Box 758 CO, 80632-0758 Dear Dale: I am writing to update you on the status of Workforce Development Council recommendations for implementing the Workforce Investment Act. The Council committees have finalize several recommendations, (copy attached), and will consider additional matters during the October 28, 1999, meeting. The full Council is expected to approve the committee recommendations. Designation of Workforce Areas The committee recommends the Governor designate a statewide workforce investment area operated under authority of local control with the existing 18 one-stop implementation areas designated as local service delivery areas (LSDA). If arty unit of local government specified in §116 (a) (2), (3) demands to be designated as a separate federal area, then the Governor should designate the remaining part of the state as a federal workforce investment area consortium of LSDAs. Background The Council received several requests from local elected officials and the recommendation from CCI, Inc., for the Governor to designate a statewide workforce area with LSDAs. The purpose for a statewide designation was to establish a consortium of LSDAs, which would provide local elected officials overseeing one-stop implementation areas: • The ability to seek designation of the existing one-stop implementation area as a LSDDA and thus enabling the local workforce board to remain the policy, SS F/ CA 992669 afficit99 Dale Hall, Letter October 22, 1999 Page 2 planning, oversight entity for the area, even in small population areas where federal area designation may not be possible. • Needed.flexibility in appointing representatives to the local workforce board. • An equitable allocation of the WIA Title I youth and adult worker grant to serve youth and adults in the LSDA. • Greater local control and flexibility than may be authorized under the WIA, including the ability to modify both federal area and LSDAs, annually. • Greater opportunities to compete for federal workforce development and youth grants through participation as a consortium of LSDAs. At the present time, the Governor has received notice from the City and County of Denver requesting a separate federal area designation. Assuming no other presumptive area demands to be designated a separate federal area, the other 17 one-stop implementation areas will be included as part of a. separate federal area comprising the consortium of LSDAs. The designated consortium area must meet three basic requirements: • The consortium area LEOs must appoint an official local workforce board.. • A consolidated local plan must be submitted to the Council. • Negotiated performance standards must be met for the area, collectively. How does the recommended consortium area affect your One-Stop area? Your present one-stop implementation area will be designated a LSDA, unless you request another permissible designation, and your area will receive an equitable WIA Title I youth, adult worker and dislocated worker allocation. You will need to: • Submit a 5-year plan for the area identifying how all the WIA partners and other partners will participate to produce a viable one-stop center for the LSDA, developed by the LSDA workforce board, with your concurrence. • Appoint a workforce board for your LSDA, which meets the minimum criteria established for an LSDA workforce board. • Join with your fellow LEOs to establish the recognized LEO for the federal designated area representing the consortium of LSDAs that will appoint the recognized workforce board for the federal designated area representing the consortium of LSDAs. Dale Hall, Letter October 22, 1999 Page 3 WIA Title I Grant Allocation A Council allocation workgroup comprised of SDA directors and a CCI, Inc. committee held several meetings throughout the summer to develop an equitable formula for allocating the youth and adult worker portion of the WIA grant to the 18 one-stop implement areas. This effort was required because the congressional allocation formula was not suitable for Colorado's current labor market conditions and would not provide sufficient resources for at least one-third of the implementation areas to meet the needs of area youth and adults. These efforts resulted in nearly identical allocation formulas. The Council applauds the SDA directors and CCI for their hard work to develop a consensus allocation formula for all 18 one-stop implementation areas. The ability of diverse interests to arrive at an equitable statewide allocation through collaboration places Colorado, its local elected officials and its service professionals in a unique position compared to all other states. The committee has endorsed the CCI recommended statewide youth and adult allocation formulas, which are attached. Because Denver has requested a separate area, the committee recommends the Governor select an alternative WIA youth and adult worker allocation formula that most closely matches the recommended statewide youth and adult allocations. What will be the WIA Title I allocation for your LSDA? The final youth and adult worker allocation to areas, including the area comprising the consortium of LSDAs, cannot be predicted with certainty and depends on a new, required ASU calculation, changes to the level of unemployment throughout the state and whether another unit of local government demands a separate federal designated area. Accordingly, for initial planning purposes, I would suggest your workforce board develop a plan based on 90% of the recommended youth and adult worker allocation for your area. Local Board Membership The Council committee is scheduled to finalize local workforce board membership criteria at the October 28, 1999, meeting. As you may know, the WIA minimum local workforce board composition for a