RE: ACTION OF BOARD AT SHOW CAUSE HEARING CONCERNING SPECIAL REVIEW
PERMIT#650 FOR A GREYHOUND KENNEL -JOEL AND GLORIA KUGLER
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, on April 27, 1998, a Show Cause Hearing was conducted to consider
whether to revoke Special Review Permit#650, issued to Joel and Gloria Kugler, 9158 Weld
County Road 49, Hudson, Colorado 80642, and
WHEREAS, Joel and Gloria Kugler are the owners of the facility located on property
described as part of the N% S'/ SW% of Section 18, Township 2 North, Range 64 West of the
6th P.M., Weld County, Colorado, and
WHEREAS, at said hearing of April 27, 1998, the County Attorney stated all violations
have been closed and Mr. Kugler has submitted a letter requesting Special Review Permit#650
be revoked, and
WHEREAS, after hearing all testimony presented, the Board deemed it advisable to
dismiss the Show Cause Hearing.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the Show Cause Hearing to consider whether to revoke Special
Review Permit#650, issued to Joel and Gloria Kugler, be, and hereby is, dismissed.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 27th day of April, A.D., 1998.

Pursuant to the zoning laws of the State of Colorado and the Weld County Zoning
Ordinance, a public hearing will be held in the Chambers of the Board of County Commissioners
of Weld County, Colorado, Weld County Centennial Center, 915 10th Street, First Floor, Greeley,
Colorado, at the time specified. All persons in any manner interested in the matter are requested
to attend and may be heard.
Should any interested party desire the presence of a court reporter to make a record of the
proceedings, in addition to the taped record which will be kept during the hearing, the Clerk to the
Board's Office shall be advised in writing of such action at least five days prior to the hearing. The
cost of engaging a court reporter shall be borne by the requesting party.

ISSUES: Whether or not the applicant is in compliance with the following:
3. The applicant shall implement the approved revegetation and soil
erosion control plan prior to starting the greyhound kennel operation.
6. The applicant shall comply with the Operation Standards for Uses by
Special Review, Section 24.6 et seq., of the Weld County Zoning
Ordinance.
8. The Use by Special Review area shall be limited to the plans shown
hereon and governed by the Standards as stated above and all
applicable Weld County Regulations. Any material deviations from
the plans and/or Standards as shown or stated above shall require
the approval of an amendment of the Permit by the Weld County
Planning Commission and the Board of County Commissioners
before such changes from the plans and/or Standards are permitted.
Any other changes shall be filed in the office of the Department of
Planning Services.

9. The property owner and/or operator of this operation shall be
responsible for complying with all of the above stated Standards.
Noncompliance with any of the above stated Standards may be
reason for revocation of the Permit by the Board of County

The semi-trailers, mobile home without appropriate permits, and miscellaneous debris are still located on the
property,therefore are a violation of Sections 31.2, 31.2.16, 31.3, 31.3.6, 31.3.9, 31.4, 31.4.18 and 43, of the
Weld County Zoning Ordinance. To bring the property into compliance appropriate permits must be obtained
and the noncommercial junkyard removed from the property or screened from adjacent properties and road
rights-of-way.
The Department of Planning Services also recommends that the County Attorney authorize legal action against
• any other persons occupying the properties, any persons claiming an interest in the properties, and any persons
acting in active concert with the identified parties.

