KELLY WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners, pursuant to its authority under Section 30-28-101(10)(d), CRS, as amended, did determine at a public meeting held in the Chambers of the Board, that a certain parcel of land, to be divided into two parcels, as shown on the plat known as Recorded Exemption #1927, does not come within the purview of the definition of the terms, "subdivision" and "subdivided land", and WHEREAS, the request for Recorded Exemption #1927 was submitted by Thomas G. Kelly, 2401 Weld County Road 42, Berthoud, Colorado 80513, for property which is described as Lot B of RE #1164, located in part of the S1/2SW1/4 of Section 21, Township 4 North, Range 68 West of the 6th P.M., Weld County, Colorado, being more particularly described in the plat which shall be provided by the applicant and known as Exhibit "A", said plat to be recorded, and WHEREAS, this request is to divide the property into parcels estimated to be approximately 44.32 acres and 34.5 acres. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the hereinabove described parcel of land be, and hereby is, exempt from the definition of the terms, "subdivision" and "subdivided land". BE IT FURTHER RESOLVED by the Board that Recorded Exemption #1927 submitted by Thomas G. Kelly be, and hereby is, approved conditional upon the following: 1. A Weld County septic permit is required for any proposed home and shall be installed according to the Weld County Individual Sewage Disposal System (ISDS) regulations. 2. Prior to recording the plat: A. Any existing septic system which is not currently permitted through the Weld County Health Department will require an ISDS evaluation prior to the issuance of the required septic permit. In the event the system is found to be inadequate, the system must be brought into compliance with current ISDS regulations. B. The following note shall be placed on the plat: NOTE: All proposed or existing structures will or do meet the minimum setback and offset requirements for the zone district in which the property is located. All future construction occurring on Lots A or B shall comply with Flood Hazard Overlay District requirements, if applicable. 4. The existing west access from Lot A to Weld County Road 42 shall be relocated to a point farther to the east, which has bee approved by the Weld County Public Works Department. 5. Lot A shall retain one access from Weld County Road 5 and two accesses from Weld County Road 42. Lot B shall retain one residential access from Weld County Road 42. No additional access shall be granted. 6. The applicant shall submit a mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be prepared in accordance with the requirements of Section 11.7 of the Weld County Subdivision Ordinance. The plat shall be submitted within sixty days from the date of approval by the Board of County Commissioners. The applicant shall be responsible for paying the recording fees. She stated the applicant was unable to obtain 70 percent of the surrounding property owners' signatures and explained the Assessor's Office originally provided him with too many names. Chair Kirkmeyer noted Henry Chavez was in her office and submitted several documents, which are included in the Board's packets, questioning the legal owner of the property and indicating the surveyors used the wrong map. Ms. Eastin confirmed the mobile home already exists on the property; however, no violation was issued. Mr. Barker clarified Sharon White, Planning Department, researched the legal ownership of the property at a title company and concluded Mr. Minjares owns all land on which he is applying for this permit. He noted staff cannot confirm Mr. Chavez's concern and referenced an old railroad right-of-way which was deeded in part to Mr. Chavez and in part to Weld County. Luis Minjares, applicant, requested permission for his mobile home to remain on his property and confirmed acceptance of all Conditions of Approval. No public testimony was offered. She located the existing accesses and prime farm.land and further reviewed the reasons for denial, including the high concentration of recorded exemptions in an area where prime farm land and irrigation water are in abundance. Responding to questions from the Board, Ms. Dunn explained the reason for requesting the property be split into two large parcels is the applicant is approaching retirement and would like to live on Lot A and maintain the alfalfa field for grazing. Kelly The Department of Planning Services' staff recommends denial for the following reasons: 1) The request does not comply with the intent of the A(Agricultural)zone district as set forth in the Weld County Comprehensive Plan,as amended, specifically Goal 4 and Policies 4, 4.1, 4.1.4 and 4.1.6; and Goal 9. Agricultural Goal 4 ...The intent of this goal should be to maintain and enhance the highest level of agricultural productivity in Weld County. Agricultural Policy 4 Applications for the division of land which is zoned agricultural shall be reviewed in accordance with all potential impacts of the division on the agricultural community. The criterion shall include but not be limited to: Agricultural Policy 4.1 Soil classifications; Agricultural Policy 4.1.4 The level of development associated with the site; Agricultural Policy 4.1.6 Feasibility for continued farm production on the site. Agricultural Goal 9 The minimum lot size of parcels in the Agricultural zone district should remain at 80 acres to encourage parcels large enough to retain viable farming operations or to accommodate modem agricultural equipment and irrigation practices. Lots of lesser size are not generally practical to farm due to large scale management practices existing today. 