costs, dues and fees. The total
expenditure for start to work expenses may not exceed $300.00 per work activity or
employment. Each individual may access start to work support services once each twelve
month period, unless authorizied in writing by the Director.
6.010.4 Supportive Services Expenditure Limit
Added 7/1/98
The total expenditures for participation related expenses and supportive services
may not exceed $1,000.00 per participant in a 12-month period. The 12-month
period begins with the month in which the first payment is made for the Colorado
Works in Weld County participant. Transportation allowances paid to individuals
in Public or Private Work Experience assignments do not count against this
$1,000.00.
6.010.5 Participant Criteria to Receive Supportive Services
A Colorado Works in Weld County recipient or applicant must be maintaining an
acceptable level of performance as outlined in the IRC. Acceptable level of
performance is demonstrated progress with the employment or educational facility
requirements.

6011 Participant Sanctions and Appeals

6.011.1 Participant Sanctions
6.011.11 Definition of Sanctions
Sanctions against assistance participants shall include the following.
A. Failure to cooperate with child support enforcement,to comply with IRC
requirements,or to secure proper immunizations for children shall result in a loss
of 25% of the family's cash benefit for the first sanction, a 50% loss for the
second sanction, and a loss of the entire cash benefit for the third sanction. Each
sanction shall follow immediately after the previous. The first and second
sanctions shall extend for a period of 30 days each. The third sanction shall
extend for a minimum of 90 days and until the reasons for the sanction are cured.
B. Conviction of fraud as determined by a court or through administrative hearing
shall result in the caretaker being removed from assistance for a 12-month period
for the first offense, twenty-four months for the second offense, and lifetime for
the third offense.
C. Assistance shall be denied for ten years to any individual who has been convicted
by a court for misrepresenting his or her residence in order to obtain assistance in
two states at the same time.
Revised 3/98 D. Refusal to participate in training,education, or work as evidenced by an
affirmative statement by the participant or demonstrable evidence, may result in
denial or termination of the basic cash assistance grant in its entirety for a
minimum or one month. The Department's referral of an applicant or recipient to
Employment Services is a referral to employment.
6.011.12 Notice of Proposed Applicant or Recipient Sanction
A notice of proposed sanction shall be sent to any applicant or participant for whom there
is a reasonable suspicion that his or her actions or inactions come within at least one of the
categories described in Section 6.011.11 of the Department's Operations Manual. This
notice shall:

Department of Human Services Volume III regulations,3.830.2.
B. Advise the applicant/participant of the opportunity for a local level dispute
resolution conference where he or she may present his or her side of the story.
C. Advise the applicant/participant that failure to respond to the notice may result in
a reduction or termination of the family's cash benefits or continued processing of
his or her application.
Revised 8/4/98 The Department's notice of proposed sanction consists of the Colorado Department
of Human Services Notice of Proposed Sanction. The Notice of Proposed Sanction
is included in Exhibit H. The Notice of Proposed Sanction shall be issued prior to a
Colorado Works in Weld County and Child Care Policies and Procedures
loss of 25% of the family's cash benefit for the first sanction,a 50% loss for the
second sanction,and a loss of the entire cash benefit for the third sanction. Each
sanction shall follow immediatately after the previous. The first and second
sanctions shall extend for a period of 30 days each. The third sanction shall extend
for a minimum of 90 days and until the reasons for the sanction are cured.
6.011.2 Absences or Late Occurrences of Participants in Work Supplementation Programs,
On-the-Job Training Program,and the Job Retention and Skills Training Program
Colorado Works in Weld County Program participants who are participants of Work
Supplementation Programs, On-the-Job Training Program, and the Job Retention and
Skills Training Program, are expected to adhere to the employer's policies and procedures
concerning absences and late occurrences to work. Participants who do not observe
absence and late occurrence policies of the employer will be failing to participate in work
activities.
6.011.3 Absences From or Late Occurrences to Other Work Activities or Scheduled
Appointments
Colorado Works in Weld County participants of the other work activities are expected
actively to participate in all assigned work activities and to attend all scheduled
appointments. These other work activities include: public sector work activity, private
sector work activity, IRC Skill Development Seminar,Job Skills Training, Education
Directly Related to Employment, Secondary School or Equivalent Education, or County
Designed Occupational Skills Training.
Clients who do not observe absence and late occurrence policies of Section 6.011.3 of the
Department's Operations Manual will be failing to participate in work activities. The
client's failure to observe absence and late occurrence policies is considered an unexcused
absence that will result in a sanction. -,
6.011.31 Late Occurrences to Work Activities and Scheduled Appointments
A. Colorado Works in Weld County participant responsibilities are as follows:
1. Telephone the appropriate Colorado Works in Weld County staff or
contractor staff if the client expects to be late.
2. Telephone at least fifteen minutes before the start time of the client's
assigned work activity.
B. Clients who are more than one hour late and do not telephone the appropriate
Colorado Works in Weld County staff or contractor staff will be considered as
absent.
C. During the first six months of work activity participation, the Department may
allow the client a maximum of three late occurrences during any work activity
participation.
D. After the first six months of work activity participation, the Department may allow
the client one late occurrence in work activity participation.

