Ferguson viewers appointed July 19th.1900 to view a line of road commencing at the county road in Section 27 .Town. 11 N.R&nge 67 W. at or near Carr,Weld County,Colo- rado,and running thence in an Easterly direction to the North line of Section 3 T. 10 N.R.66 W. ,thence in an Easterly direction to or near the South line of Sec- tion 24 T. 11 N.R.64 W.in what is known as the GERRY VALLEY,thence in an Easterly direction intersecting the county road at the S.W. corner of Section 24 T. 11 N.R. t62 W. The above road to be on or near the road as now traveled. ,was presented Nz P'Ito the Board when the following action was taken and entered of reaord,to-wit: The Board having carefully considered the report of the viewers herein,as well as the objections made thereto,and finding the report correct as to form,and be- flaying the public good requires the laying out of : the road as recommended by the , viewers,it was on motion ordered that the report be approved and adopted,and the oroad therein described and recommended by the viewers be and is hereby declared a public highway. The Clerk is directed to record the report ,plat the road,and cause notices to be posted of opening of said road,and notify the Roadi-Overseer of proper district to open the same to travel in ,sixty days as required by law. Report of the Superintendent of the Hospital for the month of October was presented, examined and ordered placed on file. IN THE MATTER OF PETITION OF ROBERT HALE. A petition was presented from Robert Hale praying for a reduction in the assessment for the year 1900 on Lots 7 ,8,9 and 10 in Block 70 Hunter' s Subdivision and that said assessment be made on a equitable basis ,and 'after carefully con- sidering the matter,it was on motion ordered that the prayer of the petitioner be granted and that the assessment on said lots be reduced from $200.00 to $50 .00. o IN THE MATTER OF PETITION OF THE DIVIDE DRAINAGE & IRRIGATION CO. A petition was presented from the Divide Drainage & Irrigation Co. praying for the use of the East half mile of the section line road com- mon to sections 8 & 17 Tp.6 N.R.65 W. ,that is common to the S.E4 of Sec.8 and the N.E`4 of Sec. 17 aforesaid,for the purpose of erecting thereon an embankment for a reservoir. In consideration ofgranting the same it will agree to make the embankment at least 20 feet wide on top and in such a manner that its present use as a public road will not be interfered with. After due consideration it was on motion ordered that the prayer of the petitioner be and is hereby granted. Cloud came before the Board and stated that while crossing a bridge over No. 2 Ditch North of Windsor recently with his threshing engine the bridge gave way thereby letting his engine fall into the ditch and in consequence thereof it is considerably damaged and will take a great deal of time and money to get it out and restore it to its former condition;that the bridge was old and not sufficiently strong to hold up such weight and therefore under the circumstances he asks the Board to reimburse him for the damages sustained. After discussing the matter ful- ly the same was taken under consideration. A petition was presented from P.W.Putnam praying for a rebate of taxes asses'3ed against him for the years 1891 ,1892 and 1893 on Moneys ,Notes and Credits for the reason that during said years he was a resident of Morgan County and was taxed in said county. After carefully considering the matter and believing his claim a just one ,it was on motion ordered that the prayer of the petitioner be granted and that the sum of $333.16 be refunded. IN THE MATTER OF THE LUCERNE CHUB HOUSE. Mr.A. C. Foster came before the Board and paid over the sum of $150.OO,being the balance of the purchase price for the Lucerne Club House, and asked that a deed be made to Sarah M.Foster for said property,whereupon it was on motion ordered that a proper deed be made ,executed and delivered by C.A.Bennett ,Public Trustee, conveying said property to said Sarah M.Foster. DOW. A petition was presented from F.M. Dow praying for a rebate of taxes assessed against her for the years 1898 and 1899 on her property in Evans for the reason that said assessments are, in the opinion of the petitiOner,too high. The following report of reduction made by the State Board of Equalization in the valuation of certain railroad property in thiS county was received and ordered spread upon the records in full,as follows:— STATE BOARD OF EQUALIZATION STATE OF COLD AD0 WILLIAM H.GRIFFITH DENVER. Dear Sir: In accordance with the provisions of an act of the Eighth General Assembly entitled "Revenue",to provide for the better assessment and collection of revenue;to prescribe the duties of the State Board of Equalization and county officers in relation thereto;to provide a penalty for the failure or neglect of duty in connection therewith,and to repeal all acts or parts of acts in conflict with this act ;I have the honor to submit herewith a statement of the number of miles and the valuation placed upon railroad,telegraph and telephone companies of your county by the State .Board of Equalization for the present year. These valuations include all property in this state owned,used or controller. by telegraph and telephone companies ,and all property in this state owned,used or controlled by railway corporations,including right of way,roadbed,side tracks bridges,culverts,fences ,snow sheds ,pipe lines ,materials ,tools,rolling stock, shops ,tanks ,depots ,turntables ,platforms; also all other buildings and real estate used or necessary to be used for the proper and convenient operation of said corporation not included in its right of way. IN THE MATTER OF PETITION OF FRITZ NIEMEYER. A petition was presented from Fritz Niemeyer pray- ing for a rebate of taxes assessed against him for the year 1899 on Sec.4 Tp.4 N.R.63 W. and the N.E4 of Sec. 17 Tp.4 N.R.65 W. for the reason that said assessment is excessive. After due consideration it was on motion ordered that the prayer of the petitioner. be and is hereby granted and that he be allowed a rebate on a valuation of $1810.00. IN THE MATTER OF APPORTIONMENT OF THE GENERAL ROAD FUND. He stated that under his present circumstances it would not be possible for him to crre for her properly at his home and asked that she be permitted to remain at the hospital and he would contribute the sum of $2.00 per month for her keeping and as much more as he possibly could. After discussin.; the matter fully it was decided to let her remain at the hospital for the present. IN THE MATTER OF THE PETITION OF THE MIDDLESEX BANKING CO. Mr.E. .Upham,Attorney for The Middlesex Bank- ing Co. ,came before the Board in regard to the petition filed for rebate of taxes assessed said company on omitted and unassessed taxable property consisting of Moneys,Notes and Credits. W.E.Austin presented a petition praying for a rebate of taxes assessed against the S.E4 of Sec. 12 Tp.6 N.R.67 W. for the year 1899 for the reason that the assessment placed on said land is greatly in excess of the true val- uation,which is not more than 0300.00. After carefully considering the matter it was on motion odered that the prayer of the petitioner be and is hereby granted and that he be allowed a rebate of said taxes on a valuation of 0520.00. DeVotie came before the Board, in behalf of the citizens residing West of the /I9 (1 City of Greeley and under canal No.3 ,and stated that owing to the large amount of seepage water in that locality those interested were going to drain it off and asked the Board to grant them permission to lay drain tile along the North side of the county road commencing at the South-west corner of the North-east Quarter of the South-west Quarter of Section 6 Township 5 North,of Range 65 W. thence running East to connect with the present drain at the West end of $th.Street in the City of Greeley. It appearing to the Board that a large overdraft exists in the. General County Fund and there is a balance to the credit of the Contingent Fund in the sum of $3494.8liabalance to the credit of the Interest Fund in the sum of $2691.41 and a balance to the credit of the County Poll Fund in the sum of $660.00. After due consideration it was on motion ordered that the County Treasurer be and is hereby authorized and directed to transfer to the General County Fund the respective balances now to the credit of the several funds above named for the purpose of reducing the overdraft now existing in the said General County Fund.
