RESOLUTION
RE: GRANT SITE SPECIFIC DEVELOPMENT PLAN AND PLANNED UNIT
DEVELOPMENT (PUD) FINAL PLAN, S #409, FOR AN AIRPARK WITH 39
HANGER LOTS AND ONE RESIDENTIAL LOT WHICH INCLUDES THE
AIRSTRIPS AND CONTROL TOWER - PLATTE VALLEY AIRPARK, C/O
MARILYN TAYLOR
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, a public hearing was held on the 8th day of January, 1997, a.m. for the
purpose of hearing the application of Platte Valley Airpark, c/o Marilyn Taylor, 7505 Weld
County Road 39, Fort Lupton, Colorado 80621, requesting a Site Specific Development Plan
and Planned Unit Development (PUD) Final Plan, S #409, for an airpark with 39 hanger lots and
one residential lot which includes the airstrips and control tower for a parcel of land located on
the following described real estate, to -wit:
A parcel located in Sections 30 and 31, Township 2 North,
Range 65 West of the 6th P.M., Weld County, Colorado
WHEREAS, at said hearing on January 8, 1997, the Board deemed it advisable to
continue said matter to February 12, 1997, at 10:00 a.m., at which hearing the applicant was
represented by Kevin Kinnley, partner in Platte Valley Airpark, and
WHEREAS, Section 28.14 of the Weld County Zoning Ordinance provides standards for
review of such a PUD Final Plan, and
WHEREAS, the Board of County Commissioners heard all the testimony and
statements of those present, studied the request of the applicant and the recommendations of
the Weld County Planning Commission, and, having been fully informed, finds that this request
shall be approved for the following reasons:
1. The applicant has complied with all the application requirements listed in Section
28.9 et seq., of the Weld County Zoning Ordinance.
2. The request is in conformance with Section 28.14 of the Weld County Zoning
Ordinance as follows:
A. Section 28.14.1 -- The proposed PUD Final Plan is consistent with the
Weld County Comprehensive Plan and is compatible with the future
development as permitted by the existing PUD District and plans of
affected municipalities. The City of Fort Lupton has reviewed the request
and found no conflicts.

B. Section 28.14.2 -- The PUD Plan conforms to the approved PUD District.
The Utility Coordinating Advisory Committee reviewed and conditionally
approved the PUD utility plan at its November 14, 1996 meeting. The
concerns of the Utility Coordinating Advisory Committee are addressed in
the conditions of approval.
C. Section 28.14.3 -- The uses, buildings, and structures shall be compatible
with the existing and future development of the surrounding area as
permitted by the existing zoning and with the future development
projected by the Comprehensive Plan or Master Plan of affected
municipalities.
D. Section 28.14.4 -- The proposed PUD Final Plan conforms with the
performance standards in Section 35.3 of the Weld County Zoning
Ordinance. The uses that require water and sewage disposal are
existing and are served by a well and individual septic systems.
E. Section 28.14.5 -- The proposed PUD Final Plan will be in compliance
with the Weld County Zoning Ordinance, Section 50, Overlay Districts.
The site is not located within any overlay districts. The U. S. Army Corps
of Engineers reviewed this proposal and indicated that a Department of
Army (DA) Permit will not be required.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the application of Platte Valley Airpark, c/o Marilyn Taylor,
requesting a Site Specific Development Plan and Planned Unit Development (PUD) Final Plan,
S #409, for an airpark with 39 hanger lots and one residential lot which includes the airstrips
and control tower on the above referenced parcel of land be, and hereby is, granted subject to
the following conditions:
1. Prior to recording the PUD Final Plan plat:
A. The Board of County Commissioners shall review and approve the
subdivision improvements agreement for off -site and on -site
improvements and the form of collateral. The security for the agreement
shall be tendered and accepted by the Board of County Commissioners
for the subdivision improvements agreement.
B. The applicant shall submit evidence to the Department of Planning
Services that any proposed fire protection system will meet the standards
of the Hudson Fire Protection District.
C. The PUD Final Plan shall be amended to comply with the Conditions of
Approval by the Weld County Utility Advisory Committee at the
November 14, 1996, meeting.

D. The applicant shall submit the following items to the Weld County
Department of Public Works for review and approval:
(1) A drainage study certification sheet that has been signed and
stamped by the Colorado registered professional engineer that
created the drainage report for this proposal.
(2) Documentation that addresses the plan for any repair for the
existing runway.
E. The applicant shall submit to the Department of Planning Services written
evidence that an agreement has been made with Patina Oil and Gas
Company concerning access and operations.
F. The applicant shall submit evidence to the Department of Planning
Services that an appropriate entity has been contracted with to manage
the escrow account for the planned improvements on -site.
2. The following notes shall be placed on the PUD Final Plan plat prior to recording:
A. The uses permitted within the PUD Final Plan for the Platte Valley Airpark
include 1 residential lot which includes the airstrips and control tower and
39 hanger lots, all of which comply with the PUD Zone District
requirements and are as described in the application materials.
B. Approval of this plan may create a vested property right pursuant to
Section 90 of the Weld County Zoning Ordinance.
C. An existing well shall provide water for the uses within the airpark.
D. Existing septic systems shall provide sewage disposal to the residential
use within the PUD Zone District.
E. Installation of all utilities shall comply with Section 10 (Design Standards)
of the Weld County Subdivision Ordinance.
F. All uses within the PUD Final Plan shall comply with the requirements of
the Hudson Fire Protection District.
G. Access to the development shall be one access from Weld County Road
39.
H. All uses within the PUD Final Plan shall maintain compliance at all times
with the U. S. Army Corps of Engineers requirements/standards.
Lot identification shall be in place prior to release of building permits.

J. Exterior illumination of the home, yard, garage, and driveway shall be
restricted as follows:
(1) Sources of light shall be shielded so that beams of light will not
shine directly onto adjacent properties.
(2) Neither the direct nor reflected light from any light source may
create a traffic hazard to operators of motor vehicles on public or
private streets.
K. All liquid and solid wastes shall be stored and removed for final disposal
in a manner that protects against surface and groundwater
contamination.
L. No permanent disposal of wastes shall be permitted at this site.
M. Waste materials shall be handled, stored, and disposed in a manner that
controls fugitive dust, blowing debris, and other potential nuisance
conditions.
N. Fugitive dust shall be controlled on this site.
O. The site shall at all times maintain compliance with the Federal Aviation
Administration regulations/requirements.
P. Landscaping including, but not limited to, trees, shrubs, fencing, and
entry signs or walls, will not be allowed within the right-of-way of Weld
County Road 39.
Q. The uses within the PUD Final Plan shall at all times maintain compliance
with the Colorado Division of Water Resources requirements/standards.
R. All construction on site shall meet the requirements of the Weld County
Departments of Public Works and Building Inspection, Weld County
Zoning Ordinance, Weld County Subdivision Ordinance, and the
approved covenants.
S. On -site improvements shall be required only after the required number of
hanger lots have been sold to obtain the funds to complete the
improvements within "Area B".
3. The Final PUD Plan plat shall meet all requirements of Section 28.11.5 of the
Weld County Zoning Ordinance and be submitted to the Weld County
Department of Planning Services within 30 days of approval by the Board of
County Commissioners.
