RESOLUTION
RE: ACTION OF BOARD CONCERNING PRO AND CON STATEMENTS REGARDING
NOVEMBER, 1996, GENERAL ELECTION BALLOT TITLE #1A -THE VILLA AT
GREELEY, INC.
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, on August 19, 1996, the Board of County Commissioners set a ballot title
for the November, 1996, general election in response to the request by John T. Coppom, for
The Villa at Greeley, Inc., concerning the siting and location of correctional or detention facilities
as required by the Weld County Home Rule Charter, which ballot title is designated as "#1K,
and
WHEREAS, prior to October 9, 1996, the Board of County Commissioners received
from proponents and opponents various proposed statements (denominated herein as the "pro"
and "con" statements) regarding said ballot title for the purpose of including said statements in
the County's election notice package, and
WHEREAS, said pro and con statements have been summarized as shown in the
attached Exhibits "A" and "B", respectively, and
WHEREAS, at the Board's regular meeting on October 14, 1996, Michael Brand,
Corrections Director for The Villa at Greeley, Inc., presented oral comments indicating that the
con statements as submitted and the summary thereof(Exhibit "A") are factually incorrect and
asked the Board to publish the election notice package without including therein the con
statements, and
WHEREAS, after hearing Mr. Brand's comments, the Board deemed it advisable to
continue the "New Business" portion of the regular meeting to October 15, 1996, at 9:00 a.m.,
and
WHEREAS, at said meeting on October 15, 1996, the Board heard testimony from
various individuals and from Mr. Brand for the purpose of determining if it should refrain from
including the pro and con statements in the County's election notice package.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County that the pro and con statements submitted to the Board regarding Ballot Title #1A
for the November, 1996, general election, which have been summarized as set forth in the
attached Exhibits "A" and "B", shall be published in the County's election notice package and
the Weld County Clerk and Recorder is hereby instructed to include said statements in said
package.

The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 15th day of October, A.D., 1996.