6.011.32 Absences from Work Activities and Scheduled Appointments
A. During the first six months of work activity participation,the Department may
allow the client a maximum of three excused absences during any work activity
participation.
B. After the first six months of work activity participation,the Department may allow
the client two excused absences during any work activity participation.
C. Excused absences are defined as follows:
1. Jury Duty: Jury duty will be an excused absence if the client presents
verification to the appropriate Colorado Works in Weld County staff
member before the time jury duty will start. The Department will require
that the client provide verification from the court that he or she was
present for jury selection. Jury duty time will not count against the total
excused absences.
2. Child(ren) School Registration: A child(ren)school registration will be
considered an excused absence if the client arranges the absence with the
appropriate Colorado Works in Weld County staff member before being
absent from a work activity or work activity appointment.
3. Inclement Weather: If the Department determines that the client is unable
to attend a work activity due to inclement weather, the Department will
excuse the absence. Generally, if city buses are transporting individuals
or Weld County is open for business,the Department will not consider
that day to be an inclement weather day.
4. Appointments for Food Stamp Redetermination: The client's
appointments for food stamp redetermination will be considered an
excused absence if the client notifies the appropriate Colorado Works in
Weld County staff member 48 hours in advance and provides proof of
attendance.
5. Sick Day Absence: During any eight(8)week period,the Department will
allow the client a total of two(2) sick day absences for him or her and for
a member of his or her immediate family. A sick day absence may be
used for:
a. A scheduled doctor's appointment. The client must notify the
appropriate Colorado Works in Weld County staff member 48
hours ahead of the start day of work activity.
b. An emergency sick day. The client must notify the appropriate
Colorado Works in Weld County staff member no later than 8:30
a.m.on the day the absence will occur.
c. Serious illness. The Department will allow the client one
additional sick day if the client or a member of the client's
immediate family has a serious illness. The client must notify the
appropriate Colorado Works in Weld County staff member no
later than 8:30 a.m. on the day the absence will occur. If the
client or his or her immediate family member is sick for three(3)
Colorado Works in Weld County and Child Care Policies and Procedures
consecutive days, a physician's excuse for the days missed is
required. The client must notify the appropriate Colorado Works
in Weld County staff member no later than 8:30 a.m. on each day
the absence will occur.
d. Court Absence: During any two-month period,the Department
will allow the client a total of one(1)court day. The client must
notify the appropriate Colorado Works in Weld County staff
member at least one week before the date of absence.
e. Emergency Absence: During any two-month period,the
Department will allow the client one(1) emergency day. The
Department may allow the client, subject to the approval of the
appropriate Colorado Works in Weld County staff member, an
emergency absence for the purposes of:
I) transportation problems if the client lives outside the
Greeley Bus System
2) child care problems if the client is not a member of a two
parent family who has a non-working spouse.
3) eviction from housing problems if the client is not a
member of a two parent family who has a non-working
spouse.
4) funeral of a member of the client's immediate family.
6.01133 Definition of Immediate Family for Purposes of Section 6.00113
A client's immediate family means a client's husband or wife, son, daughter, stepson,
stepdaughter, father, mother, stepfather, stepmother,brother, sister, father-in-law, mother-
in-law, grandmother, grandfather, grandchild, foster child(ren), or foster parent.
6.011.4 Participant Appeals
Revised 8/4198 A. The Department will adhere to the general policies of participant appeals as
outlined in Colorado State Rules, Volume III, Section 3.600, Income
Maintenance Programs.
B. The Department will send a notice of adverse action to all applicants and
recipients,who in the opinion of the Department, have failed to comply with the
terms outlined in their individual responsibility contact. The notice will advise the
applicant or participant of the opportunity to present evidence that good cause
reasons existed for their noncompliance with the IRC. The notice will also advise
the applicant or recipient that failure to respond to the notice of adverse action and
present good cause evidence will constitute willful and demonstrable evidence of
refusal to cooperate or participate in training, education, work, child support
enforcement, and/or immunization of children, and result in discontinuation or
denial of the entire cash assistance grant.
C. If the applicant or recipient refuses,either by demonstrated evidence or by an
affirmative statement,the Department may deny or terminate the basic cash
assistance grant in its entirety as determined by the county.
D. If the applicant or recipient responds to the notice of adverse action and presents
evidence that, in the opinion of the Department, does not constitute good cause for
Colorado Works in Weld County and Child Care Policies and Procedures
failure to participate, a 25% sanction will be initiated for the first month, 50%the
second month, and the entire cash assistance grant for the third month and will
continue until they resolve the sanction.

6.012.1 General Organization
The organization of Colorado Works in Weld County involves two major county
departments and an advisory committee as follows:
A. The Weld County Department of Social Services(Department)
B. The Weld County Division of Human Services(Human Services)on behalf of
Employment Services of Weld County(Employment Services)
C. The Weld County Private Industry Council,an advisory committee to the Board
of Weld County Commissioners, as the Board of Social Services, and Human
Services.
6.012.2 Joint Functions of the Department and the Employment Services
A. Develop, plan, and amend the Department's Operations Manual as it relates to the
Colorado Works in Weld County Program.
B. Develop, plan, and amend procedures, guidelines, principles, and policies for
program operations to be approved by the Board of Social Services.
C. Provide case management services for Colorado Works in Weld County
participants as described in the Department's Operations Manual procedures, as
amended.
D. Prepare and provide client tracking and the monitoring of participant, program,
goals, and program outcomes to assure that the Department meets the intent of the
law and the Department is using resources for the maximum benefit of the client.
E. Participate in the dispute resolution conferences with participants.
F. Meet the monthly average participation rates as described in the Department's
Operations Manual, as amended.
G. Provide a public record of the resources devoted, activities undertaken, and
performance achieved for the benefit of the Board of Weld County
Commissioners,funding sources,the Weld County Private Industry Council, local
citizenry, and taxpayers.
6.012.3 Functions of the Department
A. Provide overall program administration of the Colorado Works in Weld County
Program, as outlined in Public Law 100-485 and 9CCR 2503-1, Section 3.630.
B. Implement actions involving Colorado Works in Weld County recipients,
including:
1. Determination of Colorado Works in Weld County eligibility
Colorado Works in Weld County and Child Care Policies and Procedures
2. Determination of exemption status
3. Determination and application of sanctions
4. Providing notices of action affecting eligibility and payment
5. Providing dispute resolution conferences and final agency action
C. Initially assess through Social Services case managers, supportive service needs
and provide child care for those Colorado Works in Weld County participants
who need such services to participate in the Colorado Works in Weld County
Program. Coordinate with Employment Services to provide supportive services as
needed in order to remain in Colorado Works in Weld County Program and
remain in compliance with State regulations.
D. Refer Colorado Works in Weld County applicants and recipients to Employment
Services for employability assessment; assignments of works activity
participation; and ongoing Colorado Works in Weld County component
participation.
E. Participate in joint planning, program development, monitoring and
implementation of Colorado Works in Weld County, Employment First, and other
related employment and training programs for Colorado Works in Weld County
applicants and recipients with Employment Services.
F. Provide training to Employment Services in the operation of Colorado Works in
Weld County and related activities through the Colorado Department of Human
Services and other appropriate training sources, as applicable.
G. The Department shall establish billing procedures and reimburse Employment
Services for actual, reasonable, and necessary expenses incurred in providing
services pursuant to Section 6.012.6.
H. Provide the initial information and orientation materials for Colorado Works in
Weld County participants as prescribed through 9CCR 2503-1, Section 3.634.13.
6.012.4 Functions of Employment Services
A. Prepare employability assessment of Colorado Works in Weld County applicants
and recipients including participation barriers for purposes of the individual
responsibility contract and assignment to Colorado Works in Weld County work
activities.
B. Develop, monitor, and direct mandatory and optional work activities as described
in 9CCR 2503-1, Sections 3.600,and the Weld County Department of Social
Services Operations Manual.
C. Complete all necessary client, employer, or work site agreements and related
paperwork for Colorado Works in Weld County work activities.
D. Determine the time and dates for scheduling employability assessment so the
Department may refer Colorado Works in Weld County applicants and recipients
to Employment Services.
E. Assess and recommend additional supportive services for Colorado Works in
Colorado Works in Weld County and Child Care Policies and Procedures
Weld County participants to continue in Colorado Works in Weld County
activities or employment. Notify Department case managers of supportive service
referrals.
F. Approve work activities based on the aptitude, skills, and background of the
client, and labor market demand. Amend the Individual Responsibility Contract
with the client.
G. Determine if the Colorado Works in Weld County participant is satisfactorily
progressing in work activities through progress described in the Basic Work Skills
Development Report,adherence to time and attendance policies, and other
policies and procedures of the Colorado Works in Weld County Program.
H. Provide an itemized statement of expenditure and request for payment of any
services provided to a Colorado Works in Weld County participant. This itemized
statement would include, but not limited to,any expense incurred for the
Employment Services learning laboratory, Mini-Bus transportation, and testing.
This itemized statement must be submitted by the 15th of the following month
that the service was provided to the Department. The client information on the
itemized statement must include cost, COIN State ID, and COIN household
number.
I. Provide proper invoices and verification of services performed by Employment
Services for costs incurred in the performance of Employment Services as
described in Section 6.012.6.

