Health Department COLORADO• CASE NO.: USR-1226 NAME: Terra Holdings Environmental Proteclion Services has reviewed this proposal; the following conditions are recommended to be part of any approval: 1) All liquid and solid wastes(as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-101, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2) No permanent disposal of wastes shall be permitted at this site. 3) Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. 4) The maximum permissible noise level shall not exceed the commercial limit of 60 db(A) as measured according to 25-12-102, Colorado Revised Statutes. 5) Adequate toilet facilities shall be provided for the public and employees. 6) An individual sewage disposal system is required for the proposed office facility and shall be installed according to the Weld County Individual Sewage Disposal Regulations. The septic system is required to be designed by a Colorado Registered Professional Engineer according to the Weld County Individual Sewage Disposal Regulations. 7) The facility shall utilize the existing well. This project falls primarily under the purview of the Weld County Use By Special Review Standards. Our requirements are as follows: 1. Access: This site is located in the County but will gain access from Walnut Street which is located within the Le Salle City Limits. A. Please send a referral to the Town of LaSalle for any access requirements. B. The main access to the facility appears to accommodate the residence/office facilities. The proposed 20-foot ingress/egress access point would accommodate heavy equipment traffic but this is not a part of the USR portion of the application. Terra Holdings also owns the adjacent property that will be affected by this access. The applicant shall identify, on the plat, the appropriate documentation for the easement. C. The commercial access shall be a minimum of 24 feet wide to accommodate two-way traffic according to the Commercial Access Road Standard, Appendix "B," Ordinance 180, Access Sketch #1. 2. Off-Street Parking: There is adequate parking for the employees and equipment on the five-acre site which consists of adequate gravel base. I would recommend that some dust suppressant be placed on the north access as a courtesy to the neighbors to the north. 3. Storm Water Drainage: The storm water runoff does not appear to be a problem. The site is flat with a granular surface for drainage. Terra Holdings is retaining ownership of the parcels to the north and east. The southern parcel is separated by an irrigation ditch. 4. Noxious Weeds: Pursuant to Ordinance 169A, if noxious weeds exist on the property or become established 35 a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds Weld County Planning Dept. cc: USR-1228 MAR 26 1999 plan5 RECEIVED y EXHIBIT From: SHEBLE MCCONNELLOGUE To: ejerman Date: 4/19/99 9:13am Subject: Terra Holdings Today a concerned neighbor came into our office about USR-1226. He stated that oil drips off the rigs. I have an appointment today at 1:30 at the site to evaluate this complaint. The applicant, Andy said they change oil and have an oil drum in the office they ultimately will use in an oil burner but that a company comes to pick it up occasionally. I think we should add another condition: Prior to recording the plat, the applicant shall submit a waste handling plan to the Environmental Health Services Division of the Weld County Health Department. The plan shall include at a minimum, the following: 1) A lis': of wastes which are expected to be generated on site(this should include expected volumes and types of waste generated). 2) A lis:of the type and volume of chemicals expected to be stored on site. 3) The waste handler and facility where the waste will be disposed (including the facility name, address, and phone number).
