ARCHIVE BOX MISSING AS OF 12/19/2017 RESOLUTION RE: APPROVE VACATION OF SPECIAL REVIEW PERMIT (SUP #414) - THOMAS AND BEVERLY TROSTEL WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, by Resolution dated May 21, 1980, the Board did approve Special Review Permit (SUP #414) for a dairy operation for Thomas and Beverly Trostel on the following described real estate, to -wit: Lot B of amended RE #552 located in part of the E1/2 NE1/4 of Section 14, Township 2 North, Range 68 West of the 6th P.M., Weld County, Colorado WHEREAS, the Department of Planning Services staff recommended the vacation of said Special Review Permit as a Condition of Approval for amended RE #552, and WHEREAS, the Board has received a request from Thomas and Beverly Trostel, 9885 Weld County Road 11, Longmont, Colorado 80501, to vacate said Special Review Permit, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, studied the request of the applicant and the; recommendations of the Department of Planning Services staff and all of the exhibits and evidence presented in this matter and, having been fully informed, deems it advisable to approve said vacation. TO: Board of County Commissioners June 23, 1997 COLORADO From: Kerni Keithley, Current Planner SUBJECT: Vacation of SUP -414 Tom Trostel is requesting the vacation of SUP -414, a special use permit for a dairy operation which was granted in July of 1980. The parcel of land is described as Lot B of AMRE-552 located in part of the E2 NE4 of Section 14, T2N, R68W of the 6th P.M., Weld County, Co. The parcel is approximately 23 acres in size and is located west of and adjacent to WCR 11, north of WCR 20. The dairy operation is no longer occurring on the site. Mr. Trostel applied for a recorded exemption to split the property into a 13 acre and a 10 acre parcel in November of 1996. The vacation of SUP - 414 is a condition of approval for the recorded exemption. 971218 Weld county Commissioner's, June 10,1997 We are in favor of giving up our special use permit that has been in effect for several years as a requiuuent for the recorded exemption. The dairy operation on the hereon described parcel shall be limited to the facilities shown which are designed to handle a total of 140 cows and all other uses permitted by right under Section 3.3.B. of the Weld County Zoning Resolution. 2. The Special Use Permit area shall be maintained in such a manner so as to prevent soil erosion, fugitive dust, and the growth of noxious weeds. 3. All phases of the operation shall comply with all County and State Health Standards and Regulations pertaining to air quality, water quality, noise emission, and sanitary disposal systems. 4. Lagoons for wastewater retention shall be installed as per Rules and Guidelines for Water Pollution Control at Livestock Confinement Areas issued by the Colorado Department of Health, May, 1968. The applicant shall be responsible for any additional applicable directives or guidelines issued by the Colorado Department of Health, Water Pollution Control Division. 5. -All accesses shall have the approval of the Weld County Engineering Department. All accesses shall be constructed in accordance with the recommendations and/or requirements of the Weld County Engineering Department. 6. All plans, specifications and data pertaining to the dairy operation shall be submitted to the Weld County Health Department for approval prior to obtaining a Building Permit for the dairy operation. 7. There shall be no discharge of wastes into any streams, other bodies of water, or adjacent drainage systems without obtaining a National Pollution Discharge Elimination System Permit from the Colorado Department of Health. 8. The Special Use Permit shall be limited to the plans shown hereon and governed by the Development Standards stated above and all applicable Weld County Regulations. Any material deviations from the plans and/or Development Standards as shown or stated above shall require the approval of an amendment to the Special Use Permit by the Planning Commission and the Board of County Commissioners before such changes from the plans and/or Development Standards shall be permitted. Any other changes from the plans and/or Development Standards shall be filed in the office of the Department of Planning Services. 9. The property owner and/or operator of this operation shall be ' responsible for complying with all of the above stated Development Standards. Non-compliance with any of the above stated Development Standards may be reason for revocation of the Special Use Permit by the Board of County Commissioners. 1O. Appropriate landscaping shall be established along the north boundary ofythe property,:adjacentto the access road to screen the property, F.. Hello
