RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH
LEGAL ACTION AGAINST LARRY AND MARTHA RHOADARMER/RUDY HARBURG
FOR VIOLATION OF THE WELD COUNTY ZONING ORDINANCE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Larry and Martha Rhoadarmer/Rudy Harburg, VI #9700205, are allegedly in
violation of the Weld County Zoning Ordinance, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 11th day of August, 1998, a public hearing was held before the Board
of County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Larry and Martha Rhoadarmer, property owners were not present, Rudy
Harburg, representative, was present at said hearing, and
WHEREAS, the Board of County Commissioners deems it advisable to refer said
violation to the Weld County Attorney's Office for legal action, with an instruction for delay of
action upon such referral until November 9, 1998, to allow adequate time for the property owners
to bring the subject property into compliance and for an inspection of the property by the
Department of Planning Services staff.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that said violation be, and hereby is, referred to the Weld County Attorney's
Office for legal action against Larry and Martha Rhoadarmer/Rudy Harburg to remedy the
violation of the Weld County Zoning Ordinance, and any other persons occupying the properties,
any persons claiming an interest in the properties, and any persons acting in active concert with
the identified parties, with an instruction for delay of action upon such referral until November 9,
1998, to allow adequate time for the property owners to bring the subject property into
compliance.

November 18, 1997 Initial complaint received. Three "move in houses are being stored on the property.
November 21, 1997 Telephone call between Julie Chester, Zoning Compliance Officer and Larry
Rhoadarmer. He stated they are being store temporarily and will be moved into
Longmont or Lyons.
January 20, 1998 Site Inspection. Houses are still located on the property without the appropriate
permits.
January 20, 1998 Five day letter sent.
January 23, 1998 Mr. Rhoadarmer called and stated that he had signed a contract with Rudy Harburg.
The contact states the houses will be moved out by January 31, 1998.
February 2, 1998 Telehone call from Sharyn Frazer, Zoning Compliance Officer. Left a message
regarding the status of the houses.
February 5, 1998 Letter from Rudy Harburg to Sharyn Frazer specifically stating the problems occurring
in removing these structures from the address at 37th Street by late spring.
March 5, 1998 Letter of compliant sent to Commissioner Webster. •
March 12, 1998 Memo from Sharyn Frazer to Commissioner Webster regarding the status of the
violation.
April 21, 1998 Facsmile from Rudy Harburg to Gloria Dunn, Current Planner. The letter addresses
problems they are having with the Community of Nederland regarding the land use
process to move the structures into the community. The back up plan would be to
permit the structures in Weld County as accessory storage structures.
May 5, 1998 Telephone call from Rudy Harburg to Gloria Dunn stated he will be in to the
Department of Planning Services to apply for the building permits.
May 25, 1998 Building permits for all three structures applied for and paid for ($267.71), to be used
as accessory storage building on Rhoadarmers property. First inspection to be
scheduled within 180 days.

on relocating the structures.

Dear Gloria,
I have three houses stored at 3924 37th in south west Greely. This a farm that looks to
me like it might be 100 acres. I'm waiting to hear back from Larry Rhoadamer and get the
correct acreage.
Originally we were promised building permits to put the houses in Nederland "use by
right"by the Town. One permit was actually issued. But the Town decided they had
overlooked a rule requiring a PUD. The permits were withdrawn. So now we are dealing
with land use issues.

It's important to me to not create a problem for anyone because of the houses stored on
the Rooadamer property. Everyone is being extremely kind and patient. But I'm still not
sure how long this land use process will drag on. It's really hard to estimate. Larry and I
have talked about the possibility,that if titi.s process goes beyond the limits of peoples
patience, aback up plan would be to use the three houses as storage garages on his farm.
Larry has a lot of equipment on his farm now left in the weather.
I am a structural engineer,Colo PE# 11600. I would engineer foundations and smzt
changes in the building required for conversion to set the houses down on a dirt floors,
Basically,conversion would involve striping the inside of each house and replacing
interior bearing walls with steel post beam assemblies.
I know it takes time to process a permit. If you find that this storage building proposal is
acceptable,then I would want to get started with engineering and permitting to expedite
resolution on the three houses and eliminate zoning concerns.
I will try to get a plot sketch to you when I get more information from Larry.

COLORADO Subject: Letter of Complaint(K. Stewart) 4350 37th Street &Twin River Parkway
I have checked into this complaint and the Department of Planning Services currently has violations on both items
of concern (see attached letter).
The old homes being stored on 4350 37th Street is VI-9700205, Larry and Martha Rhoadarmer. Playground
Partners, LLC (Catherine Corona and Rudy Harburg) came into the office and met with me regarding the letter
I sent when we issued the violation. The Department of Planning Services is working with them to remove the
structures. I have attached a copy of the written statement they supplied for the file regarding removal plans. We
will follow this closely.
The property on the corner of 37th Street and Twin Rivers Parkway is VI-9600303, Charles McKay. The
Department of Planning Services has a District Court Stipulation on file. I have attached a copy for your
information. The property owner is currently installing his fencing.
