HomeMy WebLinkAbout992940.tiff RESOLUTION RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL ACTION AGAINST LARRY LOHMANN FOR VIOLATION OF THE WELD COUNTY BUILDING CODE ORDINANCE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Larry Lohmann, VI #9900304, is allegedly in violation of the Weld County Building Code Ordinance, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 14th day of December, 1999, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Larry Lohmann was not present or represented at said hearing, although all parties were notified of said hearing by Department of Planning Services staff, and WHEREAS, the Board deems it advisable to bring legal action against the individual as hereinabove named to correct said violation. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Weld County Attorney be, and hereby is, authorized to proceed with legal action against Larry Lohmann to remedy the violation of the Weld County Building Code Ordinance, and any other persons occupying the properties, any persons claiming an interest in the properties, and any persons acting in active concert with the identified parties. November 30, 1999 I made contact with Mr. Lohmann regarding the excavation. He stated that he was putting in a tail pond and did not know that he needed a permit to excavate. He stated that he would be in this afternoon or first thing this morning to get the permit. Deadline to get the permit was December 03, 1999. December 02, 1999 No progress has been made to get the necessary permit. December 03, 1999 Scheduled Hearing Certified Letter was sent out by Joe Mendez. There was no response regarding this violation. Letter was sent out to 2 different addresses: P.O. Box 336154, Greeley And 14615 WCR 66 (mailbox), Greeley December 07, 1999 Site inspection conducted. It appears that the excavation is still in progress. More land has been excavated since last inspection. Photos were taken. It also appears that excavation may exceed setback limits. December 13, 1999 No progress has been made; no permits applied for excavation. The Department of Planning also recommends that the County Attorney be authorized to proceed with legal action against any other persons occupying the properties, any persons claiming an interest in the properties, and any persons acting in active concert with the identified parties. Dear Larry Lohmann: I am writing this letter in reference to the excavation that is taking place on the property located at 14615 WCR 66 in which we have no recollection of an issued permit for the work in progress. There appears to be excavated land that may be exceeding the minimum set back requirements and may be possibly obstructing the drainage course of the land. We have no record of a proper permit, which is a violation of Section 30 of the Weld County Building Code Ordinance,which states no building or structure regulated by this code shall be erected, constructed, enlarged, altered, repaired, moved, improved, removed, converted, or demolished unless a separate building permit for each building or structure has been first obtained from the Weld County Building Inspection Department, to include any excavations of land. Section 3306.1 of the 1997 Uniform Building Code mentions that no person shall do any grading without first having obtained a grading permit from the building official. In addition to the non-issuance of the permit, Sub-Surface Drainage is required as per Section 3315.3 of the 1997 Uniform Building Code. Cut and fill slopes shall be provided with subsurface drainage as necessary for stability. We have not issued a violation at this time, but if you fail to correct this item of concern by November 01, 1999, a violation will be issued.
