HomeMy WebLinkAbout960751.tiff RECORD OF PROCEEDINGS MINUTES BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO APRIL 29, 1996 TAPE #96-13 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Centennial Center, Greeley, Colorado, April 29, 1996, at the hour of 9:00 a.m. ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner Barbara J. Kirkmeyer, Chair Commissioner George E. Baxter, Pro-Tem Commissioner Dale K. Hall Commissioner Constance L. Harbert Commissioner W. H. Webster Also present: County Attorney, Bruce T. Barker Acting Clerk to the Board, Shelly Miller Finance and Administration Director, Don Warden MINUTES: Commissioner Harbert moved to approve the minutes of the Board of County Commissioners meeting of April 24, 1996, as printed. Commissioner Webster seconded the motion, and it carried unanimously. CERTIFICATION OF HEARINGS: Commissioner Baxter moved to approve the hearings conducted on April 24, 1996, as follows: 1) Intent Hearing - Weld County Roth Subdivision Local Improvement District No. 1995-1; 2) Intent Hearing - Weld County Delwood Avenue Local Improvement District No. 1995-2; 3) Special Review Permit for an archery range and concrete and asphalt storage, crushing, and screening facility in the A (Agricultural) Zone District, City of Greeley, c/o Joe Lohnes; and 4) Amended Special Review Permit for a feedlot (4,000 head of cattle) in the A (Agricultural) Zone District, Robert Wardlaw, Loving Trust. Commissioner Harbert seconded the motion, which carried unanimously. ADDITIONS: There were no additions to the agenda. CONSENT AGENDA: Commissioner Harbert moved to approve the consent agenda as printed. Commissioner Webster seconded the motion, and it carried unanimously. 960751 BC0016 READING OF ORDINANCE BY TAPE: CONSIDER READING ORDINANCE NO. 89-FF BY TAPE: Commissioner Harbert moved to allow the reading of Ordinance No. 89-FF by tape. Commissioner Hall seconded the motion, which carried unanimously. PROCLAMATIONS: WELD COUNTY HEAD START DAY - APRIL 30, 1996: Linda Aragon, President of the Parent Policy Council, thanked the Board and presented each Commissioner with a ribbon to wear on Head Start day. COMMISSIONER COORDINATOR REPORTS: No reports were given. PUBLIC INPUT: No public input was offered. WARRANTS: Don Warden, Director of Finance and Administration, presented the following warrants for approval by the Board: All Funds $ 196,818.33 Electronic Transfer: Payroll Fund $ 1,525,687.30 Commissioner Webster moved to approve the warrants as presented by Mr. Warden. Commissioner Hall seconded the motion, which carried unanimously. BUSINESS: NEW: CONSIDER ECONOMIC DISLOCATION AND WORKER ADJUSTMENT ASSISTANCE SUBSTATE AREA GRANTEE PLAN BETWEEN EMPLOYMENT SERVICES AND GOVERNOR'S JOB TRAINING OFFICE AND AUTHORIZE CHAIR TO SIGN: Commissioner Harbert moved to approve said plan and authorize the Chair to sign. Commissioner Baxter seconded the motion, which carried unanimously. CONSIDER SINGLE ENTRY POINT AGENCY CONTRACT BETWEEN AREA AGENCY ON AGING AND COLORADO DEPARTMENT OF HEALTH CARE POLICY AND FINANCING AND AUTHORIZE CHAIR TO SIGN: Walt Speckman, Human Services Director, stated this contract is for the continuation of the long-term care programs. He noted the program is larger because the case load has grown, but all other items remain the same as in the past. Commissioner Harbert moved to approve said contract and authorize the Chair to sign. The motion, seconded by Commissioner Webster, carried unanimously. Minutes, April 29, 1996 960751 Page 2 BC0016 CONSIDER TEMPORARY CLOSURE OF WELD COUNTY ROAD 380 BETWEEN WELD COUNTY ROADS 63 AND 65: Commissioner Hall moved to approve said closure, and Commissioner Baxter seconded the motion, which carried unanimously. SECOND READING OF ORDINANCE NO. 118-N, IN MATTER OF AMENDING ORDINANCES NO. 118-J, NO. 118-K, NO. 118-L,AND NO. 118-M, THE WELD COUNTY PERSONNEL POLICY HANDBOOK: Commissioner Hall moved to read said ordinance into the record by title only, and Commissioner Harbert seconded the motion, which carried unanimously. Mr. Barker read the title of Ordinance No. 188-N into the record, and no public testimony was offered. Commissioner Harbert moved to approve the second reading of Ordinance No. 118-N, and Commissioner Webster seconded the motion, which carried unanimously. FINAL READING OF ORDINANCE NO. 77-D, IN MATTER OF REPEAL AND REENACTMENT WITH AMENDMENTS OF ORDINANCE NO. 77-C, EMERGENCY MEDICAL SERVICES RULES AND REGULATIONS: Commissioner Harbert moved to read Ordinance No. 77-D into the record by title only, and Commissioner Hall seconded the motion, which carried unanimously. Mr. Barker read the title of said ordinance into the record, and no public testimony was offered. Commissioner Harbert moved to approve the final reading of Ordinance No. 118-N, and Commissioner Hall seconded the motion, which carried unanimously. PLANNING: FIRST READING OF ORDINANCE NO. 89-FF, IN MATTER OF AMENDING WELD COUNTY ZONING ORDINANCE: Mr. Warden confirmed the playing of the tape was complete. Monica Mika, Planning Department Director, submitted Exhibits A and B, respectively, for the record including a diagram of"Features of Proposal" and a letter dated April 23, 1996, from Ronald L. Erbes, Silver Sage Ranch. She then stated the purpose of the amendments to said ordinance are for clarity. Ms. Mika responded to questions from the Board concerning the changes made by the Planning Commission. Mr. Erbes stated he is a farmer/rancher in the Galeton community and reviewed his diagram and request to allow a primary and secondary home. He stressed the need for housing for the handicapped and aged which is not temporary. Responding to the Board, Ms. Mika explained Mr. Erbes' options and suggested "attaching structure" be replaced with "auxiliary quarters" in Section 10.1.A.7. She also suggested amending the regulations of the "ZPAD", which is an accessory dwelling permit, rather than changing this ordinance. Mr. Erbes made further comments and submitted a newspaper article from The Denver Post dated February 1, 1996, regarding "march septic systems"as Exhibit C for the record. He and Ms. Mika responded to further questions from the Board; no other public testimony was offered. Commissioner Harbert moved to approve Ordinance No. 89-FF on first reading including the replacement of "attaching structure" with "auxiliary quarters" in Section 10.1.A.7. Commissioner Hall seconded the motion, which carried unanimously. Minutes, April 29, 1996 960751 Page 3 BC0016 RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the consent agenda. Ordinance No. 89-FF was approved on first reading, as amended; Ordinance No. 118-N was approved on second reading; and Ordinance No. 77-D was approved on final reading. Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted by the Acting Clerk to the Board.