2) The request does not comply with the intent of the Weld County Subdivision Ordinance, as amended, specifically Section 1.3, 1.3.1 and 1.3.10. Section 1.3 The purpose of this Ordinance is to achieve orderly and efficient development by: Section 1.3.1 Assisting orderly and integrated development; Section 1.3.10 Preserving agricultural land and promoting its most productive agrarian use. 9, 1.592 • The 79 acre parcel has been divided twice before, once through the MS (minor subdivision) process in 1972, and the other through the RE(recorded exemption)process in 1989. The majority of the site is identified as prime farmground and 55 acres are maintained in alfalfa. According to the application, adequate water can be made available to the property to flood irrigate. A portion of the prime land(contained in Lot A)has not been farmed by the Kellys because irrigation of this area from a separate ditch would be necessary; a portion of this area is used to graze cattle. The applicants wish to sever approximately 14 acres of the irrigated farmground(alfalfa)from proposed Lot B for inclusion into Lot A. It is staffs opinion that the cultivated area should be maintained as one unit in order to preserve agricultural viability on this parcel. Three recorded exemptions have been approved on parcels situated directly east of and adjacent to this parcel. Five residences exist on these parcels with the potential for the construction of two or more in the future. Additionally, there is an existing tap on the smaller parcel which can be moved from its current location north of the river. 2. Sewage disposal. The larger parcel has an existing septic system. The smaller parcel can be served by a similar septic system. 3. Current use of property. The property is currently being used for a residence, raising alfalfa, and a small cow-calf operation. Improvements include a single family residence, horse shed, shop and a cow shed. Approximately 55 acres are farmed. The rest is land that is too hard to irrigate, is along the river bank and is covered with willows or washed out from the changes in the river bank over the years. Part of the property,where the improvements are located, is also north of the river and not accessible for farming. There is irrigation water on the property sufficient to flood irrigate once per year, but there is not enough water to raise a row crop. Cattle are currently raised on the property for a few months in the spring before they are moved to summer pastures. 4. Reason for proposed recorded exemption. I want to divide this land into two parcels. My residence will be located on the larger parcel. The improvements will be on the smaller parcel, and it could be used for a single family residential building site. Both lots will have irrigation water and can continue to be farmed as they are currently being farmed. In fact, the southwest portion of the smaller parcel has not been irrigated by me because it requires irrigation from a separate ditch. A person who had only the smaller lot to take care of might more easily irrigate that portion and raise a crop on it. S. Description of prQp,wd new lot. The proposed new lot will be the approximately 34.8 acres lying directly isf of Weld County Road 5. Current , •my about 14 acres of this parcel is being farmed. The remainder includes approximatel 10 • res of uncultivated land (which I do not farm because it runs to the east and has to be irrigated separately),the improvements and a cattle working area located north of the river, and land along the river which cannot be cultivated. 6. Note on plat. The note will be placed on the plat. 7. N/a 8. Compatibility with existing surrounding land uses. No change in the use of this land is contemplated other than the possible addition of a single family residence on the smaller parcel. The land will continue to be used for such crop production as is possible given the amount of water available. As stated above, an additional 10 acres might even be added to production if an 961592 O owner of the smaller parcel decided to irrigate that portion which runs to the east. There are approximately 7-10 single family residences within a one mile radius of the property. 9. Consistency with intent of agricultural district. The proposal will preserve the property for the same use as currently exists. As it is currently used,only about 14 acres of the smaller parcel are being farmed. The only land that might be taken out of production would be a relatively small piece from the smaller parcel for a residential building site and driveway. It would be necessary to place a residence approximately 400 feet back from the road, and given the location of the flood plain and river, this would have to be toward the eastern end of the smaller parcel. The irrigation water will remain with the properties in proportion to their relative size. Although the total property as it currently exists contains approximately 78 acres, it is too small for profitable commercial agricultural purposes because there are only 55 acres of farmable land and there is insufficient water to plant a row crop. As stated above, it is possible that the 10 acres in the southwest portion of the smaller parcel might be added to production. 10. Consistency with efficient and orderly development. There would be no real change in the nature of the use of this property. My wife and I currently live in the residence, and I raise enough alfalfa to feed the cattle in my cow-calf operation during the period of time they are pastured on the property. Because of the location of the improvements and the river and flood plain, not all of the property is farmable. Furthermore, a portion of the property falls to the east, requiring separate irrigation, and as a result, this portion has not been farmed by me due to the inconvenience. The water and mineral rights will remain with the property.
