HomeMy WebLinkAbout961136.tiff RESOLUTION RE: APPROVAL OF TEMPORARY PERMIT FOR A TAVERN LIQUOR LICENSE, WITH EXTENDED HOURS, FOR DEEANN WILHELM AND RICHARD WILHELM, DBA FORT 21, AND AUTHORIZE CHAIR TO SIGN WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, DeeAnn Wilhelm and Richard Wilhelm, dba Fort 21, 985 East 18th Street, Greeley, Colorado 80631, presented to the Board of County Commissioners of Weld County, Colorado, an application for a Change of Ownership of a Tavern Liquor License, with extended hours, for the sale of malt, vinous and spirituous liquors for consumption by the drink on the premises only, said License previously held by Rice Enterprises, Inc., dba Fort 21, and WHEREAS,Section 12-47-106.5, C.R.S., which became effective July 1, 1991, allows for the issuance by the Board of County Commissioners of a temporary permit to the transferee of an existing liquor license to authorize the transferee to conduct business and sell alcoholic beverages at retail in accordance with said license, subject to compliance with certain conditions, and WHEREAS,DeeAnn Wilhelm and Richard Wilhelm have complied with all of the conditions set forth in said Section, and WHEREAS, DeeAnn Wilhelm and Richard Wilhelm have also submitted the required application fee for said temporary permit of$100.00. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that having examined said application and other qualifications of the applicant for the transfer of the Tavern Liquor License, with extended hours, and having considered said request for a temporary permit, does hereby grant to DeeAnn Wilhelm and Richard Wilhelm, dba Fort 21, 985 East 18th Street, Greeley, Colorado 80631, a Temporary Permit to conduct business and sell malt, vinous and spirituous liquors for consumption by the drink on the premises only, at retail at said location in accordance with the license previously held by Rice Enterprises, Inc., dba Fort 21, subject to all other rules and regulations set forth by the Board of County Commissioners of Weld County, Colorado, for a period of 120 days, or until such time as the application for Change of Ownership is approved by the State of Colorado, whichever shall occur first. PLEASE POST NEAR EXISTING LICENSE June 24, 1996 TO WHOM IT MAY CONCERN: On the 24th day of June, 1996, the Board of County Commissioners of Weld County, Colorado, did approve the Change of Ownership request of DeeAnn Wilhelm and Richard Wilhelm, dba Fort 21, for a Tavern Liquor License, with extended hours, with said license previously being held by Rice Enterprises, Inc., dba Fort 21, and expiring on April 2, 1997. The required documents for the Change of Ownership have been submitted to the State Department of Revenue for its • approval. Until notification has been received from the State advising whether this Change of Ownership request has been approved or disapproved, the Board hereby authorizes the continued sale of malt, vinous, and spirituous liquor at this establishment which is located at 985 East 18th Street, Greeley, Colorado 80631, under a Temporary Permit which has been approved by the Board. This Temporary Permit allows DeeAnn Wilhelm and Richard Wilhelm, dba Fort 21, to conduct business and sell malt, vinous and spirituous liquors for consumption by the drink on the premises only, at retail at said location in accordance with the license previously held by Rice Enterprises, Inc., dba Fort 21, subject to all other rules and regulations set forth by the Board of County Commissioners of Weld County, Colorado, for a period of 120 days, or until such time as the application for Change of Ownership is approved by the State of Colorado, whichever shall occur first.