Planning Services, and Property owners: Joel Kugler and Debbie Stednitz
Items discussed:
1. What does Joel want to do with the current USR for the greyhound kennel? He is not
sure but will give us a call by Friday, May 9, 1997 to make a decision. He is leaning toward
vacating the USR for the greyhound kennel.
2. Monica went over the current USR: the development standards, complying with those
standards, the history of the permit, referrals, etc.
3. Semi-trailers-Can they be classified as structures and if so what permits are required.
Use of the semi-trailers is for personal belongings, parts and supplies for trailers and
trucks. Basically, they are used for storage of these items.
-Building permits required for structures (semi-trailers). The chasis may need to be
removed and the semi-trailers may need to be put on a foundation.
4. Trucking business-Not commercial in nature. Joel and Debbie both drive trucks and
the trucks and semi-trailers are for their trucks. They just come and go on the
property.
5. We will pull old building permits for the house. Apparently the house is being used
currently as a duplex. We will investigate this issue further. The use of a duplex is not
allowed in the Agricultural Zone District. The house was built 20-25 years ago.
6. Mobile homes: There are two mobile homes on the property. Both are being used as
accessory structures for storage in connection with the kennel. We will research building
permits for the mobile homes also.
Options:
A. Vacate USR-650 and bring the property into compliance with the Weld County Zoning
Ordinance.
B. Amend USR-650 and include all new uses on the property. Bring the property into
compliance with all new Development Standards and the Weld County Zoning Ordinance.
C. Keep USR-650 and bring the property into compliance with the Operational Standards
of the USR and the Weld County Zoning Ordinance.

Notice is hereby given that on August 13, 19,6,at 9:00 a.m.,or as soon thereafter as the agenda of the Board
of County Commissioners permits, the Board of County Commissioners of Weld County will hold a
Probable Cause public hearing pursuant to Section 81 of the Weld County Zoning Ordinance. This meeting
will take place in the Commissioner's Hearing Room, Weld County Centennial Center, 915 Tenth Street,
Greeley,Colorado.
The purpose of this public hearing will be to review case number ZCH97-001, for compliance with the
Development Standards as approved by the Board of County Commissioners on September 23, 1984, to
determine if probable cause exists to hold a hearing on revocation of USR-650.
Inspection by representatives of this office have identified that you are not in compliance with Development
Standards#I, 3, 5,6, 8 and 9 of USR-650.
If it is determined at the public hearing that there is probable cause that you are not in compliance with
Development Standards the Board of County Commissioners will schedule a Show Cause public hearing to

It has come to the attention of the Department of Planning Services that you may not be in
compliance with the Development Standards for USR-650, approved by the Board of County
Commissioners on August 6, 1996. The noncompliance is with Development Standards #1, 3, 5,
6, 8 and 9. A copy of these items from the approved resolution are enclosed.
The Use by Special Review area must be brought into compliance with the Development Standards
within five days of this letter. Noncompliance will result in our office scheduling,a Probable Cause
Hearing before the Board of County Commissioners. If the Board determines there is sufficient
probable cause to warrant further action, a Show Cause Hearing will be scheduled to consider
revocation of the Use by Special Review Permit.
Please call a Current Planner within five working days of the date of this letter to review the