6.014.1 Client Eligibility
Effective July 1, 1997, families whose income does not exceed 155%of poverty level will
be eligible for child care under the Colorado Works in Weld County Program.
6.014.2 Child Care Provider Rates

The Department pays registration, activity, and transportation fees only to licensed child
care facilities. Providers must also charge private-pay families these same fees if they are
going to charge the Department of Social Services.
6.014.31 Absences
Added 3/98
Absences are paid to licensed providers only. Payment will be made for three days
absence to hold a child's slot when the child is not in care. More than three absences may
be approved and paid for verifiable medical reasons provided by the client.
Holidays are paid to licensed providers only. The following holidays will be paid as billed
by the provider: New Year's Day, Memorial Day, Independence Day, Labor Day,
Thanksgiving Day, and Christmas Day.
Payment will be made for a maximum of 30 days to hold a child's slot when a parent is
between eligible activities. This does not include payment when adult students are on
summer break. Providers must have prior approval from the child care worker before
agreeing to hold a slot.
6.014.32 Registration,Activity, and Transportation Fee

The registration, activity, and transportation fees are combined into one daily rate with the
child care fee. Registration, activity, and transportation fees are pro-rated daily and
combined with the daily provider Child Care rate. An activity fee may not exceed 36
cents per day. A transportation fee may not exceed $1.88 per day. Effective May 1, 1998.

6.008.3 General Requirements for Supportive Services Needed for Job Retention

The Department will assess a client who requests Job Retention Support Services
as follows:
A. Determine the client's financial eligibility for Job Retention Supportive
Services.
B. Identify the level of benefit the individual is in need of and eligible for.
The benefit level cannot exceed $1,650.00 in any twelve month period per
family assistance unit.
C. Clients receiving Job Retention Supportive Services shall agree to waive
eligibility for Colorado Works in Weld County assistance payments for a
period specified in the Individual Responsibility Contract. The duration of
the waiver is nogitiable between the client's assigned Department staff
member, the authorizing superivsor, and the client. The duration of the
waiver should generally be calculated by dividing the grant diversion
payment by the client's monthly grant assistance amount.

6.017 Social Services Division Interface

6.017.1 Procedures
A. Cases currently open on AFDC will be checked on the CATS system and the
caseworker will be contacted. A meeting between the Colorado Works in Weld
County case manager,the caseworker and the participant will occur when
possible. If the Department cannot arrange this, the case manager and the
caseworker will share information regarding the case to help in the development
of the participant's Individual Responsibility Contract(IRC).
B. For new applicants for Colorado Works in Weld County, the Colorado Works in
Weld County screener will fill out an internal 810 form. Master file staff will use
the form to:
1. determine the status of the case in CATS.
2. if the case is an open protection case, the Master file staff will write this
on the form for the case manager.
C. The case manager will then contact the caseworker. Together they can begin
discussing the participant's needs and arrange to meet with the participant to
develop the IRC.
C. When the Department receives a referral regarding a protection issue, the
protection screener will contact the Master File unit to see if there is a Colorado
Works in Weld County case manager on the case. If there is an active Colorado
Works in Weld County case, the caseworker will contact the case manager to
discuss the participant's IRC and to share information regarding the participant's
needs.
D. When a caseworker is considering offering special economic assistance services to
a participant, the caseworker will contact the Colorado Works in Weld County
case manager first to discuss whether the participant is already receiving Colorado
Works in Weld County money for the same purpose. The Colorado Works in
Weld County case manager will prepare a voucher to purchase special economic
assistance services through the Department's voucher process.
E If the Colorado Works in Weld County case manager encounters a situation of a
noncompliance with a participant who is also open with a caseworker, the case
manager will contact the caseworker before sending the notice of a sanction.
They can discuss any extenuating circumstances that could lead to the IRC being
redone rather than the sanction being imposed.
F. Changes in the participant's circumstances, i.e., financial situation, family
situations, etc. will be shared between the case managers and the caseworkers to
facilitate appropriate planning for the family.
G. The caseworker will determine if the participant requires services under the
Family Preservation Program core services, Special Circumstance Day Care
Colorado Works in Weld County and Child Care Policies and Procedures
services,or Case Services. If the caseworker determines with the Colorado Works
in Weld County case manager that the participant requires these services,the
Colorado Works in Weld County case manager will prepare a voucher to purchase
such services through the Department's voucher process.

