RESOLUTION RE: APPROVE VACATION OF CERTIFICATE OF DESIGNATION AND SPECIAL REVIEW PERMIT #779 - CHARLES HAYS -XTRA CORPORATION WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, by Resolution dated October 21, 1987, the Board did approve Special Review Permit#779, and a Certificate of Designation for a for a solid waste disposal site for Charles Hays - Xtra Corporation on the following described real estate, to-wit: SE% of the NW% of Section 8, Township 2 North, Range 68 West of the 6th P.M., Weld County, Colorado WHEREAS, the Board has received a request from Charles Hays - Xtra Corporation, 998 Highway 119, Longmont, Colorado 80504, to vacate said Special Review Permit#779 and Certificate of Designation due to cost factors and the trend toward increased recycling, the project is not economically feasible, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, studied the request of the applicant and the recommendations of the Department of Planning Services staff and all of the exhibits and evidence presented in this matter and, having been fully informed, deems it advisable to approve said vacations. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that Special Review Permit#779 and Certificate of Designation issued to Charles Hays, Xtra Corporation, be, and hereby are, vacated. Eastin, Current Planner SUBJECT: Vacate USR-779, Charles Hays - XTRA Corporation DATE: February 12, 1998 The Department of Planning Services request that the Board of County Commissioners vacate USR-799 for a Solid Waste Disposal Site. The subject property is located in the SE4NW4 of Section 8, T2N, R68W of the 6th P.M., Weld County, Colorado P.M., Weld County, Colorado. USR-799 was approved by the Board of County Commissioners on October 21, 1987. The permit was granted an extension of time concerning the Special Review Permit on October 21, 1987. To date the use has never commenced. The vacation of the permit also includes the following: • Vacation of the Certificate of Designation • Vacation of the agreement regarding collateral for closure and improvements between XTRA Corporation and the Board of County Commissioners, in the amount of $27,791.57. The release of collateral would terminate the improvements agreement. The site is located on approximately 40 acres as part of the SE1/4 of the NW1/4 of Section 8, T2N, R68W of the 6th P.M., Weld County. The Certificate of Designation was adopted by the Board of County Commissioners on October 21 , 1987. This permitted landfill has never been activated. Due to cost factors and the trend toward increased recycling, this project is not economically feasible. Therefore, I am requesting that the permit be vacated. AUG 2 5 1997 livED REC ?jos ict\i ‘c, MEMORANDUM TO: Shani Eastin, Planning DATE: November 97 FROM: Trevor Jiricek, Health Departme COLORADO SUBJECT: XTRA Corporation, Vacation of C.D. and U.S.R. Our Department has reviewed the November 10, 1997, letter from Charles R. Hayes, concerning the XTRA Corporation Landfill. It is our understanding that Mr. Hayes would like to vacate U.S.R. #799 and the Certificate of Designation which was issued in October 1987. This letter indicates that the landfill site was never developed and that no substantial activities have occurred on the site that would be subject to any County requirements or the Regulations Pertaining to Solid Waste Disposal Sites and Facilities (6 CCR 1007-2). As a result, our Department has no concerns with the vacation of the above mentioned permits.
