RE: APPROVE AGREEMENT FOR TRANSFER OF TAX SALE CERTIFICATE AND
AUTHORIZE CHAIR TO SIGN - LA SALLE OIL COMPANY
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with an Agreement for Transfer of Tax Sale
Certificate among the County of Weld, State of Colorado, by and through the Board of County
Commissioners of Weld County, on behalf of the Weld County Treasurer, La Salle Oil
Company, and Thompson Potato Company, with terms and conditions being as stated in said
agreement, and
WHEREAS, after review, the Board deems it advisable to approve said agreement, a
copy of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the Agreement for Transfer of Tax Sale Certificate among the
County of Weld, State of Colorado, by and through the Board of County Commissioners of
Weld County, the Weld County Treasurer, La Salle Oil Company, and Thompson Potato
Company, be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized
to sign said agreement.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 4th day of March, A.D., 1998.

AGREEMENT FOR TRANSFER OF TAX SALE CERTIFICATE
THIS AGREEMENT is made and entered into on this 4 day of latvp

1998, by and between the La Salle Oil Company, whose address is 320 N. 1st Street, La Salle,
Colorado 80645 ("La Salle Oil"); the Thompson Potato Company, P.O. Box 126, La Salle,
Colorado 80645 ("Thompson"); and the County of Weld, by and through the Board of County
Commissioners of the County of Weld, whose address is 915 10th Street, Greeley, Colorado
80631 ("County").
WFINESSETH:
WHEREAS, County holds Tax Sale Certificate of Purchase No. 92-00914/93 ("Tax
Certificate") for a metal building built in 1945, being approximately 7,800 square feet in size and
located on the Union Pacific Railroad Right-of-Way, in the SE4 SE4 of Section 31, T5N, R65W
of the 6th P.M., Weld County, Colorado ("metal building"), which Certificate was issued
November 4, 1993, "stricken off'to County, and then recorded in the office of the Weld County
Clerk and Recorder on July 18, 1994, at Book 1451, Reception Number 02397974, and again on
July 19, 1995, at Book 1502, Reception Number 2447155, and
WHEREAS, since July, 1993, no one has paid the taxes due on the metal building
($8321.24), it has remained unoccupied, and is now in need of demolition, and
WHEREAS, although County has the right to apply for a Treasurer's Deed for the metal
building, it has not done so as of this date, and
WHEREAS, La Salle Oil and Thompson desire to obtain ownership of the metal building
by purchasing the Tax Certificate from County, to apply for a Treasurer's Deed, and to demolish
the metal building, and
WHEREAS, pursuant to C.R.S. § 39-11-122 and given that the amount of taxes due is
less than $10,000, the County has the authority to transfer ownership of the Tax Certificate
without the necessity of obtaining the approval of the State of Colorado Property Tax
Administrator, and
WHEREAS, the parties hereby enter into this Agreement for the purpose of
accomplishing the transfer of ownership of the Tax Certificate.
NOW, THEREFORE, in consideration that mutual promises and covenants contained
herein, the parties hereto agree as follows:
1. La Salle Oil and Thompson shall pay to County the sum of$10 as the purchase
price for the transfer of ownership of the Tax Certificate.

2. County shall transfer ownership of the Tax Certificate by assigning its right, title,
and interest to La Salle Oil and Thompson(each to receive an undivided one-half
interest in the Tax Certificate).
3. La Salle Oil and Thompson shall apply with the Weld County Treasurer for a
Treasurer's Deed for the metal building. County shall pay the necessary fee for
said Treasurer's Deed ($225).
4. La Salle Oil and Thompson shall, prior to October 1, 1998, demolish the metal
building and remove all debris therefrom at no cost to County.
