LEGAL DESCRIPTION: The SE'A of the SW%/< of Section 17, and the Et of the NW'.4 of Section 20, T2N, R62W of the 6th P.M., Weld County, Colorado. LOCATION: West of and adjacent to Weld County Road 751/2 and approximately 1/2 mile north of Weld County Road 18. THE DEPARTMENT OF PLANNING SERVICES' STAFF RECOMMENDS THAT THIS REQUEST BE APPROVED FOR THE FOLLOWING REASONS: 1. The submitted materials are in compliance with the application requirements of Section 24.7 of the Weld County Zoning Ordinance, as amended, 2. It is the opinion of the Department of Planning Services' staff that the applicant has shown compliance with Section 24.3 of the Weld County Zoning Ordinance, as amended, as follows: a. This proposal is consistent with the Weld County Comprehensive Plan's Agricultural Goals and Policies section. The proposal does not take prime farm ground out of production. b. This proposal is consistent with the intent of the A (Agricultural) zone district and is provided for as a Use by Special Review. c. Portions of this site lie in the flood plain. d. Special Review Permit Development Standards will provide adequate protection of the health, safety and welfare of the neighborhood and County. This recommendation is based, in part, upon a review of the application materials submitted by the applicant, other relevant information regarding the request, and responses from referral entities. 4 EXHIBIT 9611213 uS0.-toqu USR-1090, Preston Christian Ranch Page 2 The Department of Planning Services' staff recommendation of approval is conditional upon the following: 1. The attached Development Standards for the Special Review Permit shall be adopted and placed on the Special Review plat prior to recording the plat. The plat shall be delivered to the Department of Planning Service and be ready for recording in the Weld County Clerk and Recorder's office within 15 days of approval by the Board of County Commissioners. 2. The Special Review activity shall not occur nor shall any building or electrical permits be issued on the property until the Special Review plat is ready to be recorded in the office of the Weld County Clerk and Recorder. 3. Prior to recording the plat: a. The applicant shall address the concerns stated by the Weld County School District RE-3(J) in a letter dated August 7, 1995. A copy of the applicants response shall be submitted to the Department of Planning Services. b. The applicant shall submit a drainage plan to the Department of Public Works for review and approval. A copy of the approved drainage plan shall be submitted to the Department of Planning Services. c. The applicant shall submit a parking space analysis and drawing to the Department of Planning Services for review and approval. The approval of the parking spaces shall be shown on the plat. d. All accesses shall be clearly shown on the plat. 4. Individual Sewage Disposal System permit must be finalized and approved by an Environmental Protection Specialist within one (1) year of the application date. 961473 Conditions of Approval, USR-1090 Page 2 5. All construction activities that disturb more than five (5) acres will be required to obtain • a stormwater discharge permit from the,Colorado Department of Health, Water Quality Control Division. 6. The following note shall be placed on the plat: a. Any construction in the flood plain shall require a flood hazard development permit to be applied for and approved by the Department of Planning Services, prior to the issuance of any building permits. 7. An individual sewage disposal system, is required for the proposed facility and shall be installed according to the Weld County Individual Sewage Disposal Regulations. 8. The septic system(s) is required to be designed by a Colorado Registered Professional Engineer according to the Weld County Individual Sewage Disposal Regulations. 961''?28 SITE SPECIFIC DEVELOPMENT PLAN SPECIAL REVIEW PERMIT DEVELOPMENT STANDARDS Preston Christian Ranch, c/o Ellen Korthuis USR-1090 1. The Site Specific Development Plan and Special Review permit is for a private school, church and multiple dwelling units in the A (Agricultural) zone district as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated hereon. 2. Approval of this plan may create a vested property right pursuant to Section 90 of the Weld County Zoning Ordinance, as amended. 3. All construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 4, The property owner or operator shall be responsible for complying with the Design Standards of Section 24.5 of the Weld County Zoning Ordinance, as amended. 5. The property owner or operator shall be responsible for complying with the Operation Standards of Section 24.6 of the Weld County Zoning Ordinance, as amended. 6. All liquid and solid wastes shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 7. No permanent disposal of wastes shall be permitted at this site. 8. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. 9. Fugitive dust shall be controlled on this site. 10. The maximum permissible noise level shall not exceed the residential limit of 55 db(A) as measured according to 25-12-102, Colorado Revised Statutes. 961'1.23 DEVELOPMENT STANDARDS, USR-1090 Preston Christian Ranch, c/o Ellen Korthuis Page 2 11. Any existing septic system(s) which is not currently permitted through the Weld County Health Department will require an I.S.D.S. Evaluation prior to the issuance of the required septic permit(s). In the event the system(s) is,found to be inadequate, the system(s) must be brought into compliance with current I.S.D.S. regulations. 12. All pesticides, fertilizer, and other potentially hazardous chemicals must be stored and handled in a safe manner. Reference 25-8-205.5 Colorado Water Quality Control Act and Rules and Regulations thereof. 13. Any construction in the flood plain will require a flood hazard development permit. 14. Personnel from the Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to ensure the activities carried out on the property comply with the Development Standards stated hereon and all applicable Weld County Regulations. 15. The Special Review area shall be limited to the plans shown hereon and governed by the foregoing Standards and all applicable Weld County Regulations. Major changes from the plans or Development Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes form the plans or Development Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 16. The property owner or operator shall be responsible for complying with all of the foregoing Development Standards.