6.918 Child Support Interface

6.018.1 Individual Responsibility Contract
For those households that involve an absent parent, the Department will require clients to
cooperate with the Child Support Unit as follows:
A. Provide complete and accurate information
B. Provide the full name of the non-custodial parent
C. Appear upon request to sign legal documents
D. Appear at court hearings
E. Provide copies of birth and legal documents
F. Update any new information about the non-custodial parent
G. Submit to genetic testing
H. Assign the family's rights to all child support, including past due and current
support,to the State of Colorado. This provision became effective July I, 1997,
and applies to those Colorado Works in Weld County applicants and recipients
receiving child support payments.
6.018.2 Child Support Payments
On or about October 1, 1997, a Colorado Works in Weld County applicant or recipient
may choose not to receive child support payments if current child support payments
received are more than Colorado Works in Weld County benefits paid to the applicant or
recipient. The applicant or recipient can only receive the child support payment if the
client is no longer receiving Colorado Works in Weld County benefits.
Effective July 1, 1997, the Colorado Works in Weld County applicant or recipient are not
imposed a $50 disregard payment by the Department.
6.018.3 Child Support Assessment
The child support enforcement worker will obtain appropriate information from the
applicant and will provide documentation of cooperation to the Colorado Works in Weld
County Unit. Included in the document will be an assessment regarding the probability of
collecting support,prioritization of the case, approximate time frames to collect support,
and case assignment to be used as a tool for the Colorado Works in Weld County case
manager.

6.019 Weld County Housing Authority Interface

6.019.1 Client Preferences for the Weld County Housing Authority Section 8 Program
Applicants who can demonstrate that they are employed at least 20 hours per week during
nine out of the last 12 months shall receive preference for admission through Weld County
Housing Authority's Section 8 Rental Assistance Payments Program.
6.019.2 Participation and Notification
The Weld County Housing Authority Community Services Specialist will notify the
Colorado Works in Weld County case manager whenever an applicant receiving Colorado
Works in Weld County benefits is approved for the Section 8 Program. When the
Community Services Manager becomes aware that a Section 8 participant receiving
Colorado Works in Weld County benefits is terminated from employment, the Community
Services Manager shall notify the Colorado Works in Weld County case manager.
6.019.3 Family Self-Sufficiency Program (FSS)
Section 8 participants who are participating in FSS shall sign a Family Self-Sufficiency
Contract. The Family Self-sufficiency Contract shall specify goals agreed to by the
Section 8 participant to achieve self-sufficiency within a five year period. Case
management services for any Section 8 participant who is also participating in Colorado
Works in Weld County shall be provided by the Colorado Works in Weld County case
manager, not the Community Services Manager.
6.019.4 Sanctions and Appeals
The Department shall terminate participants of the Colorado Works in Weld County
Program, who:
A. are enrolled in the Section 8 Family Self-sufficiency Program, and
B. fail to cooperate with Colorado Works in Weld County requirements and the
Section 8 Housing Assistance Program.
Each participant the Department terminates, based on failure to comply with FSS and
Colorado Works in Weld County requirements, shall have the right to a hearing based on
the Section 8 Administrative Plan.

WORK SUPPLEMENTATION AGREEMENT

hereinafter referred to as"Employment Services,"and,
hereinafter referred to as"Employer."
WITNESSETH
WHEREAS,Employment Services conducts the employment and training program for eligible
recipients of the Colorado Works in Weld County Program; and
WHEREAS, Employment Services' goal is to assist eligible applicants and recipients under the
Colorado Works in Weld County Program obtain and retain unsubsidized employment; and
WHEREAS,the Employer desires to participate with Employment Services in a subsidized
private sector employment program specifically designed for recipients of Colorado Works in Weld
County as an employer and as an instructional training facility for the recipients of the Temporary
Assistance for Needy Families participants under the Colorado Works in Weld County Program; and
WHEREAS,the Employer and Employment Services desire to work together for the express
purpose of providing employment and instructional training for participants under this program.
NOW THEREFORE, in consideration of the implementation of these goals, the parties hereby
agree to the following:
A. Program Definitions
Work Supplementation is an employer incentive-based program designed to introduce the
participant into the workforce. The employer provides a wage to a participant as an alternative
to a Temporary Assistance to Needy Families grant. Colorado Works in Weld County
provides training reimbursements of 50%of the gross monthly salary.
The participant is a recipient of aid under the Colorado Works in Weld County programs for
which the training reimbursement will apply.
Mentoring is a service the employer agrees to provide to assist the participant under the terms
of this agreement, resolve related issues and problems and assist the participant's entrance into
the work force

The work site is the location in which the participant will be out stationed by the Employer.
The Employer is eligible to receive a training allowance bonus of$500 if the Employer hires a
participant at the conclusion of the Work Supplementation Program and retains the participant

