Longmont CO 80504 JUN 1 2 1998 303 833 2992 June 9, 1998 Monica Daniels-Mika, Director, i ' turn Weld County Planning Services ti 1400 N. 17th Avenue Greeley CO 80631 Subject: Case No. Z-513, The Elms at Meadow Vale Dear Ms Daniels-Mika: I noticed two apparent discrepancies in reviewing the Weld County Referral of the subject case: 1] From the area identified on the flood plain map submitted, it appears that the land is located west, not east of CR5.5 as stated on the Referral cover sheet, and 2] the location is entirely misplaced on the submitted Geological Hazard Map, as being south of SH52 iu TIN R68W. Based on this, it might be indicated that the contents of all documents presented should be closely scrutinized for accuracy. 1. The fact that no gas or oil wells exist at the site doe not preclude that their may be rights to drill wells in the future. This should be confirmed to avoid the planning conflicts experienced at Firestone's St. Vrain Ranches project. 2. It is hoped that the developer will comply with the requirements of the St. Vrain Valley School District for land or cash in lieu, as Weld County government has no IGA with the Distinct compelling such compliance by the developer. 3. It is hoped that provision has been made for the continuance of CR5 adjoining the property on the west to continue completion of the County one mile grid of roads [subject to land contour restrictions]. 4. It is to applauded that 30% of the site will be reserved as open space, so that in some small measure the character of the area will be retained. 5. It is hoped that any new electric feeders to the site will be placed underground. If the developer is proposing a subdivision similar to that at Meadow Vale located at CR5.5 north of SH119, it would be appropriate for this agricultural area. If you could forward to Virginia Shaw, the St. Vrain Rural Impact District liaison, a copy of the Change of Zone plan and narrative submittals, we would be better able to comment on its appropriateness and the comments made in the bha design, inc. letter of May 18, 1998 which apparently were in response to questions raised byy Weld County Planning Services in the original submittal. Daniels-Mika: This firm represents Thomas W. Adam and George Adam, Jr. They own and operate an agricultural business operation known as Adam Dairy. By letter dated May 21, 1998, they were notified that Mr. Oliver has applied for a zoning change for property located very close to their dairy operation. The Adam family has conducted a full time dairy farm on their property for many years . Before the county approves any zoning change which would permit non-agricultural use of the Oliver property, my clients would like the county and the applicant to consider the following factors which are natural results from the operation of their dairy farm: 1 . The dairy farm operates on a 24 hour per day basis; 2 . The dairy farm produces odors which some residents might find to be offensive; 3 . There are insects which exist on the farm; 4 . There is heavy truck traffic; 5 . There is crop spraying which occurs on the property; 6 . The cattle and machinery will produce noise . My clients are not opposed to development of the Oliver property. However, my clients would also want these factors noted on any map or plat which governs the property to be developed. My clients want all potential occupants of the Oliver property to be fully informed of the existence of the Adam Dairy operation and the by-products of the operation. �Sr� Please contact me with any comments or questions .