The property was inspected due to a complaint that the above described was in violation of the
Weld County Zoning Ordinance and the Operation Standards of USR-650. There are several
derelict vehicles, semi-trailers, tires, miscellaneous debris and a mobile home without the
appropriate permits. The condition of the property is also in disrepair; including vegetation and soil
erosion problems.
Site Specific Development Plan and Special Review Permit#650 is for a Greyhound Kennel and
had specific operational standards for the operation of the facility. The current uses on the property
are not in compliance with Development Standards #1, 3, 5, 6, 8 and 9 as listed below and of
Sections 31.2, 31.2.16, 31.3, 31.3.6, 31.3.9, 31.4, 31.4.18 and 43 of the Weld County Zoning
Ordinance.
1. The uses permitted shall be a kennel facility for a maximum of one hundred fifty (150)
greyhounds as submitted in the application materials on file in the Department of Planning
Services.
The site is being used for other uses not included in the Special Review Permit. There is a semi-
trailer storage facility located on the property, a noncommercial junkyard and a mobile home
without the appropriate permits.
3. The applicant shall implement the approved revegetation and soil erosion control plan prior to
'starting the greyhound kennel operation.
The revegatation and soil erosion plans have not been maintained on the property.
5. The applicant shall comply with the design standards for the Use by Special Review, Section
24.5 et seq., of the Weld County Zoning Ordinance.
The property is not in compliance with the design standards for the Use by Special Review Permit.
6. The applicant shall comply with the Operation Standards for the Uses by Special Review,
Section 24.6 et seq., of the Weld County Zoning Ordinance.
The property is not in compliance with the operation standards for the Use by Special Review
Permit.
8. The Use by Special Review area shall be limited to the plans shown hereon and governed by
the Standards as stated above and all applicable Weld County Regulations. Any material
deviations from the plans and/or Standards as shown or stated above shall require the approval
of an amendment of the Permit by the Weld County Planning Commission and the Board of County
Commissioners before such changes from the plans and/or Standards are permitted. Any other
changes shall be filed in the office of the Department of Planning Services.
It has been observed by the Department of Planning Services that the property has deviated from
the plans and standards of the Permit and is also in violation of several sections of the Weld County
Zoning Ordinance. The inspection showed that there is a semi-trailer storage, a noncommercial
junkyard consisting of derelict vehicles, tires and other miscellaneous items and a mobile home
without the appropriate permits. An amendment of the Special Review Permit or a new Permit has
not been submitted to the Department of Planning Services to address these significant changes
in the use on the property.
9. The property owner and/or operator of this operation shall be responsible for complying with all
of the above stated Standards. Noncompliance with any of the above stated Standards may be
reason for revocation of the Permit by the Board of County Commissioners.
The current property owner is not complying with all of the above stated Operational Standards for
USR-650 at this time.. Standards#1, 3, 5, 6, 8 and 9 are not in compliance.

As i explained briefly,I inherited a very large old' car, tire ., ,
problem when i purchased this property. The previous owners
raised and trained greyhound dogs and they lined 19 fence lines
with old car tires.
I have spent a very large amount of money and time digging these
tires out of the sand and cleaning up the property. ' ;
Now Weld County Zoning has given me notice I have to have them off
the property in 30 days.I am asking for your help in securing a
grant for the disposal of these tires.There are approx. 1200 tires wrF:_
ranging from 13 to 15 inch. They are located at 9158 WCR 49 Hudson, Co.
WCR 49 is also known as Kersey Rd. and 9158 is approx. 2 miles north
of I-76.
I will load, unload,and transport to any site necessary.

This letter is to bring to your attention the condition
of a parcel of property located at 9158 WCR 49 . I am sure this
property is out of compliance with the Weld County Zoning Ord-
inances. Over the last six years that I lived in this area it
has gotten progresively worse. I live directly South of it at
9006 WCR49 . The pictures I have provided will verify my comp-
laints in this letter. The property because of the condition
it is in is an eyesore and is detrimental to the property values
in the immediate area. To give you idea how bad this property
really is I will invite any county official respomsible for
code enforcement including the county commissioners to come
and view it from my home. Than you will see that I am not
exaggerating.
When I moved to my current address in 1990 the property
my complaint involves had a house, one or two other buildings,
and approximately six dog runs. In the summer weeds grew along
the dog runs to height of three to five feet. They were unatt-
ractive and presented a fire hazard when they dried out in the
fall. They did provide ground cover and kept the sand from
blowing.
In about 1992 they expanded the number of dog runs. They
stripped the soil they put them on of its natural vegatation.
The exposed sand blew across the fence on the North side of
my property and covered up the grass as well as shrubs I had
planted killing them off. Any trash such as old wire or posts
that accumulated on the property were left to lie where-ever
they were cast aside. Weeds grew up at the edges of the new
dog runs and in the cast aside junk making the place even more
unsightly. Sand continued to blow from the dog runs on to my
property ruining the ground on the South side of my fence.
These dog runs were supposed to be constructed at least
150 feet North of my property line. This is shown on the Special
Review Permit Map which I just recently obtained. These runs
were constructed approximately fifty feet North of my property _
line. This violates the Special Use Map guide lines.