B. Employer Responsibilities
I. Provide for a minimum of three months of unsubsidized,continuous,full time
employment for a participant to achieve a complete diversion from a public assistance
grant. The Employer will provide participants with wages that are comparable to other
employees doing comparable work. The Employer understands that they are expected
to continue to employ the participants unless good cause prevents retention.
a. Commit to a forty-hour work week that provides for a combination of work
and education.
b. Provide training in job specifics, and mentoring of recipients in work ethics
and employment retention skills for either continued employment with the
Employer or preparation for employment with another employer. Reinforce
employer basic skills competency through performance evaluations and/or
counseling forms.
1) Training may be provided directly by the employer or through
subcontracts with another training provider.
2) Employer Basic Skills Competencies, approved by the Weld County
Private Industry Council, is attached to and made a part of this
Agreement as Attachment A.
3) The Employer is eligible to receive a$300 training allowance for the
participant to receive job search skills, interviewing,job specific, and
mentoring and employment retention skills at the end of the three-
month period.
c. Furnish all equipment and materials as deemed reasonably necessary by the
Employer to ensure the continued accomplishment of program objectives.
d. Provide liability and worker's compensation insurance coverage on the
participant to the same extent as for other employees similarly employed.
e. Agree that the Employer is given the final decision in selecting the
participant under the terms of this Agreement.
f. Provide the same benefits including health insurance, sick leave, holidays,

i. Provide competent supervision, including adequate training,when the job
requires the use of equipment and/or procedures that are unfamiliar to the
participant.
J. Abide by all pertinent Department of Labor Laws(Occupational Health and
Safety [OHSA], Davis Bacon Act,Child Labor Laws, etc.). The Employer
agrees to contact the Special Programs Coordinator of the Employment and
Training Program with any questions concerning specific tools or the Child
Labor Laws.
k. Report to Employment Services within 24 hours when the Employer terminates
a participant and documents its reason(s)for the action. Employment Services
will determine the sanction status of the participant and make appropriate
referrals to the Department of Social Services for eligibility and sanction status.
I. The Employer will complete the attached Work Supplementation Invoice Form
and follow the procedures outlined on the Form for reimbursement. The Form is
added hereto as Attachment B and is hereby made a part of this Agreement. A
separate Invoice will be completed on each participant by the 15th of the
following month based on the gross wages paid for the previous month.
m. Treat all participants in the same manner as other employees of the Employer,
concerning such issues as safety and job performance.
n. Immediately contact Employment Services regarding any difficulties the
Employer may have concerning the participant's performance, absence or
tardiness, etc.
n. Participate in any follow-up,monitoring,and evaluation procedures
conducted or endorsed by Employment Services.
o. Not to do any of the following:
1) promote or deter union organizing
2) charge fees to participants under this Agreement
3) involve participants in sectarian activities

4) involve participants in lobbying activities
5) accept any kickbacks
6) have any conflict of interest under this Agreement, including nepotism
2. Provide with continued subsidy, an additional three months of continuous, full time
employment,to those participants who need additional training to continue employment
with the Employer.
a. The conditions of such employment will continue as described in Item B. 1. a
through o of this agreement.
b. Employer is eligible to receive a training allowance bonus of$300 in order for
the participant to receive additional training at the end of the three-month
period.
c. The Employer understands that they are expected to continue to employ the
participants unless good cause prevents retention.
d. The Employer and Employment Services will determine the need of additional
training for the participant by, but not limited to, the performance results
outlined in the Basic Work Skills Development Report, and the participant's
adherence to responsibilities under the Work Participation Agreement between
Employment Services and the participant.
3. Hire and retain those participants who have been successful in meeting the Employer's
training needs, as full time employees, if appropriate. Employment Services agrees to
provide a$500 training allowance bonus to the Employer if the Employer hires the
participant at the conclusion of the Work Supplementation Program and retains the
participant for an additional three month period. Employment Services will pay the
training allowance bonus at the conclusion of the additional three month period.
B. Employment Services Responsibilities
1. Provide the Employer with an orientation session outlining the specific
procedures and policies the Employment Services requires that the Employer follow.
2. Encourage participants to apply for available positions with the Employer and assess
participants to determine their job readiness for positions with the Employer.
3. Arrange for space for the Employer to interview applicants referred to the Employer.
4. Refer, if available, the agreed upon number of participants to the Employer for
employment.
5. Complete a Work Supplementation Participation Agreement that outlines programs

expectations and responsibilities with participants. The Work Supplementation
Participant Agreement is attached hereto and incorporated herein as Attachment C.
6. Provide the Employer a monthly work supplementation fee of 50% of the participant's
gross salary for the month. Employment Services shall not be liable for any costs that
exceed the agreed upon amount.
7. Provide the Employer a training allowance bonus on behalf of the participant as follows:
a. A training allowance bonus of$300 according to the provisions of Item B. 1. of
this Agreement.
b. A training allowance bonus of$300 according to the provisions of Item B. 2. of
this Agreement, if the participant requires an additional three months of
participation in the Work Supplementation Program.
c. A training allowance bonus of$500 for a participant who has been hired by the
employer after a successful completion of a three-month or six- month work
supplementation program and retained in full time employment for three
months.
8. Assist the Employer, upon the Employer's request, in resolving any possible disputes
with the participant.
C. Assurances
1. The Employer agrees that it is an independent contractor and that its officers and
employees do not become employees of Weld County, and therefore are not
entitled to any employee benefits as Weld County employees because of the execution of
this Agreement.
2. Weld County, The Board of County Commissioners of Weld County, and its officers and
employees shall not be held liable for injuries or damages caused by any negligent acts
or omissions of the Employer, or its employees, volunteers,or agents, while performing
Employer duties as described in this Agreement. The Employer shall indemnify, defend,
and hold harmless Weld County, and its officers and employees for any loss occasioned
as a result of the performance of this Agreement by the Employer, its employees,
volunteers, and agents.
3. The Employer understands that monitoring and evaluation of the performance of this
Agreement shall be conducted by Employment Services and the results provided to the
Weld County Private Industry Council and the Board of County
Commissioners of Weld County.

4. The Employer assures that it will comply with Title VI of the Civil Rights Act of 1986
and that no person shall,on the grounds of race,creed, color, sex,or national origin, be
excluded from participation in, be denied the benefits of, or be otherwise subjected to
discrimination under this approved Agreement.
D. Performance
Performance will be monitored as follows
1. Retention rates of individuals placed in unsubsidized employment because of
participation in the programs is measured by 3 month, 6 months, and 1 year follow-up of
participants.
2. Recidivism rates of Colorado Works recipients returning to public assistance from
unsubsidized employment with the Employer.
D. Modification
This Agreement may be modified at any time by a written amendment signed by both parties.
E. Termination
This Agreement may be terminated at any time by either party giving 48 hour written notice.

