The Weld County Council met in regular session in full conformity with the Weld County Home Rule Charter at Weld Centennial Center, 915 10th Street, Greeley, CO Tuesday, January 5, 1999, 6:30 p.m.. ROLL CALL: The meeting was called to order by acting-President Judy Curtis. Vice President Dan Oster, Councilman Dwaine Kurtz, Councilman Rob Masden and Councilman Al Roberts were present, constituting a quorum of the members. Also present: Ralph Campbell, Pamela Malcom, Dan Post, Nels Nelson, and the Council secretary Bev Thomas. Plaques of appreciation of service were presented to retiring Council members Pam Malcom and Ralph Campbell. ELECTION OF OFFICERS: Councilman Roberts nominated Councilman Dan Oster for Council President. There was no second before Councilman Dwaine Kurtz nominated Councilwoman Judy Curtis as interim Council President. Councilman Rob Masden seconded the nomination for Councilwoman Judy Curtis to be interim Council President. The motion was defeated. Councilman Al Roberts nominated Councilman Dan Oster for Council President. Acting-President Judy Curtis seconded the motion. The motion carried. President Dan Oster opened the floor for nominations for Council Vice President. Councilman Dwaine Kurtz nominated Rob Masden for Council Vice President. Councilman Rob Masden seconded the motion. The motion failed. Councilman Rob Masden nominated Councilman Dwaine Kurtz for Vice President of the Council. Councilman Dwaine Kurtz seconded the motion. The motion failed. Councilwoman Judy Curtis nominated Councilman Al Roberts for Vice President. President Dan Oster seconded the motion and the motion carried. APPROVAL OF RESOLUTIONS 123 AND 124: President Dan Oster read aloud Council Resolution 123 thanking Ralph Campbell for his service on the Weld County Council. Councilman Dwaine Kurtz made a motion to adopt Resolution Number 123. Vice President Al Roberts seconded the motion and it carried unanimously. President Dan Oster read aloud Resolution 124. Vice President Al Roberts made a motion to adopt Resolution Number 124 thanking Pamela Malcom for her service on the Weld County Council. Councilman Rob Masden seconded the motion and it carried unanimously. OD Pr 46- /qq 61 C '3 990414 Weld County Council Minutes January 5, 1999-Page 2 of 4 PUBLIC COMMENT: Greeley Attorney Dan Post reiterated his desire for information from Weld County regarding its lease with Winona's. He said that he felt that the information he was requesting was public information and that his clients did not want to have to go to court to find out more about Winona's lease. Mr. Post stated that he was under the impression that he could not appear at a County Commissioners' meeting to talk about the Winona's matter without identifying his clients. He said that his clients believe that Winona's is being subsidized by Weld County and that is illegal. Mr. Post said that his most pressing concern was the non response of Weld County to his inquiries. He said that an honest explanation from Weld County explaining why the fair market value of the space occupied by Winona's is less than other downtown Greeley rental space would satisfy his clients. APPROVAL OF MINUTES: Vice President Al Roberts made a motion to approve the December 15, 1998 meeting minutes. Councilwoman Judy Curtis seconded the motion and it was approved unanimously. APPROVAL OF FOURTH QUARTER REPORT TO THE PEOPLE: Councilman Dwaine Kurtz made a motion to approve the 1998 fourth quarter Report to the People. Vice President Al Roberts seconded the motion and it was approved unanimously. APPOINTMENTS: Councilman Rob Masden and Vice President Al Roberts said that they would attend the January 11 elected officials meeting. CORRESPONDENCE: The Council reviewed the correspondence. COORDINATOR REPORTS: Social Services Grievance Board Councilwoman Judy Curtis reported that the Weld County Social Services Grievance Board had not met since its inception. Secretarial Research Requests Council members discussed how secretarial research requests would be handled. It was agreed that members would address requests directly to Council secretary Bev Thomas and as needed she would confer with the Council President about them. Vice President Al Roberts requested that when letters are received from County Attorney Bruce Barker copies be sent to each Council member. Weld County Finance Corporation Last Meeting Date Councilwoman Judy Curtis reported that there has been no Weld County Finance Corporation Board of Directors meetings since her previous report. Weld County Council Minutes January 5, 1999-Page 3 of 4 Midtown Materials Vice President Al Roberts reported that Sharon Hopper had said that there would be a violation hearing regarding Midtown Materials on January 12, 1999. Councilman Roberts has been unable to confirm this date with Planning Department personnel. Downtown Parking Councilman Dwaine Kurtz made a motion that downtown parking be deleted from the agenda. Councilwoman Judy Curtis seconded the motion and it