In reviewing the documents with the special use permit,
it is mentioned numerous times that the ground should not be
stripped of its natural cover. If it was, it was recommended
that it be revegetated again. No attempt has ever been made
by the property owner to control wind erosion. Instead every
practice they used accelerated the erosion caused by wind. No
windbreak trees were ever planted and I never saw them re-seed
any area with grass.
In 1996 the property was sold to its present owner. He
immediately moved in semi-trailers,junk cars and trucks. In
addition to the inoperable vehicles, he is running one semi-
tractor with which he brings different trailers onto the proper-
ty at different times and than leaves with the same trailer
again.
He also d&osited old roof trusses, plywood and various
items up against the fence on my North property line. This junk
catches blowing sand from the numerous bare areas on his prop-
erty and allows it to build up on my fence. It will eventually
bury the fence.
I had asog;tistibm
with him and told him that every
place he tore up the grass it would blow and end up on my pro-
perty. As you can see from the pictures provided all of this
is happening. I suggested that he put gravel down on the areas
he cleared off. He did not listen to me.
He will tell you that he is cleaning up the property.
What he did was remove most of the old dog runs. These consis-
ted of old wire, posts, dog houses, and old tires. He took all
these items and placed them in a low spot on his property in
about the middle. What ever fell off on the way back was left
where it fell. He also moved two junked semi-tractors to the
middle of his property along with the other junk. They are not
visible from the highway, but very visible from my kitchen and
living room window. All he did was move a lot of trash and junk
from the West end of his property to about the middle of it.
There is now about two acres of bare sand where he remov-
ed the dog runs. It is blowing onto the North side of my property
covering up my fence, shrubs and grass. Once the grass is covered
with sand it will die. It could take many years to bring it
back to its natural condition.
The property owner called me in the evening on March 28, 1997
and accused me of tilling him into Weld county. This was not
true as the first time I discussed this problem with Weld county
was on that very same day. Someone else had complained about
his property before me. I told him this and that I was in full
agreement with whoever complained and that I had been to Weld -�

county to complain on that very same day. He than made a few
false and degrading statements about me. Than he told me this:
"I know a Black man with about seven or eight kids and I will
sell my place to him. " "Than see what happens to your property
values. " , I took this as a threat. I have a right to live in
peace and quiet on my property without having its value decreased
by a neighbor who cares nothing about the surrounding area and
is willing to break numeruous zoning regulations so he can live
his life style.
This area is made up of small 20 to 40 acre ranches. Most
owners raise a few cattle or horses on their property.
This neighbor at 9158 WCR 49 is the only one in the area
operating a trucking terminal, noncommercial junk yard, dump,
and dog kennel. All of the uses being made of the property
detract from its appearance and cause the surrounding property
values to go down. Also with the exception of the kennel I be-
lieve he is out of compliance with the zoning regulations. The
way in which the kennel has been built and operated has also
detracted from the value of the property. Bare sand, head high
weeds and junk do not add value to the property.
This is what I would like to see done to correct the prob-
lem. If the property is abandoned it should have to be done
before it is allowed to sell. The Special Use Permit should
be revoked permanently. They are not following it. They should
be made to clean up and haul off to the dump all of the junk.
They should also do something to control the blowing sand from
the areas where the natural ground cover has been destroyed.
I have lived next to these people for six years hoping
things would get better. They have continued to get worse. I
will be glad to take time off from work to show you first hand
what I have described here if you care to come over. I will
help in anyway I can.
All I want is my neighbor to the North of me to take care
of his place in the same manner as my other neighbors and myself
do. I hope you can help me with this problem. I would like to
be notified of any hearings on this matter so that I can attend

NOTE
I have mentioned several times in my complaint about blowing
sand from the neighbor' s property blowing on to mine and ruin-
ing it. I want to clarify this. The blowing sand is not harming
all of my property. The damage is occuring on a strip along
the fence on my North property line. I do not want it to appear
that my entire parcel is being destroyed.