The Work Supplementation Program(WSP)is designed to help people receiving a TANF grant to become self-supporting through employment.
WSP does not guarantee employment,but WSP is an additional opportunity to gain valuable work skills as well as additional referrals to jobs.

the use of equipment and/or procedures that are unfamiliar to the participant.
j. Abide by all pertinent Department of Labor Laws (Occupational Health and
Safety [OHSA], Davis Bacon Act, Child Labor Laws, etc.). The Employer agrees

to contact the Special Programs Coordinator of the Employment and Training
Program with any questions concerning specific tools or the Child Labor Laws.
k. Report to Employment Services within 24 hours when the Employer terminates a
participant and documents its reason(s) for the action. Employment Services will
determine the sanction status of the participants and make appropriate referrals to
the Department of Social Services for eligibility and sanction status.
1. The Employer will complete the attached Work Supplementation Invoice Form
and follow the procedures outlined on the Form for reimbursement. The Form is
added hereto as Attachment B and is hereby made a part of this Agreement. A
separate Invoice will be completed on each participant by the 15th of the
following month based on the gross wages paid for the previous month.
m. Treat all participants in the same manner as other employees of the Employer,
concerning such issues as safety and job performance.
n. Immediately contact Employment Services regarding any difficulties the
Employer may have concerning the participant's performance, absence or
tardiness, etc.
o. Participate in any follow-up, monitoring, and evaluation procedures conducted or
endorsed by Employment Services.
p. Not to do any of the following:
1) promote or deter union organizing
2) charge fees to participants under this Agreement
3) involve participants in sectarian activities
4) involve participants in lobbying activities
5) accept any kickbacks
6) have any conflict of interest under this Agreement, including nepotism
2. Provide with continued subsidy, an additional three months of continuous, full time
employment, to those participants who need additional training to continue employment
with the Employer.
a. The conditions of such employment will continue as described in Item B. 1. a
through o of this agreement.
b. Employer is eligible to receive a training allowance bonus of$300 in order for the
participant to receive additional training at the end of the three-month period.
c. The Employer understands that they are expected to continue to employ the
participants unless good cause prevents retention.
d. The Employer and Employment Services will determine the need of additional
training for the participant by, but not limited to, the performance results outlined
in the Basic Work Skills Development Report, and the participant's adherence to
responsibilities under the Work Participation Agreement between Employment
Services and the participant.

B. Employment Services Responsibilities
1. Provide the Employer with an orientation session outlining the specific procedures and
policies the Employment Services requires that the Employer follow. •
2. Encourage participants to apply for available positions with the Employer and assess
participants to determine their job readiness for positions with the Employer.
3. Arrange for space for the Employer to interview applicants referred to the Employer.
4. Refer, if available, the agreed upon number of participants to the Employer for
employment.
5. Complete a Work Supplementation Participation Agreement that outlines programs
expectations and responsibilities with participants. The Work Supplementation
Participant Agreement is attached hereto and incorporated herein as Attachment C.
6. Provide the Employer a monthly work supplementation fee of 25% of the participant's
gross salary for the month. Employment Services shall not be liable for any costs that
exceed the agreed upon amount.
7. Provide the Employer a training allowance bonus on behalf of the participant as follows:
a. A training allowance bonus of$300 according to the provisions of Item B. 1. of
this Agreement.
b. A training allowance bonus of$300 according to the provisions of Item B. 2. of
this Agreement, if the participant requires an additional three months of
participation in the Work Supplementation Program.
8. Assist the Employer, upon the Employer's request, in resolving any possible disputes
with the participant.
C. Assurances
1. The Employer agrees that it is an independent contractor and that its officers and
employees do not become employees of Weld County, and therefore are not
entitled to any employee benefits as Weld County employees because of the execution
of this Agreement.
2. Weld County, The Board of County Commissioners of Weld County, and its officers
and employees shall not be held liable for injuries or damages caused by any negligent
acts or omissions of the Employer, or its employees, volunteers, or agents, while
performing Employer duties as described in this Agreement. The Employer shall
indemnify, defend, and hold harmless Weld County, and its officers and employees for
any loss occasioned as a result of the performance of this Agreement by the Employer,
its employees, volunteers, and agents.
3. The Employer understands that monitoring and evaluation of the performance of this
Agreement shall be conducted by Employment Services and the results provided to the

Exhibit C
Weld County Private Industry Council and the Board of County Commissioners of
Weld County.
4. The Employer assures that it will comply with Title VI of the Civil Rights Act of 1986
and that no person shall, on the grounds of race, creed, color, sex, or national origin, be
excluded from participation in, be denied the benefits of, or be otherwise subjected to
discrimination under this approved Agreement.
D. Performance
Performance will be monitored as follows:
1. Retention rates of individuals placed in unsubsidized employment because of
participation in the programs is measured by 3 month, 6 months, and 1 year follow-up
of participants.
2. Recidivism rates of Colorado Works recipients returning to public assistance from
unsubsidized employment with the Employer.
D. Modification
This Agreement may be modified at any time by a written amendment signed by both
parties.
E. Termination
This Agreement may be terminated at any time by either party giving 48 hour written
notice.

