Subject: AmUSR-397; J.C.K. Gravel and Boulder Creek Estates, LLC.
The Weld County s partment has reviewed this proposal; the following comments are
recommended to be a part of any approval:
1. The applicant is indicating that the Colorado Department of Transportation (CDOT) has
approved the transport of the conveyor system to pass under State Highway 119 at the bridge
adjacent to the St. Vrain Creek. This needs to be verified with the CDOT. Please contact
Tess Jones at the Greeley office for verification.
2. In reference to the Hamm Pit, 23.01 acres, the USR is indicating that WCR 5.5 enters State
Highway 119 at a 45° angle. Weld County has worked with the Olivers on the Meadow Vale
Farms,which is adjacent to WCR 5.5. WCR 5.5 will be realigned to State Highway 119 at
a 90° angle. I would like to have the applicant adjust the mylars to reflect the new
realignment at this location.
3. The applicant has indicated in the Extraction St. u e,.... section of the proposal that no
excavation of sand and gravel will occur wit n 10 - t of the boundaries of the adjacent
properties. The Weld County setback requirement is a minimum distance 20 fe om the
property lines or right-of-way of any mining operation in an agricultura zone. Irrigation o
ditches and rivers require additional setback. Please check with the Colorado State Mining
and Geology Division on those requirements. The 200 feet setback from a "man made
structure" will be reviewed next to every Weld County road prior to approval.
4. Any new accesses to Weld County roads require an access information sheet, which is
available through the Public Works Department located at 933 North 11th Avenue, Greeley,
Colorado.
Addressing Raod Improvements for Heavy Hauling:
Western Mobile Companies along with the other heavy gravel, asphalt, or concrete haulers have
previously entered into a Road Improvements and Maintenance Agreement with Weld County on
the repair, upgrade or paving of WCR 7, WCR 20.5, and designed haul areas within the MUD area.
No additional road agreements would be required for this operation.

Environmental Protection Services has reviewed this proposal; the following
conditions are recommended to be part of any approval:
1. All liquid and solid wastes shall be stored and removed for final disposal
in a manner that protects against surface and groundwater contamination.
2. No permanent disposal of wastes shall be permitted at this site.
3 . Waste materials shall be handled, stored, and disposed in a manner that
controls fugitive dust, blowing debris, and other potential nuisance
conditions.
4. Fugitive dust shall be controlled on this site.
5. The maximum permissible noise level shall not exceed the industrial limit
of 80 dB(A) , as measured according to 25-12-102, Colorado Revised
Statutes.
6. A NPDES Permit shall be obtained from the Water Quality Control Division
of the Colorado Department of Health for any proposed discharge into State
Waterways.
7. The applicant shall remove, handle, and stockpile overburden, soil, sand
and gravel from the facility area in a manner that will prevent nuisance
conditions.
8. An Air Pollution Emission Notice and emission permit shall be obtained if
required by the Air Pollution Control Division of the Colorado Department
of Public Health for emissions from the mining operations & concrete &
asphalt botching. The site shall operate in accordance with all applicable
rules and regulations of the Air Pollution Control Division.

9. The operator shall submit dust abatement plan for approval to both the W.C
Planning Department and the W.C. Health Department.
10. An individual sewage disposal system shall be installed according to the
Weld County I.S.D.S. Regulations for the office, shop building, concrete
plant, and any other structure constructed on the site in which people will
be working, congregating, bathing, etc. Portable toilets may by utilized
on sites which are temporary locations of the working face & portable
processing equipment , etc. for up to six months at each location.

Dear Todd:
Thank you very much for sending the four related applications concerning the currently permitted
sand and gravel mining operations located on either side of SH119 at St. Vrain Creek to the City
of Longmont for our review and comment. These mining operations are known as the Hamm Pit
(on the north side of SH119) and the Boulder Creek Estates Pit (on the south side of SH119).
According to the applications, the intent is to extend the focus of the processing and sales
activities at the current area located at the northwest corner of SH119 and WCR7 and to install
a portable conveyor under SH119 at St. Vrain Creek so that this processing facility can serve the
mining operations located south of St. Vrain Creek.
The City of Longmont's comments primarily concern St. Vrain Creek. The City of Longmont
and Weld County have plans for a trail along St. Vrain Creek, and I believe Weld County has
plans for a trail along Boulder Creek. The reclamation plans submitted with these applications do
not indicate that there will be trails along either of these creeks that are accessible to the public
in the future. If Weld County has the ability to get the reservation and/or dedication of these trails
as part of this review process, we encourage you to consider it as part of your deliberations on
these applications.
The applications indicate that excavation will either be kept 10 ft. away or 100 ft. away from St.
Vrain Creek. The City prefers the 100 ft. distance. Also, the City requests that Weld County
ensure the mining operations disturb St. Vrain Creek as little as possible.
The applications indicate that the area south of SH119 and St. Vrain Creek is to remain
undisturbed and is reserved as a wildlife habitat. The City supports this intent and assumes that
Weld County will further detail this reservation during its review of these applications.

located in the Southeast '/4 of Section 4, Township 2 North, Range 68 West, Weld County,
Colorado.
This office is aware of this activity. Western Mobile Boulder, Inc. has been informed
of the need for a Department of the Army permit for this project and is acting accordingly.
