Approved with Conditions
The Department of Planning Services has determined through the review, that the standards of Section
11.4.2.1 through 11.4.2.6 of the Weld County Subdivision Ordinance have been met. This Recorded
Exemption is approved with the following conditions in accordance with information submitted in the
application and the policies of the County.
1. Prior to recording the plat:
A. In accordance with Weld County Public Works Ordinance #180, Lot A and Lot B shall utilize the
existing residential and agricultural access points. No circle drives or additional accesses shall
be granted.
I B. All approved accesses shall be clearly shown on the plat. The applicant shall contact the Weld
County Public Works Department to determine if a culvert is necessary at any approved access

point.
C. WCR 84 is designated on the Transportation Plan Map as a local gravel road, which requires 60 feet of
right-of-way at full build out. There is presently 60 feet of right-of-way. This road is maintained by Weld
County. A total of 30 feet from the centerline of Weld County Road 84 right-of-way shall be delineated on
the plat.
D. WCR 17 is designated on the Transportation Plan Map as a local gravel road, which requires 60 feet of
right-of-way at full build out. There is presently 60 feet of right-of-way. This road is maintained by Weld
County. A total of 30 feet from the centerline of Weld County Road 17 right-of-way shall be delineated on
the plat.
E. The following notes shall be placed on the plat:
1) All proposed or existing structures will or do meet the minimum setback and offset
requirements for the zone district in which the property is located.
2) Any future structures or uses on site must obtain the appropriate zoning and building
permits.
3) Should noxious weeds exist on the property or become established as a result of the
proposed development, the applicant/landowner shall be responsible for controlling the
noxious weeds, pursuant to Ordinance 169A.
4) Prior to the release of building permits on Lot A, or Lot B, the applicant will be required to
submit a recorded deed describing the lot upon which the building permit is requested with
the building permit application. The legal description on such deed shall include the lot and
recorded exemption number.
2. The applicant shall submit a mylar plat to the Department of Planning Services to be recorded in the
office of the Weld County Clerk and Recorder. The plat shall be prepared in accordance with the
requirements of Section 11.7 of the Weld County Subdivision Ordinance. The plat shall be submitted
within sixty (60) days from the date of approval by the Department of Planning Services. The applicant
shall be responsible for paying the recording fees.
3. Planning Staffs approval of this recorded exemption is based upon satisfying the above conditions.
Should an applicant be unwilling or unable to meet any one of these conditions, within 60 days of
approval, then this case will be forwarded to the Board of County Commissioners with a
recommendation for denial.

APPLICATION FOR AMENDMENT OF RECORDED EXEMPTION NO . 1873
DATED JULY 13 , 1999
1 . a . Domestic water for both lots A and B set up by
the recorded exemption in 1996 is supplied with separate
taps by North Weld Count Water District .
b . Irrigation water is available to both parcels
from Cactus Hill Lateral , owned by North Poudre Irrigation
Company from three headgates located on the east boundary
of the property . All fields in both lots A and B have
been irrigated with gated pipe , however , since the
proposed Lot A is 5 acres total , including corrals and
building site , no irrigation is planned for Lot A, other
than from North Weld Water for domestic use . Irrigation
on all fields from underground 8" lines and gated pipe
will continue on Lot B. Adequate drainage and farm
equipment access has been established for all fields
of both proposed lots for many years . Owner owns twenty
shares of North Poudre Irrigation Company water stock .
Water for Lot A could be made available through existing
facilities , and additional water for both lots is
available for lease each year , if required .
2 . Both residences on lots A and B have septic and leach
fields approved by the Health Dept . (attached) .
3 . Virtually all of the acreage is prime irrigated farm
land , with established , highly productive irrigated grass
pastures and alfalfa . Improvements include a large
residence , barn , and corrals on both lots . Permanent
electric fencing , gated irrigation pipe , and access roads
divided the land into six fields for rotational grazing
on Lot B.
4 . The original residence , corrals and barn , 5 acres ,
and established roads will be included in lot A . These
facilities should be useful for a variety of agricultural
or livestock activities . Lot B will include over 98
acres of alfalfa and established pasture , a new insulated
lambing barn , and residence , shop , permanent electric
fencing , field access roads and corrals .
5 . The division and development of the two lots was
determined by the original recorded exemption no . RE-1873 .
An Amended Recorded Exemption 0705-08-1-1873 was approved
November , 1998 with a division of 27-83 acres . However ,
it has become desirable to reserve more land for
agricultural use on Lot B. Therefore this application
for a second amendment is to reduce the 27-83 division
to a 5-106r acre division . This requires a lot line change
to put more land with the facilities where the owners
now live . It is expected that a flock of ewes or other
livestock can be maintained more easily by the present
owners on a larger lot B.

6 . This particular farm has several small hills and
valleys which determine irrigation practices , and field
boundaries , and these features are of major consideration
in the planned division .
7 . All new or approved structures meet the minimum set—
back and offset requirements for the zone district in
which the property is located .

9 . Building sites have been established .
10. The best effort possible is being made to establish
a farm site where a small farm , which is recognized as
a viable farming operation by the Federal and local
Agriculture Departments , can be carried on , the soil
and water rights protected , and the local livestock
industry can be encouraged .
11 . The proposed use has not changed since the original
recorded exemption was granted . The uses are very similar
in size and type to surrounding farms and homes .
12 . Approval of the change in the position of the boundary
line from the line established in the original recorded
exemption will not change or conflict with the intent
of the district or the Weld County Comprehensive Plan .
The area is currently a well—planned area which is
agriculturally oriented . The use of the available
irrigation water will continue . The soil will be
improved , and the land will remain productive .

The Weld County Public Works Department has reviewed this proposal; the following requirements are
recommended to be a part of any approval:
COMMENTS:
WCR 84 is designated on the Transportation Plan Map as a local gravel road which requires 60 feet of right-of-way
at full build out. There is presently 60 feet of right-of-way. This road is maintained by Weld County. Pursuant to
the definition of SETBACK in the Weld County Zoning Ordinance (Ordinance 89, as amended), the required
setback is measured from the future right-of-way line.