carried. UNFINISHED BUSINESS: Weld County Council District I Councilman Vacancy The Council discussed the procedure for filling Weld County Council District I Councilman vacancy as per instructions from County Attorney Bruce Barker. It was noted that the Council had advertised that applications for the vacancy would be received until 5:00 p.m. January 5, 1999. The Council had received six applications. Councilman Roberts will verify with Weld County Election Department that all applicants are viable candidates. The Council reviewed interview questions that were in the Council's files. Council members compiled the list of questions that they wanted to use in the interview project. Councilman Dwaine Kurtz made a motion that questions seven, eight, nine, and ten be struck from the proposed question list. There was no second to the motion. Councilman Dwaine Kurtz made a motion that questions eight, nine, and ten be deleted. Councilman Rob Masden seconded the motion and the motion carried. Vice President Al Roberts made a motion to delete question fourteen. Councilwoman Judy Curtis seconded the motion and it carried. The Council agreed to the list of questions entitled: Interview Questions for District I Councilman Candidates 1/99. Councilwoman Judy Curtis made a motion that half hour interviews begin at 6:00 p.m. Thursday, January 7 with District I Councilman candidates at the Weld County Centennial Center. Councilman Rob Masden seconded the motion and it carried. Councilman Roberts will schedule the candidates in alphabetical order. NEW BUSINESS: Council Meeting Dates for 1999 Councilman Dwaine Kurtz made a motion that the Weld County Council meet on the third Tuesday of February, February 16, 1999, at the Weld County Centennial Center. Councilman Rob Masden seconded the motion and it carried. Councilman Dwaine Kurtz made a motion that the Council meet on the third Tuesday of the month in 1999 and that the Council meetings be at 6:30 p.m. in Greeley, or at 7:00 p.m. at Council 9Q�'t/J/ Weld County Council Minutes January 5, 1999-Page 4 of 4 meetings held out of Greeley. Councilman Rob Masden seconded the motion and it carried. Coordinator Assignments The Council agreed to the following Coordinators' assignments: Councilwoman Judy Curtis - Department of Health Services Councilman Dwaine Kurtz - Department of Human Services Councilman Rob Masden - Department of Public Works President Dan Oster - Department of Finance, Central Purchasing, and Personnel Vice President Al Roberts - Department of Planning Services. Payment of the Bills: Councilman Roberts made a motion to pay the following bills: Mileage for Councilwoman Judy Curtis $23.22 Reimbursement for Meals Councilwoman Judy Curtis $ 76.41 Mileage for Councilman Dan Oster $21.60 Mileage for Councilman Al Roberts $ 14.04 Councilwoman Judy Curtis seconded the motion and it carried unanimously. The Council will meet to consider additional information it has received relevant to a letter from Commissioner Glenn Vaad regarding a potential conflict of interest. The Council will be reconsidering its action taken on the letter at its February 16 meeting. Weld County citizens are welcome to attend Weld County Council meetings to discuss ideas or concerns regarding Weld County government. RE: Regular 1999 Meetings of the Weld County Council WHEREAS, Section 13-4-(3) of the Weld County Home Rule Charter specifies that regular meetings of the Council shall be held at least monthly on a day or days to be determined by the Council by Resolution: NOW, THEREFORE, BE IT RESOLVED, that the regular meetings of the Weld County Council shall be held the third Tuesday of each month during the calendar year of 1999 unless an appropriate notice of change has been written and posted in the Board of County Commissioners' offices and notice given to all Council members as required in the Rules of Procedure for the Weld County Council. ROLL CALL: The meeting was called to order by President Dan Oster. Vice President Al Roberts, Councilman Dwaine Kurtz, Councilman Rob Masden and Councilwoman Judy Curtis were present, constituting a quorum of the members. Also present: Mike Danielson, Paul Farrer, Keith McIntyre, Nels Nelson, Annie Nelson, Caleb Nelson, Annika Nelson, Seth Nelson, Evangeline Nelson, Joyce Smock, and Mike Willits. President Dan Oster stated that the meeting's purpose was to interview candidates to fill the Weld County Council District I Councilman vacancy. The Council interviewed candidates in the following order: Keith McIntyre, Nels Nelson, Paul Farrer, Michael Danielson, Joyce Smock, and Michael Willits. The Council discussed the criteria for choosing candidates and the strengths of the various candidates. Councilman Dwaine Kurtz made a motion that Joyce Smock be appointed to the Weld County Council for District I. Councilwoman Judy Curtis seconded the motion. The motion carried unanimously. President Dan Oster declared Joyce Smock the Councilwoman for District I. Council members signed Resolutions 123 and 124.
