HomeMy WebLinkAbout950745.tiffHEARING CERTIFICATION RE: VIOLATIONS OF THE WELD COUNTY BUILDING CODE AND ZONING ORDINANCES A public hearing was conducted on April 11, 1995, at 10:00 a.m., with the following present: Commissioner Dale K. Hall, Chairman Commissioner Barbara J. Kirkmeyer, Pro-Tem Commissioner George E. Baxter Commissioner Constance L. Harbert Commissioner W. H. Webster Also present: Acting Clerk to the Board, Lin Dodge County Attorney, Bruce Barker Planning Department representative, Keith Schuett Planning Department representative, Ed Stoner The following business was transacted: I hereby certify that a public hearing was conducted to consider whether to authorize the County Attorney to proceed with legal action against the individuals named for violations of the Weld County Building Code and Zoning Ordinances. Cases were heard as follows. BCV #2147 - Elizabeth Parker Sellers: Ed Stoner, Department of Planning Services, reported he had talked to Bob Parker, Elizabeth Sellers' son and representative, who indicated Mrs. Sellers is hospitalized at this time and requested the case be continued to May 9, 1995. Commissioner Baxter moved to continue BCV #2147 against Elizabeth Parker Sellers to May 9, 1995 at 10:00 a.m. The motion was seconded by Commissioner Webster and passed unanimously. BCV #2165 - Michael and Robert Phelan: Mr. Stoner reported this case closed. BCV #2160 and 2161 - River Valley Village and Servando and Ofelia Martinez. Tenants: Mr. Stoner reviewed the case file for the record and indicated the property owners failed to acquire final inspections by June 9, 1994, and failed to obtain a permit for the deck/patio, which violates Sections 60.5.1. 20.9.8, 70.4.2, and 30 of the Weld County Building Code Ordinance. In response to Commissioner Harbert, Mr. Stoner indicated staff contacted the property owners on April 10, 1995, with no response. The property owners were neither present nor represented. No public comment was offered. Commissioner Harbert moved to refer BCV #22160 and 2161 against River Valley Village and Servando and Ofelia Martinez, tenants, to the County Attorney for legal action. Commissioner Kirkmeyer seconded the motion, which carried unanimously. VI #2170 - Richard and Nancy Marshall (cont. from 3/14/95): Keith Schuett, Department of Planning Services, reviewed the case report for the record and presented a video of the property taken at the April 10, 1995, inspection. He indicated the property still is in violation and stated a dog on the property kept him from the front door, and the property owners did not respond to his car horn. Mr. Schuett clarified the property location for the Board. Bruce Barker, County Attorney, reviewed his phone conversation with Mr. Marshall on March 14, 1995, during which Mr. Marshall requested a continuance and indicated he would license the derelict vehicles and attempt to remove some of the miscellaneous junk materials. The property owners were neither present nor represented at this time. No public comment was offered. Commissioner Harbert moved to refer VI #2170 against Richard and Nancy Marshall to the County Attorney for legal action. Commissioner Baxter seconded the motion, which carried unanimously. 950745 PL0824 de. Pc; C`/9 BUILDING CODE AND ZONING VIOLATIONS PAGE 2 VI #2137 - George and Cinthia Beaman: Mr. Schuett reviewed the case report for the record and presented a video of the property taken April 10, 1995. He reported this property was previously in violation and the owners did screen a portion of the property; however, derelict autos and other junk are now piled outside the screened area. The property owners were not present or represented. No public comment was offered. Commissioner Baxter moved to refer VI #2137 against George and Cinthia Beaman to the County Attorney for legal action. The motion was seconded by Commissioner Webster and carried unanimously. VI #2173 - Lorene Hill: Mr. Schuett reviewed the case report for the record and indicated staff has had no contact with the property owner or her representative since March 14, 1995. He added that an unpermitted mobile home is now on the property and the property owner will be notified of said violation. The property owner was not present or represented at this time. No public comment was offered. Commissioner Harbert moved to refer VI #2173 against Lorene Hill to the County Attorney for legal action. Commissioner Kirkmeyer seconded the motion, which carried unanimously. This Certification was approved on the 17th day of April, 1995.
