HomeMy WebLinkAbout960747 • • RESOLUTION RE: APPROVAL OF RECORDED EXEMPTION #1861 - SCHAEFER WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners, pursuant to its authority under Section 30-28-101(10)(d), CRS, as amended, did determine at a public meeting held in the Chambers of the Board, that a certain parcel of land, to be divided into two parcels, as shown on the plat known as Recorded Exemption#1861, does not come within the purview of the definition of the terms, "subdivision" and "subdivided land", and WHEREAS, the request for Recorded Exemption #1861 was submitted by William and Beverly Schaefer, 17483 Weld County Road 44, LaSalle, Colorado 80645, for property which is described as the E'%, SW%of Section 13, Township 4 North, Range 66 West of the 6th P.M., Weld County, Colorado, being more particularly described in the plat which shall be provided by the applicant and known as Exhibit "A", said plat to be recorded, and WHEREAS,this request is to divide the property into parcels estimated to be approximately 4 acres and 68 acres. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the hereinabove described parcel of land be, and hereby is, exempt from the definition of the terms, "subdivision" and "subdivided land". BE IT FURTHER RESOLVED by the Board that Recorded Exemption #1861 submitted by William and Beverly Schaefer be, and hereby is, approved conditional upon the following: 1. The access onto Lot A from Weld County Road 44 and located on the west side of said Lot A shall be closed. 2. Prior to recording the plat: a. An access easement for the benefit of Lots A and B to the south side of the ditch shall be delineated across Lot A for access and repair or maintenance of the ditch. The access easement shall be dedicated for the use as shown on the plat using the language set forth in Section 11.7.1.12.5 of the Weld County Subdivision Ordinance. The applicant shall submit evidence that the septic system located on Lot A is permitted through the Weld County Health Department or that an I.S.D.S. evaluation has been performed by the Weld County Health Department. In the event the system is found to be inadequate, the system must be brought into compliance with current I.S.D.S. regulations. 3. The applicant shall submit a mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be prepared in accordance with the requirements of Section 11.7 of the Weld County Subdivision Ordinance. The plat shall be submitted within sixty days from the date of approval by the Board of County Commissioners. The applicant shall be responsible for paying the recording fees. 4. Any future development of Lot A shall require the closure of the circle drive access onto Lot A and located at the intersection of Weld County Roads 35.5 and 44. 5. No vegetation, structure, or other obstruction shall be located within the sight triangle on Lot A at the northwest corner of the intersection of Weld County Roads 35.5 and 44. The owner of Lot A shall at all times maintain said sight triangle so that adequate sight distances exist. The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 24th day of April, A.D., 1996. Webst (( 960747 RE1861 f �; • • COLORADO Staff Recommendation RE-1861 William & Beverly Schafer The Department of Planning Services' staff is concerned that this proposal does not comply with the intent of the Transportation Goals and Policies of the Weld County Comprehensive Plan, as amended; specifically T.Goal 1, T.Policy 1, T.Goal 3, T.Policy 3, T.Goal 4, T.Policy 4, and T.Policy 4.1. Three of the existing accesses to proposed Lot A are from Weld County Road 44, which is designated as a County Collector in the Weld County Comprehensive, as amended. This proposal does not meet the requirements of Ordinance 180 of the Access Code which allows for one residential access per parcel. T.Goal 1: "Provide a unified and coordinated countywide street and highway system which moves people and goods in a safe, economical, and efficient manner." T.Policy 1: "The County should maintain a road classification system so county roads are designed and maintained according to their planned function." T.Goal 3: "Maximize the compatibility of roads, streets, and highways with adjacent land uses." T.Policy 3: "Establish policy standards for the regulation of accesses to streets and highways from abutting land-uses and intersecting roads." T.Goal 4: "Provide a balanced approach to transportation system development giving due consideration to all modes of travel." T.Policy 4: "The County will plan and maintain a transportation system that unifies and coordinates with other state, county, city, and community transportation systems." T.Policy 4.1: "The number of access points on collector and arterial roads should be kept to a minimum in order to minimize interruptions to traffic flow and to promote safety from the traveling public. Local roads shall be utilized for access to adjoining property." A letter from Central Weld County Water District is herewith enclosed stating there is an existing tap for the smaller parcel and water service is available to the larger parcel provided all requirements of the District are met. The larger parcel has an adjudicated irrigation well and Western Mutual Ditch rights for irrigating the larger parcel. 2. The existing parcel is serviced by an existing septic system for the smaller parcel. There is also an existing septic system for the improvements on the larger parcel. Any new construction on the larger parcel would require a new septic system to be installed in accordance with Weld County Health Department regulations. 3. The smaller parcel is currently being used as a rural residence, and will consist of approx. 4 acres of nonprime farmland. The larger parcel of approx. 68 acs. is being used as an irrigated farm, consisting of prime farmland and a rural residence. Improvements on the smaller parcel consist of a principal residence, and metal shed. Improvements on the larger parcel consist of a residential dwelling, miscellaneous sheds and two gas wells. 4. There will be no change in use after the exemption is granted. The smaller parcel will remain as a rural residence and the larger parcel will remain as an irrigated farm & rural residence. We are semi-retiring and reducing our farming operation and debt load. Our farm is over-improved for the amount of acreage. Some interest has been shown in purchasing our farm, but the Buyers have no need for and/or cannot afford the extra set of improvements. Therefore, we would like to separate our 4 acre tract of non-prime farmland from the farm, so it can be sold separately. There would still be a set of improvements on the larger parcel. The subject property is located approx. 1 mi. east of Peckham on Weld Co. Rd. 44. 6. The surrounding area consists of agriculture farming and rural residences. The two main accesses to the house and shed area from WCR 44 have been paved with a circle drive in place. The other additional accesses are a field access and an access from WCR 35.5 directly to the shed. Referring to Ordinance 180 of the access code,I would like to see one residential access to the four- acre parcel. All other accesses would be closed to WCR 44 and WCR 35.5 to correspond with the ordinance. This will minimize the number of accesses from WCR 44, which carries a high volume of truck and passenger vehicles. Lot B also has four existing accesses to WCR 35.5. Two of the existing accesses are agricultural- related to provide access to concrete line ditches.