PUBLIC SECTOR WORK ACTIVITY AGREEMENT
WITH A SPONSOR
This Agreement, made and entered into the date written below, by and between the Employment
Services of Weld County, hereinafter referred to as "Employment Services" and
a public sector employer, hereinafter referred to as the
"Sponsor."
PURPOSE OF THE AGREEMENT
A. It is the purpose of this Agreement to outline a cooperative and non-financial Agreement
between Employment Services and the Sponsor in the assignment of Colorado Works in Weld
County (CWWC) participant to specific CWWC activities at the Sponsor's work site.
B. The Sponsor will provide specific activities for the CWWC participant that lead to the
development of basic work habits, enhancement of employment skills through reinforcement of
work place skills, and the obtainment of a current work history for the participant.
C. As an option, the Sponsor will provide specific training activities that will enhance the
participant's job specific skills.
COOPERATIVE AND NONFINANCIAL AGREEMENT
A. EMPLOYMENT SERVICES AGREES AS FOLLOWS:
1. To refer participants who they believe can perform work activities within the Sponsor's work
assignment.
2. To provide a participant for six (6) months or less.
3. To assure that necessary and reasonable transportation and related work expenses are provided
to the participant.
4. To provide timely notification to the participant and the Sponsor of the required number of
hours of weekly participation.
5. To furnish attendance and performance evaluation report forms which the Sponsor and
participant will jointly complete.
6. To maintain communication with the Sponsor concerning participant progress.
7. To assure that Worker's Compensation coverage for the participant is provided by Weld
County Government.
B. THE SPONSOR AGREES AS FOLLOWS:
1. To provide work activities that will enable the participant to learn vocational skills and gain
work experience and, at the option of the Sponsor,job specific training activities.
2. Not to displace regular full-time or part-time employees to fill vacancies with the
CWWC participants.
3. To not create assignments in situations resulting from a labor dispute, nor which, in any way
interfere with union rules.
4. To furnish equipment and materials reasonably necessary to ensure the accomplishment of the
project task.
5. To accept only the number of CWWC participants whom the Sponsor can effectively supervise
and use productively.
6. To assure competent supervision, including adequate training when the work assignment
requires the use of equipment and/or procedures unfamiliar to the participant.

7. To prepare with each CWWC participant monthly attendance sheets certifying the days and
number of actual hours spent at the work site. Those reports will be forwarded to Employment
Services no later than(3) days after the report period has ended.
8. To grant to the participant the necessary time to report for employment interviews authorized by
Employment Services.
9. To provide work assignments in which the participant shall not to exceed eight hours per day.
10. To treat all CWWC participants in the same manner and under the same rules as employees of
the Sponsor concerning such issues as hours of work, safety, and job performance.
11. To inform each CWWC participant of the rules at the time of initial placement.
12. To contact Employment Services immediately in the event the CWWC participant fails to
participate under the terms of the Assignment Agreement.
13. To complete a performance report that focuses on work place skills with each CWWC
participant per arrangement with Employment Services. Such reports shall be prepared at a
minimum of every two months and at the end of the participant's assignment at the work site.
The form for the performance report is set forth in Attachment A.
14. To assure that the participant will not be subject to racial, ethnic, sexual, or religious
discrimination.
15. To release immediately and return to Employment Services a participant whose
conduct becomes excessively disruptive, or who consistently violates the rules and
regulations. The Sponsor will provide Employment Services an explanation of the
participant's release.
16. To respect the participant's rights to confidentially on being a CWWC participant.
17. To follow the procedures as provided by Employment Services for any worker's
compensation coverage. The worker's compensation coverage procedure is Attachment B.

EMPLOYMENT SERVICES OF WELD COUNTY
WORKERS' COMPENSATION
The following are the policies and procedures for Workers' Compensation:
1. Trainees in a public or private sector work activity program under the Colorado Works in Weld
County Program are covered by the Workers' Compensation Act which is provided under Weld
County Government. The coverage under Workers Compensation provides that a CWCC
participant receiving a job related disease or injury will be eligible for disability income and
medical care.
2. If an injury occurs during training/work hours, you as the work site supervisor are directed to
immediately report and injury on the day that it occurs to Employment Services of Weld County at
353-3800. If the injury is after hours or on a weekend, please notify Employment Services the
next available working day.
3. All work site supervisors must know and be able to provide to the trainees the procedures to
follow when an injury occurs.
4. All work related injuries occurring during daily working hours are to be treated at the North
Colorado Occupational Medicine Clinic located at North Colorado Medical Center, 1801 16th
Street (if using the main entrance, the information desk can direct employees to the clinic). This
clinic is open from 7:30 a.m. until 4:00 p.m., Monday through Friday. The Clinic staff will
determine if immediate attention is necessary of if an appointment can be established in the near
future. For hours other than 7:30 a.m. through 4:00 p.m, Monday through Friday, employees are
to go the emergency room at the same address. The claim may be denied if the participant goes to
a private physician. The only exception will be if the injury is severe enough to require the use of
an ambulance in which case the injured party will be taken to the nearest medical facility.
Payment will not be made for anv chiropractic service.
5. Before the injured trainee is allowed to return to work, a written release is required from the
physician stating the trainee can return to work.
The trainee's agreement with Employment Services of Weld County will be immediately terminated if
it is determined by the Weld County Personnel staff that the trainee has fraudulently claimed an injury
or illness under Workers' Compensation. The Weld County Personnel Office will determine if further
legal action will be pursued.

Based upon the Individual Responsibility Contract(IRC), Employment Services has determined that
your participation in the Public Sector Work Activity Program is a step toward your employment goals.
The purpose of the Public Sector Work Activity Program is to provide you the opportunity to develop
basic work habits, enhance employment skills through the reinforcement of your work place skills, and
obtain current work history. Your Participation in these activities will help you obtain employment.
Employment Services will assign you to a"Sponsor." A Sponsor is a public sector employer.
YOUR RESPONSIBILITIES AND RIGHTS ARE AS FOLLOWS:
Employment Services will require that you participate in the Public Sector Work Activity Program as
condition for continued Colorado Works and food stamp eligibility, as applicable. Employment
Services will expect you to:

