WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute arid the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners held a public hearing on the 7th day of
December, 1998, at the hour of 9:00 a.m. in the Chambers of the Board for the purpose of
hearing the application of Antonio and Rosalia Corrales, 1759 Fern Avenue, Greeley, Colorado
80631, for Minor Resubdivision, S #477 for Vacation of a utility easement on the following
described real esta':e, to-wit:
Lot 4 of Zendt Farm Subdivision, Part of the SE'/ of Section 10,
Township 5 North, Range 65 West of the 6th P.M., Weld County,
Colorado
WHEREAS, said applicant was present, and represented by Rito Gallardo, and
WHEREAS, Section 8.2 of the Weld County Subdivision Ordinance provides standards
for review of said Minor Resubdivision for vacation of easements, and
WHEREAS, the Board of County Commissioners heard all of the testimony and
statements of those present, studied the request of the applicant and the recommendations of
the planning staff and all of the exhibits and evidence presented in this matter and, having been
fully informed, finds that this request shall be approved for the following reasons:
1. The submitted materials are in compliance with Section 8.2.5 of the Weld County
Subdivision Ordinance.
2. The easement has not been used for its intended purpose since the recording of
the approved plat.
3. The vacation is compatible with the surrounding area and uses, will be consistent
with efficient and orderly development, is consistent with the Weld County
Comprehensive Plan, and will not deprive any parcel of adequate access to a
public road or street right-of-way.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the application of Antonio and Rosalia Corrales for Minor
Resubdivision, S # 477 for Vacation of the easement on the hereinabove described parcel of
land be, and hereby is, granted subject to the following conditions:
1. The applicant shall be responsible for submitting a final plat to be recorded in the
office of the Weld County Clerk and Recorder, as well as paying the recording
fee.

Dear Commissioners:
The attached application and submitted materials are concerning a request made by Antonio
Corrales. The request is to vacate the existing utility easement which runs through Lot 4 of the
Zendt's Farm Subdivision, which is owned by Mr. Corrales. The property is located south of and
adjacent to East 18th Street, and west of and adjacent to Fern Avenue. No other properties are
affected by the vacation of this easement.
Based upon the submitted application materials and other relevant information regarding this
request, the Department of Planning Services' Staff recommends conditional approval of this
request.
This determination was based on the following:
1. The submitted materials are in compliance with Section 8.2.5 of the Weld County
Subdivision Ordinance.
2. The easement has not been used for its intended purpose since the recording of the
approved plat.
3. The vacation would be compatible with the surrounding area and uses, be consistent with
efficient and orderly development, is consistent with the Weld County Comprehensive Plan,
and would riot deprive any parcel of adequate access to a public road or street right-of-way.
Conditions of Approval:
1. The applicant shall be responsible for submitting a final plat to be recorded in the
office of the Weld County Clerk and Recorder, as well as paying the recording fee. (Dept.
of Planning Services)
2. A Weld County Septic Permit is required for the proposed home septic system(s) and shall
be installed according to the Weld County Individual Sewage Disposal Regulations.(Health
Department)

Dear Mr. Corrales:
Your application and related materials for the request described above are complete and in order at the
present time. I have scheduled a meeting with the Weld County Board of County Commissioners for
Wednesday, December 2, 1998, at 9:00 a.m. This meeting will take place in Room 101 of the Weld
County Centennial Center, 915 Tenth Street, Greeley, Colorado. In addition, I have scheduled a meeting
with the Weld County Utilities Advisory Committee for Thursday, November 19, 1998, at 10:00 a.m. This
meeting will take place in the Weld Cour.ty Administrative Offices, 1400 N. 17th Avenue, Greeley,
Colorado.
It is the policy of Weld County to refer an application of this nature to any town or municipality lying within
three miles of the property in question or if the property under consideration is located within the
comprehensive planning area of a town or municipality. Therefoie, our office has forwarded a copy of the
submitted malenals to the Greeley Planning Commission for its review and comments. Please call City of
Greeley at 970-S509780, for information regarding the date, time and place of the meeting and the review
process
It is recommended that you and/or a representative be in attendance at each of the meetings described
above i order to answer any questions that might arise with respect tc . Dur application.
A representative from the Department of Planning Services will be out to the property to post a sign
adjacent to and visible from a publicly maintained road right-of-way which identifies the hearing time, date,
and location. In the event the property under consideration is not adjacent to a publicly maintained road
right-of-way, one sign will be posted in the most prominent place on the property and post a second sign
at the point at which the driveway (access drive) intersects a publicly maintained road right-of-way.
The Department of Planning Services' staff will make a recommendation concerning this application to the
Weld County Planning Commission. It is the responsibility of the applicant to contact the Department of
Planning Services office a few days before the date of the hearing to obtain that recommendation.

COMMENTS: Several zoning violations exist in the immediate vicinity, including a
substantial auto junkyard to the east. This is a very poor building site. Setbacks may
be violated with the installation of a mobile or manufactured home. Surrounding
properties are all cluttered with junk and derelict vehicles. The site, itself, slopes
dramatically to the north. A septic system has already been installed on-site, but has
not been re-covered.

We Antonio Corrales and Itosalia Corrales request vacation of a utility easement that crosses the center of our
property known as Lot 4 Ze:ndt's Subdivision Parcel Number 096110403004.
We request the vacation of this easement as we have purchased a mobil home since May and are only waiting for
this vacation request so that we may have our home installed.
The Public Utility Company has sent a letter to the Planning Conunission stating they are vacating such easement
The letter was sent to Mrs Monica by Terry Stencil.
The proposed easement is not adjacent toany other private property. It ends on County Road 45 and an abandoned
County Road.
Included is a Plat for the proposed vacation easement dimensions.

The Weld County Public Works Department has reviewed this proposal for vacation of a utility easement in a minor
subdivision and has the following comments:
1. Utility Board: This item should be scheduled with the Weld County Utility Board as a part of the process
to determine whether the easement should remain or be vacated.
2. Utility Easement: the applicant should verify if the easement is being used.
A. If the easement is being used, the applicant shall contact the user and either relocate or abandon
the utility.
B. The app icant may obtain a letter stating that a building may be placed on the utility.
3. Building Location: A building envelope should be addressed and a Weld County Access Information
Sheet needs to De completed to approve access onto the county road system.

Ben Patton, presentee case S-477. Ben explained that the request is to vacate an existing utility easement
that runs through the center of the Corrales property, which is no longer used, to allow for the applicant to
place a mobile home '.n the center of their property. Access will be off of East 18th Street.
Don Carroll asked if(here were currently any utilities located in the easement. Ben stated there were no
utilities and that they have been moved.
There is a 15-foot easement to be placed on the outside of the lot. Gene Rempel did not feel as though any
additional easements along E. 18th Street would be necessary.
Gene Rempel moved :0 approve the plat to eliminate the existing easement and that no additional easements
be added. Don Carroll seconded. Motion carried unanimously.

residential lots of approximately 2.5 acres each. And a fifth Agricultural lot that will be farmed by the applicant
and which will be buildable. A building envelope has been placed in the northern part of the Ag lot. There
is a 5.3 Acre Open Space Outlot that will not be buildable and will buffer the residential lots from the Ag lot.
