RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH
LEGAL ACTION AGAINST VERA GLENDENING FOR VIOLATION OF THE WELD
COUNTY ZONING ORDINANCE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Vera Glendening, VI #9700109, is allegedly in violation of the Weld County
Zoning Ordinance, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 9th day of September, 1997, a public hearing was held before the
Board of County Commissioners for the purpose of hearing testimony relating to said violation,
and
WHEREAS, Vera Glendening, property owner, was present at said hearing, and
WHEREAS, the Board of County Commissioners deems it advisable to refer said
violation to the Weld County Attorney's Office for legal action, with an instruction for delay of
action upon such referral until December 9, 1997, to allow adequate time for the property owner
to bring the subject property into compliance and for an inspection of the property by the
Department of Planning Services staff.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that said violation be, and hereby is, referred to the Weld County
Attorney's Office for legal action against Vera Glendening to remedy the violation of the Weld
County Zoning Ordinance, and any other persons occupying the properties, any persons
claiming an interest in the properties, and any persons acting in active concert with the
identified parties, with an instruction for delay of action upon such referral until December 9,
1997, to allow adequate time for the property owner to bring the subject property into
compliance.

properties and public rights of way.

Building Code Ordinance. I have scheduled a meeting with the Board of County Commissioners
on September 9, 1997 at 10:00 a.m. to consider the violations occurring on the property. This
meeting will take place in the County Commissioners' Hearing Room, first floor, Weld County
Centennial Center, 915 Tenth Street, Greeley, Colorado. It is recommended that you or a
representative be in attendance to answer any questions the Board of County Commissioners might
have about the violations.
The Department of Planning Services' staff will be recommending that the Board of County
Commissioners authorize the County Attorney to proceed with legal. action to remedy the violation.

Dear Mrs. Glendening:
This letter is in response to your recent telephone calls. I have tried to return your calls but have
not been able to reach you at the number you left with our Secretary. The conversations I have
had with you have been less than constructive and it is my intent that this letter be more
constructive.
As we discussed during our last telephone conversation, the violations concerning your property
involve two departments of county government: Health, and Planning Services. The
malfunctioning individual sewage disposal system is the only major health code violation, but
there are several violations of county building and zoning ordinances. As you know, as a result
of our Health Officer Hearing on June 6, 1997, I issued a Cease and Desist Order on your
property until such time as the system is repaired and functional. Monica Mika Daniels, Director
of Planning Services, indicates that they are also pursuing legal action with regard to the building
and zoning violations.
Our first concern in this issue is you as a Weld County Citizen. It is my sense that you do not
fully understand the nature and the seriousness of these violations. Further, despite all that the
county staff has done to outline and explain corrective action, we do not seem to be able to
communicate this in such a way that you might understand how you can comply with the health,
building and zoning laws. My best advice to you is that you contact an engineer, attorney, or
some other professional to assist you in this matter. County staff would be more than willing to
work with your representative in the resolution of these violations.

A second concern is for our County staff. I am confident that Troy Swain, Jeff Stoll and myself,
have done all that we know to do, to work with you in the resolution of these violations. We
have offered you several options for correction, none of which seem acceptable to you. Again, in
talking with Ms. Daniels, she too feels that Planning Services staff has been more than willing to
work with you. Consequently, we feel that your abusive and harassing telephone calls are
inappropriate. We are indeed public servants, but we are not obliged to accept verbal abuse. We
are advising county staff of this matter, and directing them to discontinue any telephone calls
with you which become verbally abusive, and/or threatening.
Mrs. Glendening, I would like to be of more help to you in this matter, but I am not hopeful that I
can do so given the current lack of communication. Again I encourage you to contact an
engineer, attorney, or other professional to assist you in this matter. I have attached a list of
attorneys for your consideration. In the meantime, if we can be of any further service, please
contact us.

The uses on the above described property are being considered as a zoning violation of Section 31.2 and
31.3.9 of the Weld County Zoning Ordinance. This is not a use allowed by right in the Agricultural zone
district.
The violation can be corrected by removing the noncommercial junkyard from the property or screening
it from all adjacent properties and public rights of way. Current license plates could be obtained for the
derelict vehicles, however they would also need to be in running condition. If screening is to be used to
conceal the noncommercial junkyard, a detailed screening plan must be submitted to and approved by the
Department of Planning Services prior to installation.
It is the intention of this office to assist and cooperate with you without imposing undue hardships;
however, we have no discretion in this matter if you fail to correct this violation. You have 30 (Thirty)
days from July 8, 1997 to correct this zoning violation. Failure to •do so will result in this office
scheduling the violation before the Board of County Commissioners to consider whether to refer the
violation to the County Attorney's office for legal action.
Any information you have that may help to resolve this matter will be helpful. This office is ready to be