PRIVATE SECTOR WORK ACTIVITY AGREEMENT
WITH A SPONSOR
This Agreement, made and entered into the date written below, by and between the Employment
Services of Weld County, hereinafter referred to as "Employment Services" and
a private sector employer, hereinafter referred to as the
"Sponsor."
PURPOSE OF THE AGREEMENT
A. It is the purpose of this Agreement to outline a cooperative and non-financial Agreement
between Employment Services and the Sponsor in the assignment of Colorado Works in Weld
County (CWWC)participants to specific activities at the Sponsor's work site.
B. The Sponsor will provide specific activities for the CWWC participant that leads to the
development of basic work habits, enhancement of employment skills through reinforcement of
work place skills, and the obtainment of a current work history for the CWWC participant.
C. As an option, the Sponsor will provide specific training activities that will enhance the CWWC
participant's job specific skills.
COOPERATIVE AND NONFINANCIAL AGREEMENT
A. EMPLOYMENT SERVICES AGREES AS FOLLOWS:
1. To refer CWWC participants who they believe can perform work activities within the
Sponsor's work assignment.
2. To provide a CWWC participant for six (6) months or less.
3. To assure that necessary and reasonable transportation and related work expenses are
provided to the CWWC participant.
4. To provide timely notification to the CWWC participant and the Sponsor of the required
number of hours of weekly participation.
5. To furnish attendance and performance evaluation report forms which the Sponsor and
CWWC participant will jointly complete.
6. To maintain communication with the Sponsor concerning CWWC participant progress.
7. To assure that Worker's Compensation coverage for the CWWC participant is provided
by Weld County Government.
B. THE SPONSOR AGREES AS FOLLOWS:
1. To provide work activities that will enable the CWWC participant to learn vocational
skills and gain work experience and, at the option of the Sponsor,job specific training
activities.
2. To not displace regular full-time or part-time employees to fill vacancies with the
CWWC participants.
3. To not create assignments in situations resulting from a labor dispute, nor which, in any
way interfere with union rules.
4. To furnish equipment and materials reasonably necessary to ensure the accomplishment
of the project task.
5. To accept only the number of CWWC participants whom the Sponsor can effectively
supervise and utilize productively.

6. To assure competent supervision, including adequate training when the work assignment
_ requires the use of equipment and/or procedures unfamiliar to the CWWC participant.
7. To prepare with each CWWC participant monthly attendance sheets certifying the days
and number of actual hours spent at the worksite. Those reports will'be forwarded to
Employment Services no later than (3) days after the report period has ended.
8. To grant to the CWWC participant the necessary time to report for employment
interviews authorized by Employment Services.
9. To provide work assignments in which the CWWC participant shall not exceed eight
hours per day.
10. To treat all CWWC participants in the same manner and under the same rules as
employees of the Sponsor concerning such issues as hours of work, safety, and job
performance.
11. To inform each CWWC participant of the rules at the time of initial placement.
12. To contact Employment Services immediately in the event the CWWC participant fails to
participate under the terms of the Assignment Agreement.
13. To complete a performance report that focuses on work place skills with each CWWC
participant per arrangement with Employment Services. Such reports shall be prepared at
a minimum of every two months and at the end of the CWWC participant's assignment at
the worksite. The form for the performance report is set forth in Attachment A.
14. To assure that the CWWC participant will not be subject to racial, ethnic, sexual, or
religious discrimination.
15. To release immediately and return to Employment Services a CWWC participant whose
conduct becomes excessively disruptive, or who consistently violates the rules and
regulations. The Sponsor will provide Employment Services an explanation of the
CWWC participant's release.
16. To respect the CWWC participant's rights to confidentially on being a CWWC
participant.
17. To follow the procedures as provided by Employment Services for any worker's
compensation coverage. The worker's compensation coverage procedure is Attachment
B.

EMPLOYMENT SERVICES OF WELD COUNTY
WORKERS' COMPENSATION
The following are the policies and procedures for Workers' Compensation:
1. Trainees in a public or private sector work activity program under the Colorado Works in Weld
County Program are covered by the Workers' Compensation Act which is provided under Weld
County Government. The coverage under Workers' Compensation provides that a CWCC
participant receiving a job related disease or injury will be eligible for disability income and
medical care.
2. If an injury occurs during training/work hours, you as the work site supervisor are directed to
immediately report and injury on the day that it occurs to Employment Services of Weld County at
353-3800. If the injury is after hours or on a weekend, please notify Employment Services the
next available working day.
3. All work site supervisors must know and be able to provide to the trainees the procedures to
follow when an injury occurs.
4. All work related injuries occurring during daily working hours are to be treated at the North
Colorado Occupational Medicine Clinic located at North Colorado Medical Center, 1801 16th
Street(if using the main entrance,the information desk can direct employees to the clinic). This
clinic is open from 7:30 a.m. until 4:00 p.m., Monday through Friday. The Clinic staff will
determine if immediate attention is necessary of if an appointment can be established in the near
future. For hours other than 7:30 a.m. through 4:00 p.m, Monday through Friday, employees are
to go the emergency room at the same address. The claim may be denied if the participant goes to
a private physician. The only exception will be if the injury is severe enough to require the use of
an ambulance in which case the injured party will be taken to the nearest medical facility.
Payment will not be made for any chiropractic service.
5. Before the injured trainee is allowed to return to work, a written release is required from the
physician stating the trainee can return to work.
The trainee's agreement with Employment Services of Weld County will be immediately terminated if
it is determined by the Weld County Personnel staff that the trainee has fraudulently claimed an injury
or illness under Workers' Compensation. The Weld County Personnel Office will determine if further
legal action will be pursued.

C. Baseline Information for Child Care
1. Characteristics of Participants from demographic reports of April 1997
a. 14.7% of the families on the low income program remain on the program less than 6
months.
b. 7% of the families on the low income program remain on the program less than 12
months.
c. 24.4% of the families on the low income program continue the program more than 24
months.
d. 18.1% of the families receiving child care for JOBS/New Directions remain on the child
care program for less than 6 months.
e. 4% of the families receiving child care for JOBS/New Directions remain on the child care
program for less than 12 months.
f. There are no families receiving child care benefits for more than 24 months under the
JOBS/New Directions program.
g. Transitional child care recipients did not remain on the program for more than 12 months
and then approximately 90% of those families moved into the low-income child care
program.
h. Services were provided to 782 children under the low-income program, 179 children
under the JOBS program, 88 children under the transitional child care program, and 86
children under the special circumstances/protective services program. The average
number of children served were two-parent families, and the remaining 91% were single-
parent applicants.
I. For the low-income population, 9% of the families served were two-parent families, and
the remaining 91% were single-parent applicants.
j. Expenditures were as follows: $185,208.07 for all child care programs combines;
$143,764.91 was spent on low-income; $201235.23 on JOBS; $11,403.66 on transitional
child care; and $9,804.27 on Special Circumstance child care.
