RESOLUTION
WHEREAS , a public hearing was held on Wednesday, May 7, 1969 at
2:00 P.M. in the chambers of the Board of County Commissioners of Weld
County, Colorado for the purpose of hearing a petition of John Willard, Route
1, Box 182, Brighton, Colorado, requesting a change of zone from "A" Agri-
cultural District to "I" Industrial District, and
and
WHEREAS, the petitioner was present in person, and
WHEREAS, there was no one present in opposition to the change of zone,
WHEREAS, the Board of County Commissioners heard all the testimony
and statements of those present, and
WHEREAS, the Board of County Commissioners has studied the request
of the petitioner and studied the recommendation of the Weld County Planning
Commission as submitted on March 7, 1969, and having fully informed;
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS that the petition of John Willard for a change of zone from
"A" Agricultural District to "I" Industrial District, said area being more par-
ticularly described as follows:
A tract of land located in the Northeast Quarter (NE4) of
the Northeast Quarter (NE4) of Section 34, Township 1
North, Range 66 West of the 6th P. M. , Weld County, Colo-
rado, more particularly described as follows: Beginning at
the Northeast corner of said Section 34, thence south 30 feet
to the true point of beginning; thence south 1200 feet; thence
west 600 feet; thence north 1200 feet; thence east 600 feet to
the true point of beginning, containing 16. 527 acres more or
less, and
is hereby granted under the conditions following:
1. Any water and sanitation facilities to be installed shall be approved
by the State Health Department.
2. All applicable subdivision regulations, and zoning regulations shall
be followed and complied with to the satisfaction of the Board of County Com-
missioners, Weld County, Colorado.

Marshall Anderson: We will call this hearing to order, the hearing as requested
by John Willard of Route 1 Box 182, Brighton, Colorado. The hearing date to
be May 7, 1969 at the hour of 2:00 P. M. a Change of Zone from Agriculture
District to Industrial District. Mr. Telep would you like to make an
opening statement.
Mr. Telep: Thank you Mr. Chairman, Let the record show that this cause
came on for a hearing this day, May 7, 1969 at 2:00 P. M. for a Change of
Zone pursuant to a petition of John Willard of Route 1 Box 182, Brighton,
Colorado, concerning a Change of zone from "A" Agriculture District to
"I" Industrial District of a tract of land located in the Northeast
Quarter of the Northeast Quarter of Section 34, Township 1, North,
Range 66 West of the 6th P. M., Weld County, Colorado and more particularly
described in metes and bounds as was published and as is required by law.
on April 4th and April 25th 1969, in the Greeley Booster.
We would like the record to further show that the applicant
is present in person, namely John Willard. I would like the record to
further show that there is on file a resolution of the Weld County Planning
Commission dated March 7, 1969 recommending favorably this request for a
Change of Zone. In addition a recommendation approving the site for a
packing and slaughter house, which is not before the Commissioners at this
time. Mr. Chariman I think it is in order to hear the applicant, who is
present to testify in his own behalf in favor of the request for a zone
change.
Mr. Anderson: Alright, Mr. Willard if you will state your name for the
record.
Mr. Willard: I am John W. Wilkrd of Brighton, about all I have to show you
is the answers that the Planning Board asked me I think that would be applicable
to what you have to ask me also. I have some copies of those or you can read
them off.
Mr. Telep: Why don't you just tell the Board, Mr. Willard, in your own
words why you made this request.
Mr. Willard: I think the location is a good location. In the first place there
is thirty-five feet of sand in this area with a real good water supply but it
is deep water, 225 feet is the water level, good soft potable water and there
is no surface water or ditch or table to contaminate. It is on a well traveled
Toad and I think it would be of benefit to our area of the county.
Mr. Anderson: John, what about the roads.
Mr. Willard: Well I think it is County Road Number 4, isn't it. Yes County
Road Number 4, you probably know where that is right above Kitayama's,
everyone knows where Kitayama's is located. About a mile above them.
Mr. Anderson: Its going to be up there on John Dyers place?
Mr. Willard: No its our place.
Mr. Anderson: Is it the next place east of where Don is going to put that airport
Mr. Willard: Yes ----
Mr. Anderson: Don has that section there by the ditch.
Mr. Willard: Yes, that is County Road Number 4 that he was thinking about
going across. This is across the road on the south side.
Mr. Anderson: Where the ditch meanders around ---
Mr. Willard: Yes, it is up above the ditch, you know where you cut the new
road through, three years ago, our corner starts there and then this plant
site is a mile - see we've got a mile of property on the right hand south
side of the road, and it is in the Northeast corner of that.
Mr. Anderson: Where that grass farm is, is that grass farm yours?
Mr. Willard: Yes, well it is just in prairie now.
Mr. Anderson: Yes, but it is in that section
Mr. Willard: Yes, it is just a mile from the corner from County Road 4
and the new road whatever you call it - its a mile up from County 4 in that
corner. Across from where those people are taking advantage of those people
for a dump site. I thought it would also help keep people out of there

Mr. Willard: It is quite high there, there is one higher nob inbetween
well between there and our mail box. It is right directly west of where
-Public Service turns north.
Mr. Anderson: You don't have any neighbors out there
Mr. Willard: No, they are making a subdivision on east there about another
half of a mile - right away - they have cut the road in. Is there anything
_else you are particularly interested in ?
Mr. Anderson: I think I know where you are at and what you are planning to do
Mr. Willard: It will be a government inspected installation.
Mr.Anderson: It will be health department approved or government approved?
Mr. Willards: It will be Weld County Health Department approved as far as
the septic system or whatever, then the inspection, the plant itself will
be under federal. I am going to request federal inspection.
Mr. Anderson: Barney, lets hear from you.
Mr. Elgin: Well I have been out on the site, I know of no reason why
there should be objections to it and so far as I know there have been no
objections logged with the Commission at any time regarding this.
Mr. Anderson: I don't know how you can be any farther away and still be
in Weld County and away from everybody else.
Mr. Willard: We -have been forgotten for a long time down there.
Mr. Anderson: Is there anyone in this room oposing this application?
Let the record there is no-one present objecting the hearing.
Mr. Billings: Mr. Chairman, I move that we approve the request for the zone
change from "A" Agricultural District to "I" Industrial District as per the
request of Mr. John Willard, of Route 1 Box 182, Brighton, Colorado.
Harold Anderson: I will second the motion.
Marshall Anderson: I will make it unanimous. Motion carried.

Mr. Telep: May I call your attention to the fact that while you have
agreed that this zone would be changed there is still another question
before this Board. That is to the approval of the site which has to be
done by this Board, as long as you are in ser>sion, I was wondering if
you would like to entertain it at this time because it will take another
and separate resolution. It is one thing to change the zone, to have this
type of business in this zone area, then you need an approval as to location
from this Board. What is the Board's pleasure?
Mr. Billings: I so move.
Harold Anderson: Seconded.
Marshall Anderson: I will make it unanimous.
