The submitted materials are in compliance with Section 8.2.5 of the Weld County Subdivision Ordinance. 2. The easement has not been used for its intended purpose since the recording of the approved plat. 3. The vacation is compatible with the surrounding area and uses, will be consistent with efficient and orderly development, is consistent with the Weld County Comprehensive Plan, and will not deprive any parcel of adequate access to a public road or street right-of-way. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application of Antonio and Rosalia Corrales for Minor Resubdivision, S # 477 for Vacation of the easement on the hereinabove described parcel of land be, and hereby is, granted subject to the following conditions: 1. The request is to vacate the existing utility easement which runs through Lot 4 of the Zendt's Farm Subdivision, which is owned by Mr. Corrales. The property is located south of and adjacent to East 18th Street, and west of and adjacent to Fern Avenue. No other properties are affected by the vacation of this easement. Based upon the submitted application materials and other relevant information regarding this request, the Department of Planning Services' Staff recommends conditional approval of this request. This determination was based on the following: 1. The submitted materials are in compliance with Section 8.2.5 of the Weld County Subdivision Ordinance. 2. The easement has not been used for its intended purpose since the recording of the approved plat. 3. The vacation would be compatible with the surrounding area and uses, be consistent with efficient and orderly development, is consistent with the Weld County Comprehensive Plan, and would riot deprive any parcel of adequate access to a public road or street right-of-way. Ben explained that the request is to vacate an existing utility easement that runs through the center of the Corrales property, which is no longer used, to allow for the applicant to place a mobile home '.n the center of their property. Access will be off of East 18th Street. Don Carroll asked if(here were currently any utilities located in the easement. Ben stated there were no utilities and that they have been moved. There is a 15-foot easement to be placed on the outside of the lot. Gene Rempel did not feel as though any additional easements along E. 18th Street would be necessary. Gene Rempel moved :0 approve the plat to eliminate the existing easement and that no additional easements be added. Don Carroll seconded. Motion carried unanimously.