federal designated area could require the appointment of up to 55 individuals. The recommended criteria for a LSDA board will allow you flexibility to establish a much smaller board. Dale Hall, Letter October 22, 1999 Page 4 The committee recommends the LEO appointing the local workforce board for the area comprising the consortium of LSDAs appoint individuals from the LSDA boards and the Council. LEO Responsibility You will receive in a few days a 20-minute videotape, which discusses LEO responsibility under the WIA. Additional assistance is available upon request. LSDA Local Workforce Investment Plan Your LSDA workforce board should be in the process of developing the local plan for the One-Stop center. The 5-year plan must be made available by February 4, 2000, to the public for comment during a period of 30-day, with a copy of the plan submitted to the Council. Interim planning guidelines are being sent today to your local board chair and SDA director. The final plan, incorporating comments, must be submitted to the Council by March 15, 2000, for final review. We realize developing the local plan in the next 100 days will be a major challenge for you and the board. Many LSDA have accomplished significant integration of the WIA specified federal partner programs during the past two years and should have no difficulty complei:ing a plan. Many best practices at the One-Stops will be highlighted at the upcoming Rocky Mountain Workforce Development Association meeting at Beaver Creek on October 27 - 29, which your Board may find helpful in developing its plan. Bolser Enclosure C: Local Workforce Board Chair SDA Director COLORADO WORKFORCE DEVELOPMENT COUNCIL Subcommittees: WIA Planning and Implementation Grant Allocation October 4, 1999 RECOMMENDATIONS TO THE WORKFORCE DEVELOPMENT COUNCIL. Designation of Workforce Investment Areas The Governor should designate a statewide workforce investment area with the existing18 one-stop local service delivery areas under the Workforce Investment Act, which would operate under a governing structure, authority and responsibilities built around local control, which includes the right of units of local government to request a difference area designation. If a unit of local government (or combinations thereof), identified in §116 (a) (2) or (3) of the Workforce Investment Act, does not want to be part of the statewide area, then the Governor should designate the remaining area of the state as a workforce investment area. If four or more workforce investment areas are designated, the Workforce Development Council should reconsider this recommendation Allocation of Youth and Adult Worker Grants 1. The youth grant should be allocated throughout a statewide workforce investment area to the local service delivery area based 100% on the number of youth in poverty, conditioned on a hold harmless between 90 - 95% and a cap of the previous two year average funding to the local service delivery area. The allocation would be a one year and the allocation formula should be re-evaluated for the second program year. 2. The adult worker grant should be allocated throughout a statewide workforce investment area to local service delivery area based on the adult worker allocation formula recommended by Colorado Counties, Inc., attached. The allocation would be for one year and the allocation formula should be re-evaluated for the second program year. 3. If other area(s) are designated within the state because a unit of local government (or combinations thereof), identified in §116 (a) (2) or (3) of the Workforce Investment Act, request to be designated as a workforce investment area, the Governor should utilize the legally permissible alternative youth and adult worker allocation formula that most closely matches the results of the Workforce Development Council's recommendation to the areas and the local service delivery areas within the balance of the state. Assurance for Local Governance 1. Request the Governor write a letter of assurance addressed to all local elected officials throughout Colorado that they will have the exact same authority under a statewide workforce investment area as they would if their unit of local government was designated as a separate workforce investment area. 2. The committee directed the Workforce Development Council staff to write Mayor Webb requesting his reconsideration of a separate workforce investment area designation for the City and County of Denver. 3. The committee also requested the local elected officials of the El Paso/Teller SDA and the Workforce Board provide the Council recommended provisions for local governance tc resolve concerns expressed by the Workforce Board. Criteria for Appointing Members of the Local Workforce Boards pursuant to §117 (B) (1), Workforce Investment Act. 1. Designated workforce investment area with local service delivery areas (LSDAs) The Governor should establish as criteria for use by the chief elected officials in the designated workforce investment area with LSDAs for appointing members of the local workforce investment board to comply with the minimum membership composition required by §117 (b) (2), Workforce Investment Act, the following: A. Business representatives will be selected first from the business representatives on the Colorado Workforce Development Council, who reside within the workforce investment area, and from the business representatives on the local service delivery area workforce boards. B. The other individuals selected for membership on the local workforce investment board will be first selected from qualified representatives on the local service delivery area workforce boards and from the Colorado Workforce Development Council, who reside within the workforce investment area.
