Dear Commissioners:
Given, County governments variable record on acting on applications for
increases in dairy herds and the denial of the nearby Busker Dairy
application,we were at first concerned that the subject application
might be denied. In reviewing the case papers we were reassured there
would be no reason to deny this application.The voluminous
documentation submitted by EnviroStock,the many letters of support,the
lack of negative letters from local naysayers or area municipal
governments, being outside local UGBs and County government's ostensible
support of the agriculture industry in the county leaves little excuse
for rejection.
We hope for and support Planning Commission and County Commissioner
approval of this case.

We are writing this letter to say we against the proposal for the expansion of the
Berson dairy.
He is proposing an increase for more than 2500 cattle on his dairy and we
feel that he does not have the acreage to handle that amount of cattle.
The flies are not being controlled now and the ponds he has there are not
sufficient., during the rainy time in April the ponds overflowed and flooded
out a wheat crop and a pasture and he had plenty of time before hand to
take care of this problem and he didn't. This cannot be good for the
environment,the underground water it is truly a health hazard.
The odor from the dairy is unbearable and the dust and the traffic caused by all of the
traffic going to and from the dairy is constant,trucks,employees and the
trash that this generates on the roads is terrible. It was never this bad before.
• Our land value will be decrease drastically with an expansion.
These dairy's make a substantial amount of money now and we feel that
expanding it will only help him and hurt a lot of people and the surrounding
land if this is allowed to go through.
The other problem was none of the surrounding properties were notified
about this proposal and the sign that he was suppose to hang out about the
("IN hearing was only up for 2 days,not the proper amount of time to notify
everyone in the area.
The way we see it he is trying to bypass rules and regulations now and we
think things will only get worse if he is allowed to expand.
You turned down the expansion for the Busker Dairy not that long ago,it
is only less than a mile away we are between themboth,;we are located at the
corner of Road#19 and Road#16. We hope you do the same this time.
Frederick and Firestone are also close by moying out this,way.
There are at least 13 to 15 homes and more in;the works that will be affected
if this is allowed to pass so please vote NO.on the,Berson Dairy expansion.

flies that these dairy's in this area cause. We have lived here for 20 years
and know what it is like to live in the country but this is getting ridiculous.

To whom it may concern,
This letter is in response to the proposed expansion for the Bearson Dairy located on WCR 16 in
Fort Lupton, Colorado.
The proposed expansion affects not only those within the direct border of the dairy in question,
but also those residents in the general vicinity. The expansion has raised numerous concerns and
this letter hopes to address them and raise the same concerns for the agencies involved in the
decision making process.
An original "gentlemen's" agreement was made with Bud Hunziker, the seller of the property,
that Mr. Bearson would:
A. Agree to not increasing his herd size greater than 900 head.
B. Agree to purchase the property as his main residence.
Mr. Bearson, to date has not built a primary residence on the property and now he is proposing to
expand his herd to over 3 '/2 times the size of which he originally agreed.
The present herd size is already a concern for the residents in the area. The health issues include:
A. Flies- The amount of flies located,not only at the dairy, but also their migration to
the various residences in the vicinity.
B. Dust- The dust generated by not only the herd, but also the equipment used to
support the operation. ( such as milk hauling semi trucks)
C. Waste Containment- The storage of the liquid waste product in the holding pond.
The last heavy rain, which was not abnormal for the area, ruptured the retention pond
and allowed the waste to run onto neighboring land. Monetary losses of the wheat
crop can be made available following harvest.
D. Odor- The current situation will not allow neighboring residents to regularly enjoy a
substantial quality of life.
The proposal as it stands does not offer a credible solution to problems which will only multiply
by a factor greater than three. Mr. Bearson has offered the following proposal:
A. Flies- to introduce a parasitic wasp. The introduction of non-local species to an
environment which utilizes a balance of nature may have catastrophic effects.
B. Dust- to allow the urine of the herd to control the dust. This does not address the
dust related to trucked milk hauling. The urine will only add to the issues of flies and
odor.
C. Waste Containment- no proposed solution
D. Odor- no proposed solution

Another issue related to the expansion which has not been addressed is that of water usage. Mr.
Bearson, like nearly all of the local residents, utilizes well water. Aquifer management and the
issues related are a concern for everyone. The introduction of seven families, i.e. trailers, alone
will impact the available water table; in addition the increased herd size of 2500 head will most
definitely have a negative impact on the local community's water availability.
Mr. Bearson has several letters which support the expansion proposed. These letters have been
solicited by local businesses which obviously will benefit monetarily. None of these businesses'
proprietors live in the vicinity. Not one of these individuals will have to live with the issues
raised in this opposition.
Several issues, because of the timeliness of this hearing have not been properly investigated:
A. The cun:-ent size of the herd.
B. If Mr. Bearson was involved in the Dairy Buyout in the late 1980's. Those involved
had agreed, for monetary compensation, not to be involved in future dairy operations.
In conclusion Mr. Bearson, through his failure to live up to his original agreement with Mr.
Hunziker, has shaded his credibility with the local residents. His lack of notification and the
removal of the original notice of public hearing or the lack of its maintenance, has raised
tremendous concern as to his proposed attempt to manage this expansion.
Mr. Bearson does not live on this property because of the before mentioned issues, what will
ensure us that any attempt will be made to secure an acceptable quality of life for the local
residents.
We, the signers of this letter, are in agreement with the content.
